PROGRAM PROGRAMME wspó∏pracy mi´dzy Rzàdem Rzeczypospolitej Polskiej a Rzàdem Republiki S∏owenii w dziedzinie kultury, nauki i oÊwiaty na lata 2003—2006 of cooperation between the Government of the Republic of Poland and the Government of the Republic of Slovenia in the Field of Culture, Science and Education in the Years 2003—2006 Rzàd Rzeczypospolitej Polskiej i Rzàd Republiki S∏owenii, zwane dalej „Stronami”, The Government of the Republic of Poland and the Government of the Republic of Slovenia, hereinafter referred to as ”the Parties”, — kierujàc si´ postanowieniami artyku∏u 20 Umowy mi´dzy Rzàdem Rzeczypospolitej Polskiej i Rzàdem Republiki S∏owenii o wspó∏pracy w dziedzinach oÊwiaty, kultury i nauki, podpisanej w Warszawie dnia 14 lutego 1994 r., — pursuant to the provisions of article 20 of the Agreement between the Government of the Republic of Poland and the Government of the Republic of Slovenia on cooperation in the fields of education, culture and science, signed in Warsaw on February 14, 1994, — dà˝àc do rozszerzenia wymiany w dziedzinach kultury, nauki i oÊwiaty, — seeking to expand cooperation in the fields of culture, science and education, uzgodni∏y, co nast´puje: have agreed as follows: I. Kultura i sztuka I. Culture and Art Artyku∏ 1 Article 1 Strony, w okresie obowiàzywania Programu, wymienià po jednej wystawie sztuki wspó∏czesnej z uwzgl´dnieniem zainteresowania drugiej Strony. Under this Programme, the Parties shall exchange one modern art exhibition each guided by the wishes of the other Party. Wybór wystawy powinien byç dokonany na podstawie zg∏oszenia z 12-miesi´cznym wyprzedzeniem przed planowanym otwarciem ekspozycji. The selection of the exhibition shall be made on the basis of an application submitted 12 months before the planned opening of the exhibition. Artyku∏ 2 Article 2 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ mi´dzy zwiàzkami twórczymi, organizacjami i instytucjami kultury obu krajów. The Parties shall promote direct cooperation between artistic associations, organisations and cultural institutions of the two countries. Strony b´dà wspiera∏y wymian´ twórców, artystów i ekspertów w dziedzinie kultury na wizyty studyjne na okres nie d∏u˝szy ni˝ 30 dni dla ka˝dej ze Stron, w ramach programów rocznych instytucji kulturalnych, stowarzyszeƒ i organizacji. The Parties shall support exchanges of authors, artists and cultural experts, taking the form of study visits, with stays of up to thirty days for each Party within annual programme of cultural institutions, associations or organisations. Artyku∏ 3 Article 3 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ mi´dzy muzeami i galeriami sztuki, w tym wymian´ ekspertów oraz wspó∏prac´ w zakresie zachowania dziedzictwa kulturalnego mi´dzy instytucjami zajmujàcymi si´ ochronà i konserwacjà zabytków. The Parties shall support direct cooperation between museums and art galleries, including exchange of experts and cooperation in the field of preservation of the cultural heritage between institutions involved in the protection and conservation of cultural monuments. Dziennik Ustaw Nr 196 — 13392 — Poz. 1920 Artyku∏ 4 Article 4 Strony b´dà popiera∏y wymian´ doÊwiadczeƒ dotyczàcych tworzenia prawa regulujàcego ochron´ dóbr kultury, a w szczególnoÊci zwalczania nielegalnego wywozu dzie∏ sztuki zgodnie z „Konwencjà dotyczàcà Êrodków zmierzajàcych do zakazu i zapobiegania nielegalnemu przywozowi, wywozowi i przenoszeniu w∏asnoÊci dóbr kultury”, sporzàdzonà w Pary˝u dnia 17 listopada 1970 r. The Parties shall support exchange of experiences pertaining to domestic legislation concerning the protection of cultural values, with particular regard to combating illegal trafficking in works of art as envisaged in ”The Convention on Means of Prohibiting and Preventing Illicit Import, Export and Transfer of Ownership of Cultural Property”, signed in Paris on November 17, 1970. Artyku∏ 5 Article 5 Strony b´dà kontynuowa∏y wspó∏prac´ w dziedzinie archiwistyki mi´dzy Naczelnà Dyrekcjà Archiwów Paƒstwowych Rzeczypospolitej Polskiej a Archiwum Republiki S∏owenii w oparciu o bezpoÊrednie „Porozumienie o wspó∏pracy mi´dzy Naczelnym Dyrektorem Archiwów Paƒstwowych Rzeczypospolitej Polskiej a Archiwum Republiki S∏owenii”, zawarte 9 paêdziernika 1998 r. The Parties shall continue cooperation in the field of archives between the Head Office of State Archives of the Republic of Poland and the Archive of the Republic of Slovenia, on the basis of the ”Agreement on cooperation between the General Director of State Archives of the Republic of Poland and the Archive of the Republic of Slovenia”, concluded on October 9, 1998. W celu realizacji tej wspó∏pracy Strony zagwarantujà wymian´ ekspertów, na zasadzie wzajemnoÊci, w okresie dziesi´ciu dni roboczych rocznie. To implement this cooperation, the Parties shall exchange experts for stays lasting ten working days each year. Wspó∏praca ta b´dzie obejmowa∏a tak˝e realizacj´ mi´dzynarodowego projektu „Wspólne dziedzictwo archiwalne Europy Ârodkowej i Wschodniej”. The cooperation shall also include implementation of the international project ”Common archive heritage of Central and Eastern Europe”. Artyku∏ 6 Article 6 Strony b´dà popiera∏y wspó∏prac´ mi´dzy teatrami, stowarzyszeniami teatralnymi, scenami operowymi oraz w dziedzinie baletu przez: The Parties shall support collaboration between theaters, drama associations, operas and ballets through:

1. a)wymian´ zaproszeƒ na festiwale teatralne, operowe i baletowe,
2. a)exchange of invitations to drama, opera and ballet festivals,
3. b)wymian´ tekstów sztuk teatralnych,
4. b)exchange of theater play scripts,
5. c)wymian´ taÊm wideo z przedstawieniami teatralnymi.
6. c)exchange of videos with theater productions. Artyku∏ 7 Article 7 Strony b´dà popiera∏y wspó∏prac´ mi´dzy Bibliotekà Narodowà w Warszawie a Narodowà Bibliotekà Uniwersytetu w Lublanie i innymi polskimi i s∏oweƒskimi bibliotekami w zakresie: wymiany ksià˝ek, czasopism, materia∏ów audiowizualnych, wydawnictw w∏asnych, a w szczególnoÊci z zakresu bibliografii narodowych. The Parties shall promote cooperation between the National Library in Warsaw and the National and University Library in Ljubljana and other Polish and Slovene libraries in the fields of: exchanging books, periodicals, audio-visual materials and own publications, with particular regard to national bibliographies. Strony b´dà równie˝ popiera∏y wspó∏prac´ mi´dzy bibliotekami publicznymi i naukowymi oraz wymian´ ekspertów i doÊwiadczeƒ w wykorzystaniu nowych technik bibliotekarskich. in joint The Parties shall also support cooperation between public and scientific libraries, and shall promote exchange of experts and experience on the application of new librarianship technologies. Artyku∏ 8 Article 8 Strony b´dà organizowa∏y sta˝e dla polskich i s∏oweƒskich t∏umaczy literatury pi´knej. The Parties shall organize internships for Polish and Slovene translators of literature. Dziennik Ustaw Nr 196 — 13393 — Poz. 1920 Artyku∏ 9 Article 9 Strony b´dà wzajemnie informowa∏y si´ o najwa˝niejszych targach ksià˝ki, takich jak Mi´dzynarodowe Targi Ksià˝ki w Warszawie i Targi Ksià˝ki w Lublanie. The Parties shall inform each other on most important book fairs, such as the International Book Fair in Warsaw and Book Fair in Ljubljana. Artyku∏ 10 Artice 10 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ mi´dzy instytucjami, organizacjami i twórcami filmowymi obu krajów. B´dà równie˝ sprzyja∏y prezentacji filmów drugiego kraju w ramach mi´dzynarodowych festiwali filmowych organizowanych w swoim kraju zgodnie z regulaminami poszczególnych festiwali. The Parties shall promote direct cooperation between filmmakers, as well as their institutions and organisations in the two countries. They shall also facilitate presentation of films of the other side at international film festivals in their countries, in accordance with the rules of such festivals. Strony b´dà sprzyja∏y, na zasadzie wzajemnoÊci, organizowaniu niekomercyjnych przeglàdów filmów. The Parties shall promote the organisation, on reciprocal basis, of non-commercial film reviews. Artyku∏ 11 Article 11 Strony b´dà popiera∏y wspó∏prac´ w dziedzinie twórczoÊci ludowej oraz wymian´ zespo∏ów artystycznych i folklorystycznych w ramach mi´dzynarodowych festiwali, znaczàcych imprez kulturalnych lub na zaproszenie drugiej Strony. The Parties shall support collaboration in the field of folk art and the exchange of artistic ensembles, in the framework of international festivals, major cultural events, or at the invitation of the other Party. Szczegó∏y dotyczàce wymiany (wybór zespo∏u, okreÊlenie repertuaru, programu pobytu i terminu wizyty) b´dà ustalane drogà bezpoÊrednich kontaktów na zasadach wzajemnoÊci. The particulars concerning the exchanges (choice of the ensemble, elaboration of the repertoire, programme and date of visit) shall be determined through direct contacts on reciprocal basis. 10. b)participation of a Slovene theatre in the International Theatre Festival Kontakt in Toruƒ, or the International Theatre Festival Malta in Poznaƒ,
11. c)udzia∏ wykonawców i obserwatorów w festiwalach muzycznych: Mi´dzynarodowym Festiwalu Warszawska Jesieƒ i Mi´dzynarodowym Festiwalu Wratislavia Cantans,
12. c)participation of performers and observers in music festivals: the International Warsaw Autumn Festival and the Wratislavia Cantans International Festival,
13. d)udzia∏ pisarzy s∏oweƒskich w imprezach literackich o charakterze mi´dzynarodowym,
14. d)participation of Slovene writers in international literary events,
15. e)udzia∏ t∏umaczy s∏oweƒskich w Âwiatowym Kongresie T∏umaczy Literatury Polskiej;
16. e)participation of Slovene translators in the World Congress of Translators of Polish Literature. 2. w S∏owenii: 2. In Slovenia:
17. a)udzia∏ polskich grafików w Mi´dzynarodowym Biennale Grafiki,
18. a)participation of Polish graphic artists in the International Biennale of Graphic Art,
19. b)udzia∏ polskiego autora w dorocznym spotkaniu PEN-Club w Bled,

21. c)udzia∏ polskiego autora w spotkaniu autorów z krajów Europy Ârodkowej Vilenica,
22. c)participation of a Polish author in International Writer’s Gathering Vilenica, the
23. d)udzia∏ polskich muzyków w Festiwalu Muzyki Kameralnej XX wieku w Radencach lub w festiwalu Brežice.
24. d)participation of Polish musicians in the Festival of 20th Century Chamber Music in Radenci or the Brežice Festival. Artyku∏ 13 Article 13 Strony udzielà wsparcia wystawie Tadeusz Kantor: jego teatr i malarstwo, która zostanie zorganizowana w Lublanie (S∏owenia) w 2004 r. w ramach wspó∏pracy OÊrodka Dokumentacji Sztuki Tadeusza Kantora „Cricoteka” w Krakowie z Narodowym Muzeum Teatralnym. The Parties shall grant support to the exhibition Tadeusz Kantor: His Theatre and Painting in Ljubljana/Slovenia as cooperation between Cricoteka, Centre for the Documentation of the Art of Tadeusz Kantor, Cracow and the National Theatre Museum from Ljubljana in the year 2004. Artyku∏ 14 Article 14 Strony udzielà wsparcia wystawie poÊwi´conej twórczoÊci Jože Plečnika, którà zorganizuje Mi´dzynarodowe Centrum Kultury w Krakowie w 2004 r. The Parties shall grant support to the exhibition devoted to the works of Jože Plečnik, to be organised by the International Culture Center in Cracow, in 2004. II. OÊwiata i nauka II. Education and Science Artyku∏ 15 Article 15 Strony b´dà dà˝y∏y do pog∏´bienia i rozszerzenia wspó∏pracy w dziedzinie edukacji. W tym celu Ministerstwo Edukacji Narodowej i Sportu Rzeczypospolitej Polskiej oraz Ministerstwo Szkolnictwa, Nauki i Sportu Republiki S∏owenii uzgodnià priorytetowe obszary wspó∏pracy w dziedzinie edukacji oraz podejmà konkretne kroki zach´cajàce do bezpoÊrednich kontaktów mi´dzy szko∏ami wszystkich szczebli i innymi instytucjami oÊwiatowymi oraz do wymiany informacji i specjalistów. The Parties shall seek to develop their cooperation in education. For this purpose, the Ministry of National Education and Sport of the Republic of Poland and the Ministry of Education, Science and Sport of the Republic of Slovenia, shall determine cooperation priorities in the field of education, and shall take concrete steps to encourage direct contacts between schools at all levels and other educational institutions and exchange of information and specialists. Article 16 Artyku∏ 16 Strony, w miar´ potrzeb i wspólnych obszarów zainteresowaƒ, wymienià delegacje odpowiednich instytucji w celu zapoznania si´ z systemami edukacji w obu krajach. The Parties shall where necessary and on the basis of mutual interest exchange delegations between relevant institutions to become acquainted with the system of education in the other country. Artyku∏ 17 Article 17 Strony uznajà znaczenie rzetelnego przedstawiania historii i geografii ka˝dego z krajów w podr´cznikach szkolnych. W tym celu rozwa˝à mo˝liwoÊç powo∏ania dwustronnej komisji polskich i s∏oweƒskich specjalistów do przeprowadzenia analizy programów nauczania historii i geografii. The Parties recognise the significance of accurate presentation of the history and geography of each country in school textbooks. For this purpose, the Parties shall consider the establishment of a bilateral commission of Polish and Slovene specialists to analyse history and geography curricula. Artyku∏ 18 Article 18 Strony b´dà wspiera∏y bezpoÊrednià wspó∏prac´ mi´dzy szko∏ami wy˝szymi obu krajów, w tym zawieranie umów, zw∏aszcza mi´dzy Uniwersytetem Warszawskim, Uniwersytetem ¸ódzkim, Uniwersytetem im. Adama Mickiewicza w Poznaniu oraz Uniwersytetem Âlàskim w Katowicach a Uniwersytetem w Lublanie, Uniwersytetem w Mariborze oraz innymi instytucjami szkolnictwa wy˝szego w S∏owenii. The Parties shall promote direct cooperation between institutions of higher education of the two countries and conclusion of agreements, particularly between Warsaw University, ¸ódê University, Adam Mickiewicz University in Poznaƒ, Silesian University in Katowice and University of Ljubljana, University of Maribor and other higher education institutions in Slovenia. The Parties shall support cooperation of the libraries of the Slavonic Studies Institute of Polish Academy of Sciences in Warsaw and Cracow with the library of the Slavonic Department at the Faculty of Arts at the University of Ljubljana. Artyku∏ 20 Article 20 Strony wysoko oceniajà prowadzenie studiów s∏owenistycznych w polskich szko∏ach wy˝szych i nadal b´dà wspiera∏y lektoraty j´zyka s∏oweƒskiego na Uniwersytecie Jagielloƒskim w Krakowie, Uniwersytecie Warszawskim, Uniwersytecie Âlàskim w Katowicach i Uniwersytecie ¸ódzkim oraz lektoraty j´zyka polskiego na Uniwersytecie w Lublanie poprzez udzielanie pomocy w zatrudnianiu lektorów. The Parties positively asses Slovene studies in Polish higher schools and shall continue to support the Slovene language lectorate at Jagiellonian University in Cracow, Warsaw University, University of Silesia in Katowice and ¸ódê University and Polish language lectorate at the University of Ljubljana through providing assistance in employing lecturers there. The Parties fully support the University of Ljubljana endeavours in preparing and implementing the programme of regular undergraduate Polish studies. Artyku∏ 21 Article 21 1. Strony b´dà corocznie wymieniaç 3 studentów — na studia roczne lub semestralne (∏àcznie do 30 miesi´cy), zw∏aszcza studentów polonistyki i s∏owenistyki. 1. The Parties shall receive each year 3 persons for yearly or semester studies (up to 30 months altogether), particularly students of the Polish and Slovene languages. 2. Strony corocznie b´dà dokonywa∏y wymiany wyk∏adowców szkó∏ wy˝szych oraz studentów polonistyki i s∏owenistyki na wakacyjne kursy j´zykowe — po 5 osób ka˝da ze Stron. 2. The Parties shall each year exchange lecturers and students of Polish and Slovene studies to attend summer language courses — 5 persons from each side. 3. Strony b´dà corocznie wymienia∏y — w limicie do 16 miesi´cy rocznie — studentów i pracowników naukowych z drugiego kraju na sta˝e naukowe trwajàce od 1 do 9 miesi´cy. 3. The Parties shall each year exchange students and scientific workers for interships lasting from 1 do 9 months, their combined period of stay not exceeding 16 months annually. Artyku∏ 22 Article 22 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ szkó∏ i uczelni artystycznych obu krajów, w tym: The Parties shall support direct collaboration between artistic schools in the two countries through:
25. a)wymian´ grup uczniowskich i studenckich, a tak˝e kadry pedagogicznej,
26. a)exchange of school and university students and teaching staff,
27. b)wymian´ przedstawicieli uczelni artystycznych w konferencjach, seminariach, kolokwiach, sesjach dotyczàcych kszta∏cenia artystycznego i teorii sztuki organizowanych przez drugà Stron´,
28. b)participation of artistic school representatives in conferences, seminars and sessions concerning artistic education and artistic theory, organised by the other Party,
29. c)wymian´ informacji o programach nauczania i podr´cznikach systemu szkolnictwa artystycznego,
30. c)exchange of information on artistic education curricula and textbooks,
31. d)wspó∏prac´ w zakresie pomocy dydaktycznych i naukowych.
32. d)collaboration with regard to teaching aids. Warunki finansowe wspó∏pracy b´dà uzgadniane bezpoÊrednio przez zainteresowane instytucje. The financial conditions of cooperation shall be determined directly by the interested institutions. Artyku∏ 23 Article 23 Strony b´dà wspiera∏y rozwój wspó∏pracy mi´dzy Polskà Akademià Nauk w Warszawie a S∏oweƒskà The Parties shall support the development of cooperation between Polish Academy of Sciences in Dziennik Ustaw Nr 196 — 13396 — Poz. 1920 Akademià Nauk w Lublanie, realizowanej na podstawie bezpoÊredniego porozumienia o wspó∏pracy naukowej, podpisanego w 1994 r. Warsaw and Slovene Academy of Sciences and Arts in Ljubljana, based on the direct agreement on scientific cooperation, signed in 1994. Strony b´dà rozszerza∏y i pog∏´bia∏y bezpoÊrednià wspó∏prac´ mi´dzy placówkami naukowymi, jednostkami badawczo-rozwojowymi oraz instytucjami prowadzàcymi badania naukowe, a tak˝e mi´dzy naukowcami obu krajów. The Parties shall develop direct cooperation between research institutions, research-and-development entities and other research organisations, as well as individual scientists of the two countries. Artyku∏ 24 Article 24 Strony b´dà popiera∏y wspólne starania Instytutu Badaƒ Literackich Polskiej Akademii Nauk w Warszawie i Wydzia∏u Slawistyki Uniwersytetu w Lublanie przygotowania projektu w zakresie badaƒ porównawczych nad literaturà oraz kulturà s∏oweƒskà i polskà, który ma byç prowadzony w ramach wspó∏pracy bezpoÊredniej. The Parties shall support the joint preparation by the Institute of Literary Studies of Polish Academy of Sciences in Warsaw and the Slavonic Department of the University of Ljubljana, of the Polish and Slovene literature and culture comparative studies project, to be pursued within the framework of direct cooperation. III. Inne dziedziny wspó∏pracy III. Other Fields of Cooperation Artyku∏ 25 Article 25 Strony uznajà prawa autorskie i pokrewne do utworów, przys∏ugujàce obywatelom i instytucjom drugiego paƒstwa oraz ich nast´pcom prawnym, niezale˝nie od miejsca pierwszego opublikowania tych utworów. Each Party shall recognize the copyrights and other related rights belonging to the physical and legal persons of the other Party and their legal successors, regardless of the place of first publication of the works in question. Strony zapewnià ochron´ praw autorskich na takich samych warunkach, jakie gwarantuje ich prawo wewn´trzne dla ich w∏asnych obywateli i instytucji. The Parties shall ensure copyright protection on the same terms as provided in their domestic legislation for their own physical and legal persons. Strony zobowiàzujà si´ ponadto do poszanowania praw autorskich i pokrewnych swoich obywateli, zgodnie ze standardami obowiàzujàcymi w Unii Europejskiej. The Parties shall ensure the protection of copyrights and related rights in accordance with European Union standards. Artyku∏ 26 Article 26 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ m∏odzie˝y obu krajów w zakresie wymiany mi´dzy szko∏ami oraz inne formy wspó∏pracy m∏odzie˝owej, w tym wymian´ mi´dzy organizacjami m∏odzie˝owymi. The Parties shall support exchange of school youth and other forms of youth cooperation, including exchanges between youth organisations. Strony b´dà popiera∏y wspó∏prac´ mi´dzy organizacjami kultury fizycznej i sportu oraz sprzyja∏y wszelkim inicjatywom s∏u˝àcym dalszemu jej rozwijaniu. The Parties shall support cooperation between physical culture and sports organisations and favour all initiatives conducive to its further development. Artyku∏ 27 Article 27 Radiofonie obu krajów b´dà nadal ÊciÊle wspó∏pracowa∏y w ramach cz∏onkostwa w Europejskiej Unii Radiowej (EBU). The radio broadcasting organisations of the two countries shall continue their collaboration as members of the European Broadcasting Union (EBU). Artyku∏ 28 Article 28 Strony b´dà popiera∏y bezpoÊrednià wspó∏prac´ telewizji polskiej (Telewizja Polska SA) z telewizjà s∏oweƒskà (Televizija Slovenija) w ramach obowiàzujàcej umowy dwustronnej. The Parties shall support direct cooperation between Polish television (Telewizja Polska S.A.) and Slovene television (Televizija Slovenija), on the basis of the bilateral agreement in force. The Parties shall support cooperation between their national United Nations Educational, Scientific and Cultural Organization (UNESCO) committees. IV. Postanowienia ogólne i finansowe IV. General and Financial Provisions Artyku∏ 30 Article 30 Strona wysy∏ajàca przeka˝e Stronie przyjmujàcej propozycje dotyczàce wymiany specjalistów, co najmniej trzy miesiàce przed proponowanym terminem wizyty. The sending Party shall submit to the receiving Party its proposals concerning exchange of specialists at least three months in advance of the planned visit. Strona przyjmujàca powiadomi Stron´ wysy∏ajàcà o swej decyzji co do przyj´cia kandydatów, co najmniej szeÊç tygodni przed planowanym rozpocz´ciem pobytu. The receiving Party shall advise the sending Party of its decision at least six weeks in advance of the planned visit. The sending Party shall advise the receiving Party of the precise date of arrival and mode of transport at least three weeks before arrival. The above deadlines may be changed — by mutual consent — by the institutions involved in the exchange. Artyku∏ 31 Article 31 Strona wysy∏ajàca przeka˝e Stronie przyjmujàcej do dnia 30 marca ka˝dego roku dokumentacj´ kandydatów na studia, kursy j´zykowe i sta˝e naukowe, o których mowa w artykule 21 Programu. The sending Party shall convey to the receiving Party, by March 30 of each year, documents pertaining to the candidates for studies, language courses and internships referred to in Artice 21 of this Programme. Kandydaci zostanà wybrani przez wspólnà komisj´, sk∏adajàcà si´ z przedstawicieli Strony wysy∏ajàcej i Ambasady paƒstwa Strony przyjmujàcej. The candidates shall be selected by a joint commission, including representatives of the sending Party and the Embassy of the receiving Party. Dokumentacja kandydatów na studia i sta˝e naukowe powinna zawieraç: ˝yciorys, Êwiadectwo zdrowia, potwierdzenie znajomoÊci j´zyków obcych niezb´dnych dla podj´cia studiów lub sta˝u, plan studiów lub sta˝u (z zaznaczeniem instytucji i specjalistów, z którymi kandydat zamierza wspó∏pracowaç), a w przypadku pracowników naukowych — tak˝e kopi´ dyplomu lub zaÊwiadczenia o stopniu naukowym. The documents pertaining to candidates for studies and internships shall include: the curriculum vitae of the candidate, health certificate, foreign language certificate, plan of studies or research (identifying the institutions and specialists with whom the candidate intends to collaborate). Scientific workers shall also submit copies of diplomas or scientific degree certificates. The receiving Party shall notify the sending Party of its decisions concerning candidates approved for summer courses not later than by June 1st each year, and for studies and internships — not later than three months before their initiation. The sending Party shall cover the costs of return travel to the place of destination in the host country. Artyku∏ 33 Article 33 Strona wysy∏ajàca zapewni, ˝e osoby uczestniczàce w wymianie obj´tej Programem b´dà posiada∏y ubezpieczenie na wypadek choroby lub nieszcz´Êliwego wypadku. The sending Party shall ensure that exchange participants covered by this Programme have health and accident insurance. The receiving Party shall cover the costs of travel on its territory connected with the programme of the visit. Artyku∏ 35 Article 35 Strona przyjmujàca zapewnia osobom przybywajàcym na wizyty studyjne na okres do 30 dni, o których mowa w artykule 2, oraz komisarzom wystaw bezp∏atne zakwaterowanie, bezp∏atne wy˝ywienie lub diety pobytowe zgodnie z przepisami Strony przyjmujàcej. The receiving Party shall provide participants in study visits lasting up to thirty days, referred to in Article 2, and exhibition commissioners free accommodation, free board or per diems in accordance with the domestic regulations of the receiving Party. The receiving Party shall provide for persons indicated in Article 21, paragraphs 1 and 3 of this Programme, tuition-free education or scientific programmes in state higher schools and provide scholarships according to relevant provisions of the internal legislation of each Party of this Programme. The higher schools of the receiving Party shall provide lecturers delegated under Article 21 with salaries envisaged by local regulations and appropriate, free-of-charge, single-occupancy accommodation. Stosunki pracy tych osób podlegajà przepisom prawa, w tym równie˝ w zakresie ubezpieczenia zdrowotnego, obowiàzujàcym w paƒstwie Strony przyjmujàcej. The terms of employment of those persons, including health insurance, shall comply with domestic regulations of the receiving Party. Artyku∏ 39 Article 39 Strona wysy∏ajàca pokrywa koszty transportu wystawy do pierwszego miejsca ekspozycji w kraju przyjmujàcym oraz koszty transportu powrotnego wystawy. The sending Party shall cover the costs of transport of an exhibition to the first place of exposition in the host country and the costs of return transport. The receiving Party shall cover the transport costs to other places of exposition on its territory. Artyku∏ 40 Article 40 Strona wysy∏ajàca pokrywa koszty ubezpieczenia wystawy na czas transportu i ekspozycji. W przypadku zniszczenia lub uszkodzenia eksponatów, Strona przyjmujàca zobowiàzana jest przekazaç Stronie wysy∏ajàcej niezb´dnà dokumentacj´ dotyczàcà szkód w celu umo˝liwienia uzyskania odszkodowania z tytu∏u ubezpieczenia. The sending Party shall cover the insurance costs ot the exhibition during transport and exposition — according to the ”nail to nail” principle. In the event of damage to the exhibits, the receiving Party shall supply the sending Party with the necessary documents for insurance claims. The receiving Party shall not undertake any repairs of damaged exhibits without the consent of the sending Party. The receiving Party shall cover the costs of organising the exhibition, ensuring appropriate venue, publicity and printing of catalogue, the materials for which shall be supplied not later than three months before opening. Artyku∏ 42 Article 42 W przypadku wystaw muzealnych odpowiednie instytucje obu Stron mogà uzgodniç w bezpoÊrednim porozumieniu specjalne warunki dla ich organizacji. In the case of museum exhibitions, the relevant institutions of the two Parties shall be able to directly elaborate special conditions of their organisation. V. Postanowienia koƒcowe V. Final Provisions Artyku∏ 43 Article 43 Wszelkie kwestie sporne, które mogà wyniknàç podczas realizacji Programu, b´dà rozstrzygane w drodze dyplomatycznej. Any disputes arising during the implementation of this Programme shall be resolved through diplomatic channels. Artyku∏ 44 Article 44 Niniejszy Program nie wyklucza realizacji innych porozumieƒ w dziedzinie kultury, nauki i edukacji, zawieranych bezpoÊrednio mi´dzy zainteresowanymi instytucjami. This Programme shall not prejudice the implementation of other agreements in the field of culture, science and education concluded directly by the interested institutions. Artyku∏ 45 Article 45 Niniejszy Program wejdzie w ˝ycie w dniu podpisania i pozostanie w mocy do dnia 31 grudnia 2006 r. Jego obowiàzywanie zostanie automatycznie przed∏u˝one do czasu podpisania kolejnego Programu, o ile ˝adna ze Stron nie wypowie go w drodze notyfikacji. W takim przypadku Program utraci moc obowiàzujàcà w terminie 60 dni od dnia wypowiedzenia. This Programme shall come into force on the day of signing and shall remain in force until December 31, 2006. It shall be automatically extended until the signing of the next Programme, unless one of the Parties denounces it in writing. The Programme shall be terminated on the 60th day after such notification.
