Article 2

, committed within the territory of the Requesting State, and is found within the territory of the Requested State.

1. Wydanie nastàpi równie˝ w odniesieniu do przest´pstwa obj´tego ekstradycjà okreÊlonego w artykule 2, pope∏nionego poza terytorium Paƒstwa wzywajàcego, co do którego Paƒstwo wzywajàce posiada jurysdykcj´, je˝eli prawo Paƒstwa wezwanego przewiduje w podobnych warunkach odpowiedzialnoÊç karnà za przest´pstwo tego samego rodzaju pope∏nione poza jego terytorium.
2. Extradition shall also be granted in respect of an extraditable offence,

Article 2

, committed outside the territory of the Requesting State but in respect of which the Requesting State has jurisdiction, if the laws of the Requested State provide for the punishment for such an offence committed outside its territory in similar circumstances.

1. Wydanie mo˝e nastàpiç równie˝ w odniesieniu do przest´pstwa obj´tego ekstradycjà okreÊlonego w artykule 2, pope∏nionego w ca∏oÊci lub w cz´Êci na terytorium Paƒstwa wezwanego, co do którego Paƒstwo wzywajàce posiada jurysdykcj´.
2. Extradition may also be granted in respect of an extraditable offence,

Article 2

, committed wholly or partly in the territory of the Requested State, over which the Requesting State has jurisdiction. 4. Na podstawie postanowieƒ niniejszej umowy zgoda na ekstradycj´ zostanie udzielona niezale˝nie 4. Extradition shall be granted in accordance with the provisions of this Treaty, irrespective of when the Dziennik Ustaw Nr 156 — 9547 — Poz. 1304 od tego, kiedy zosta∏o pope∏nione przest´pstwo stanowiàce podstaw´ wniosku o ekstradycj´, pod warunkiem ˝e: offence in relation to which extradition is sought was committed, provided that:

1. a)by∏o ono uznane za przest´pstwo przez prawo obu Umawiajàcych si´ Paƒstw w czasie dzia∏aƒ lub zaniechaƒ stanowiàcych przest´pstwo i
2. a)it was an offence under the laws of both the Contracting States at the time of the acts or omissions constituting the offence; and
3. b)by∏o ono uznane za przest´pstwo przez prawo obu Umawiajàcych si´ Paƒstw w czasie wystàpienia z wnioskiem o ekstradycj´.
4. b)it was an offence under the laws of both the Contracting States at the time the request for extradition was made. Artyku∏ 2 Article 2 Przest´pstwa obj´te ekstradycjà Extradition offences 1. Przest´pstwem obj´tym ekstradycjà dla celów niniejszej umowy jest czyn, który na mocy prawa ka˝dego z Umawiajàcych si´ Paƒstw zagro˝ony jest karà pozbawienia wolnoÊci nie krótszà ni˝ jeden rok. 1. An extradition offence for the purposes of this Treaty is constituted by act which under the laws of each Contracting State is punishable by a term of imprisonment for a period of at least one year. 2. Przest´pstwo jest tak˝e przest´pstwem obj´tym ekstradycjà, je˝eli polega na pod˝eganiu, usi∏owaniu pope∏nienia lub uczestnictwie w pope∏nieniu przest´pstwa okreÊlonego w ust´pie 1. Udzia∏ w zwiàzku lub zorganizowanej grupie majàcej na celu pope∏nienie przest´pstwa okreÊlonego w ust´pie 1 w rozumieniu prawa Rzeczypospolitej Polskiej i zmowa w celu pope∏nienia przest´pstwa okreÊlonego w ust´pie 1 w rozumieniu prawa Republiki Indii — sà równie˝ przest´pstwami obj´tymi ekstradycjà. 2. An offence shall also be an extradition offence if it consists of an attempt to commit, abetment or participation in the commission of an offence specified in paragraph 1. Participation in an association or an organised group to commit offences specified in paragraph 1, as provided by the laws of the Republic of Poland and conspiracy to commit an offence specified in paragraph 1, as provided by the laws of the Republic of India, shall also be extradition offences. 3. Przest´pstwo jest tak˝e przest´pstwem obj´tym ekstradycjà, je˝eli dotyczy podatków, innych op∏at lub ma charakter wy∏àcznie skarbowy. W wypadku wniosku o ekstradycj´ za przest´pstwa dotyczàce przepisów podatkowych, celnych, dewizowych lub innych przepisów skarbowych nie mo˝na odmówiç ekstradycji tylko na tej podstawie, ˝e zgodnie z prawem Paƒstwa wezwanego tego rodzaju podatki lub c∏a nie sà nak∏adane bàdê prawo to nie zawiera przepisów podatkowych, celnych lub dewizowych tego samego rodzaju co prawo Paƒstwa wzywajàcego. 3. An offence shall be an extradition offence notwithstanding that it relates to taxation or revenue or is one of a purely fiscal character. Where extradition is sought for an offence against laws relating to taxation, customs duties, foreign exchange or other revenue matter, extradition may not be refused only on the ground that the laws of the Requested State do not impose the same kind of tax or duty or do not contain a tax, duty, customs, or exchange regulation of the same kind as the laws of the Requesting State. Artyku∏ 3 Article 3 Zakres zastosowania Application Niniejsza umowa b´dzie mia∏a zastosowanie do przest´pstw pope∏nionych zarówno przed, jak i po jej wejÊciu w ˝ycie. This Treaty shall apply to offences committed before as well as after the date it enters into force. Artyku∏ 4 Article 4 Powody odmowy wydania Grounds for refusal of extradition 1. Osoba nie b´dzie wydana, je˝eli: 1. A person shall not be extradited if:
5. a)jest ona obywatelem Paƒstwa wezwanego;
6. a)he is a citizen of the Requested State;
7. b)osoba, której dotyczy wniosek o ekstradycj´, zgodnie z prawem Paƒstwa wzywajàcego lub Paƒstwa wezwanego nie podlega Êciganiu lub wykonaniu kary z powodu przedawnienia;
8. b)the person claimed has, according to the laws of either the Requesting or the Requested State, become immune, by reason of lapse of time, from prosecution or the execution of punishment;
9. c)wydanie nie jest dopuszczalne na mocy prawa Paƒstwa wezwanego lub

11. d)przest´pstwo, za które jest Êcigana lub za które zosta∏a skazana, stanowi przest´pstwo wojskowe, które jednoczeÊnie nie jest przest´pstwem na mocy powszechnego prawa karnego.
12. d)the offence in respect of which he is wanted for prosecution or is convicted is a military offence which is not an offence under ordinary criminal law. 2. Osoba nie mo˝e byç równie˝ wydana, je˝eli w odniesieniu do przest´pstwa stanowiàcego podstaw´ wniosku ekstradycyjnego wczeÊniej prowadzono przeciwko niej post´powanie w Paƒstwie wezwanym i zosta∏a ona prawomocnie skazana lub uniewinniona. 2. A person shall also not be extradited if in respect of the offence for which his extradition is requested, he has been previously proceeded against in the Requested State and convicted or acquitted with final effect. 3. Je˝eli wed∏ug oceny Paƒstwa wezwanego ekstradycja by∏aby ca∏kowicie nie do pogodzenia ze wzgl´dami humanitarnymi dotyczàcymi zw∏aszcza stanu zdrowia lub podesz∏ego wieku osoby Êciganej, Umawiajàce si´ Paƒstwa podejmà konsultacje w celu wzajemnego ustalenia, czy wnioskowi o ekstradycj´ powinien byç nadany bieg. 3. Where it appears to the Requested State that extradition would be totally incompatible with humanitarian considerations, in particular the state of health or old age of the person sought, the Contracting States shall consult to mutually determine whether the extradition request should continue. Artyku∏ 5 Article 5 Przest´pstwa polityczne Political offences 1. Wydanie nie nastàpi, je˝eli przest´pstwo stanowiàce podstaw´ wniosku o wydanie jest przest´pstwem o charakterze politycznym. 1. Extradition shall not be granted if the offence for which extradition is requested is an offence of a political character. 2. Dla celów niniejszej umowy nast´pujàce przest´pstwa nie sà uwa˝ane za przest´pstwa o charakterze politycznym: 2. For the purposes of this Treaty, the following offences shall not be considered to be of a political character:
13. a)zabójstwo lub jakiekolwiek inne przest´pstwo przeciwko g∏owie Paƒstwa lub szefowi rzàdu jednego z Umawiajàcych si´ Paƒstw albo przeciwko cz∏onkom ich rodzin;
14. a)murder or any other offence against the person of the Head of State, the Head of Government of either of the Contracting States or members of their families;
15. b)przest´pstwo, za które oba Umawiajàce si´ Paƒstwa na podstawie wielostronnej umowy mi´dzynarodowej majà obowiàzek wydania osoby Êciganej lub przekazania sprawy swym w∏aÊciwym organom w celu podj´cia decyzji w sprawie wszcz´cia post´powania karnego;
16. b)an offence for which both Contracting States have the obligation pursuant to a multilateral international agreement to extradite the person sought or to submit the case to their competent authorities for decision as to prosecution;
17. c)zabójstwo, nieumyÊlne spowodowanie Êmierci, umyÊlne uszkodzenie cia∏a, ci´˝kie uszkodzenie cia∏a lub ci´˝ki rozstrój zdrowia;
18. c)murder, manslaughter, malicious wounding, or inflicting grievous bodily harm or other grievous injury to health;
19. d)porwanie, uprowadzenie lub inne niezgodne z prawem pozbawienie wolnoÊci, w tym branie zak∏adnika;
20. d)an offence involving kidnapping, abduction or any form of unlawful detention, including the taking of a hostage;
21. e)pod∏o˝enie lub u˝ycie materia∏u wybuchowego, Êrodka zapalajàcego lub innego niszczàcego urzàdzenia zagra˝ajàcego ˝yciu, powodujàcego powa˝ne uszkodzenie cia∏a lub powa˝nà szkod´ w mieniu, i
22. e)placing or using an explosive, incendiary or destructive device capable of endangering life, of causing substantial bodily harm or of causing substantial property damage; and
23. f)usi∏owanie pope∏nienia lub uczestnictwo w pope∏nieniu jakiegokolwiek z wy˝ej wymienionych przest´pstw, jak równie˝ udzia∏ w zwiàzku lub zorganizowanej grupie majàcej na celu pope∏nienie tych przest´pstw w rozumieniu prawa Rzeczypospolitej Polskiej i zmowa w celu pope∏nienia tych przest´pstw w rozumieniu prawa Republiki Indii.
24. f)an attempt to commit, or participation in the commission of any of the foregoing offences as well as participation in an association or an organised group to commit these offences, as provided by the laws of the Republic of Poland or conspiracy to commit these offences, as provided by the laws of the Republic of India. 25. a)wniosek o ekstradycj´ nie zosta∏ uwzgl´dniony, Paƒstwo wezwane przeka˝e spraw´ swym w∏aÊciwym organom w celu wszcz´cia post´powania karnego zgodnie z w∏asnym prawem. W tym celu Paƒstwo wzywajàce przeka˝e Paƒstwu wezwanemu odpowiednie dokumenty i dowody. 1. If an extradition request is refused under paragraph 1 subparagraph
26. a)of Article 4, the Requested State shall transmit the case to its competent authorities in order to initiate criminal proceedings in accordance with the laws of the Requested State. For this the Requesting State shall transfer to the Requested State the relevant documents and evidence. 2. Postanowienie ust´pu 1 stosuje si´ tak˝e w innych wypadkach nieuwzgl´dnienia wniosku o ekstradycj´, je˝eli wszcz´cie post´powania karnego nie jest wy∏àczone na podstawie prawa Paƒstwa wezwanego. 2. The provision of paragraph 1 shall apply in other cases also where a request for extradition is refused, if the initiation of criminal proceeding is not excluded under the laws of the Requested State. 3. W wypadku gdy wniosek o ekstradycj´ nie zosta∏ uwzgl´dniony z powodu istnienia jurysdykcji (artyku∏ 1 ust´p 3) i zgodnie z decyzjà organu Êcigania nie jest mo˝liwe wniesienie aktu oskar˝enia w Paƒstwie wezwanym, wniosek o ekstradycj´ mo˝e byç z∏o˝ony ponownie. 3. In case the extradition is refused on the ground of existence of jurisdiction (Article 1 paragraph 3) and according to the decision of the investigating authority the trial is not found feasible in the Requested State, the request for extradition may be resubmitted. Artyku∏ 7 Article 7 Odroczenie wydania i wydanie tymczasowe Postponement of extradition and temporary extradition 1. Je˝eli osoba, która ma zostaç wydana, jest Êcigana lub odbywa kar´ na terytorium Paƒstwa wezwanego za inne przest´pstwo, wydanie mo˝e zostaç odroczone do czasu zakoƒczenia post´powania karnego lub odbycia kary, o czym Paƒstwo wzywajàce zostanie poinformowane. 1. If the person to be extradited is being prosecuted or serving sentence for another crime in the territory of the Requested State, the extradition may be postponed till the end of the criminal proceedings of the case, or completion of sentence, which shall be advised to the Requesting State. 2. Je˝eli odroczenie wydania mo˝e doprowadziç do przedawnienia lub mo˝e utrudniç post´powanie, osoba mo˝e zostaç wydana tymczasowo na podstawie specjalnego wniosku Paƒstwa wzywajàcego. 2. If the postponement of extradition can result in immunity by the reason of lapse of time or impede the investigation, the person can be extradited temporarily under a special request of the Requesting State. 3. Osoba wydana tymczasowo musi zostaç zwrócona Paƒstwu wezwanemu niezw∏ocznie po zakoƒczeniu post´powania w sprawie. 3. The temporarily extradited person must be returned to the Requested State immediately after the end of the proceedings of the case. Artyku∏ 8 Article 8 Post´powanie ekstradycyjne Extradition procedures 1. Wniosek o wydanie przekazuje si´ na drodze dyplomatycznej. 1. The request for extradition shall be made through diplomatic channels. 2. Wniosek powinien zawieraç: 2. The request shall be accompanied by:
27. a)imi´ i nazwisko osoby, o której wydanie si´ wnioskuje, informacje dotyczàce jej obywatelstwa, miejsca zamieszkania lub pobytu oraz inne stosowne dane, jak równie˝ w miar´ mo˝liwoÊci rysopis tej osoby, jej fotografie i odciski palców;
28. a)the name and surname of the person whose extradition is requested, information on his citizenship, place of residence or whereabouts and other pertaining data, as well as, if possible, the description of the person’s appearance, his photographs and fingerprints;

Do wniosku o wydanie w celu Êcigania nale˝y ponadto do∏àczyç orygina∏ lub uwierzytelniony odpis nakazu aresztowania wydanego przez w∏aÊciwy sàd Paƒstwa wzywajàcego oraz takie informacje lub oÊwiadczenia, które uzasadnia∏yby postawienie osoby w stan oskar˝enia, gdyby przest´pstwo by∏o pope∏nione w Paƒstwie wezwanym. 3. The request for extradition for the prosecution, besides the information specified above, must be accompanied by the original or a certified copy of the warrant of arrest issued by a competent court of the Requesting State and such information or statements as would justify the committal for trial of the person had the offence been committed in the Requested State. 4. Je˝eli wniosek dotyczy osoby ju˝ uznanej za winnà i skazanej, nale˝y do niego do∏àczyç uwierzytelniony odpis wyroku wraz z poÊwiadczeniem prawomocnoÊci i wykonalnoÊci, z zaznaczeniem, w jakim wymiarze wyrok nie zosta∏ wykonany. 4. If the request relates to a person already convicted and sentenced, it shall also be accompanied by a certified copy of the judgement and a statement that the judgement is final and enforceable and showing how much of sentence still remains to be undergone. 5. Je˝eli Paƒstwo wezwane uzna, ˝e materia∏y lub informacje przekazane dla celów niniejszej umowy nie sà wystarczajàce dla podj´cia decyzji, Paƒstwo to zwróci si´ o dostarczenie niezb´dnych dodatkowych materia∏ów lub informacji i w tym celu mo˝e wyznaczyç rozsàdny termin do ich otrzymania. 5. If the Requested State considers that the material or information supplied for the purposes of this Treaty is not sufficient in order to enable a decision to be taken as to the request, it shall request the necessary supplementary material or information and may fix a reasonable time limit for the receipt thereof. Artyku∏ 9 Article 9 Tymczasowe aresztowanie Provisional arrest 1. W nag∏ych wypadkach osoba poszukiwana mo˝e byç zgodnie z prawem Paƒstwa wezwanego tymczasowo aresztowana na wniosek w∏aÊciwych organów Paƒstwa wzywajàcego. Wniosek powinien zawieraç stwierdzenie zamiaru wystàpienia o wydanie tej osoby oraz oÊwiadczenie o istnieniu nakazu jej aresztowania lub o jej skazaniu oraz dane niezb´dne do identyfikacji osoby poszukiwanej, jak równie˝ inne informacje niezb´dne do wydania nakazu aresztowania w Paƒstwie wezwanym. Wniosek powinien tak˝e okreÊlaç przest´pstwo, w zwiàzku z którym b´dzie ˝àdaç si´ wydania. 1. In urgent cases the person sought may, in accordance with the laws of the Requested State, be provisionally arrested on the application of the competent authorities of the Requesting State. The application shall contain an indication of intention to request the extradition of that person and a statement of existence of a warrant of arrest or a conviction against him, such information as may be necessary to identify him and such other information as would be necessary for the issue of a warrant of arrest in the Requested State. The application shall also state for what offence extradition will be requested. 2. Osoba aresztowana na podstawie wymienionego wniosku zostanie zwolniona po up∏ywie 60 dni od daty aresztowania, je˝eli nie wp∏ynà∏ wniosek o wydanie. Nie wyklucza to wszcz´cia dalszego post´powania o ekstradycj´ osoby poszukiwanej, je˝eli wniosek taki zostanie z∏o˝ony w terminie póêniejszym. 2. A person arrested upon such an application shall be set at liberty upon the expiration of 60 days from the date of his arrest if a request for his extradition shall not have been received. This provision shall not prevent institution of further proceedings for the extradition of the person sought if a request is subsequently received. Artyku∏ 10 Article 10 Zasada ograniczenia Êcigania Rule of speciality 1. Osoba wydana na mocy niniejszej umowy nie mo˝e byç pozbawiona wolnoÊci, Êcigana karnie, skazana lub poddana wykonaniu kary w Paƒstwie wzywajàcym za przest´pstwa, z wyjàtkiem: 1. A person extradited under this Treaty may not be detained, prosecuted, sentenced or punished in the Requesting State for offences except for: Dziennik Ustaw Nr 156 — 9551 — Poz. 1304
37. a)przest´pstwa, za które nastàpi∏o wydanie lub odmiennie okreÊlonego przest´pstwa opartego na tych samych faktach, za które nastàpi∏o wydanie, o ile takie przest´pstwo jest przest´pstwem obj´tym ekstradycjà lub stanowi ∏agodniejszà form´ takiego przest´pstwa;
38. a)an offence for which extradition has been granted or a differently denominated offence based on the same facts on which extradition was granted, provided such an offence is extraditable or is a lesser form of such offence;
39. b)przest´pstwa pope∏nionego po wydaniu osoby lub
40. b)an offence committed after the extradition of the person; or
41. c)przest´pstwa, co do którego w∏aÊciwy organ Paƒstwa wezwanego wyrazi∏ zgod´ na pozbawienie wolnoÊci, Êciganie karne, skazanie lub wykonanie kary wobec danej osoby. Dla celów niniejszego punktu:
42. c)an offence for which the competent authority of the Requested State has consented to the person’s detention, prosecution, sentencing, or punishment. For the purpose of this subparagraph: (
43. i)Paƒstwo wezwane mo˝e wymagaç przedstawienia dokumentów okreÊlonych w artykule 8 oraz (
44. i)the Requested State may require the submission of the documents specified in Article 8; and (
45. ii)o ile Paƒstwo wezwane nie wyrazi sprzeciwu na piÊmie, osoba wydana mo˝e zostaç zatrzymana przez Paƒstwo wzywajàce na 90 dni lub na taki d∏u˝szy czas, na jaki zezwoli Paƒstwo wezwane, wówczas gdy wniosek jest rozpatrywany. (
46. ii)unless the Requested State objects in writing, the person extradited may be detained by the Requesting State for 90 days, or for such longer period of time as the Requested State may authorize, while the request is being processed. 2. Osoba wydana na mocy niniejszej umowy nie mo˝e byç nast´pnie wydana paƒstwu trzeciemu za przest´pstwo pope∏nione przed przekazaniem, chyba ˝e Paƒstwo przekazujàce wyrazi zgod´. 2. A person extradited under this Treaty may not be extradited to a third State for an offence committed prior to the surrender unless the surrendering State consents. 3. Ust´py 1 i 2 niniejszego artyku∏u nie wy∏àczajà pozbawienia wolnoÊci, Êcigania karnego, skazania lub wykonania kary wobec osoby wydanej ani dalszego wydania tej osoby paƒstwu trzeciemu, je˝eli: 3. Paragraph 1 and 2 of this Article shall not prevent the detention, prosecution, sentencing or punishment of an extradited person, or the extradition of that person to a third State if:
47. a)osoba ta po wydaniu dobrowolnie opuÊci∏a terytorium Paƒstwa wzywajàcego i nast´pnie dobrowolnie tam powróci, lub
48. a)that person leaves the territory of the Requesting State after extradition and voluntarily returns to it; or
49. b)osoba ta nie opuÊci terytorium Paƒstwa wzywajàcego w terminie 30 dni od dnia, w którym uzyska∏a mo˝liwoÊç swobodnego wyjazdu.
50. b)that person does not leave the territory of the Requesting State within 30 days of the day on which that person is free to leave. Artyku∏ 11 Article 11 DopuszczalnoÊç dokumentów Admissibility of documents Dokumenty do∏àczone do wniosku o wydanie zostanà przyj´te i dopuszczone jako dowody w post´powaniu ekstradycyjnym, je˝eli: The documents which accompany an extradition request shall be received and admitted as evidence in extradition proceedings if:
51. a)w wypadku wniosku ze strony Rzeczypospolitej Polskiej — sà one uwierzytelnione przez g∏ównego przedstawiciela dyplomatycznego lub konsularnego Republiki Indii w Rzeczypospolitej Polskiej;
52. a)in the case of a request from the Republic of Poland, they are certified by the principal diplomatic or consular officer of the Republic of India resident in the Republic of Poland;
53. b)w wypadku wniosku ze strony Republiki Indii — sà one uwierzytelnione przez w∏aÊciwego przedstawiciela dyplomatycznego lub konsularnego Rzeczypospolitej Polskiej w Republice Indii, lub
54. b)in the case of a request from the Republic of India, they are certified by the proper diplomatic or consular representative of the Republic of Poland in the Republic of India, or
55. c)sà one uwierzytelnione lub poÊwiadczone w inny sposób uznany przez prawo Paƒstwa wezwanego.
56. c)they are certified or authenticated in any other manner accepted by the laws of the Requested State. Dziennik Ustaw Nr 156 — 9552 — Poz. 1304 Artyku∏ 12 Article 12 Zbieg wniosków Competing requests Je˝eli ekstradycja tej samej osoby za to samo przest´pstwo lub inne przest´pstwa jest wnioskowana przez Umawiajàce si´ Paƒstwo oraz paƒstwo trzecie, Paƒstwo wezwane okreÊli, któremu paƒstwu wyda t´ osob´. Podejmujàc decyzj´, Paƒstwo wezwane rozwa˝y okolicznoÊci sprawy ∏àcznie z nast´pujàcymi: istnienie lub brak umowy o ekstradycji z paƒstwami wnoszàcymi o ekstradycj´, miejsce pope∏nienia przest´pstw, wag´ przest´pstw, obywatelstwo osoby, której dotyczy wniosek, i chronologiczny porzàdek, w jakim wnioski zosta∏y otrzymane. If extradition of the same person whether for the same offence or for different offences is requested by a Contracting State and a third State, the Requested State shall determine the State to which the person shall be extradited. In making its decision, the Requested State shall take into consideration factors including: existence or non — existence of extradition treaty with the states requesting extradition, place of the commission of offences, gravity of offences, nationality of the offender and chronological order of the requests received. Artyku∏ 13 Article 13 Kara Êmierci Death sentence Je˝eli na mocy prawa Paƒstwa wzywajàcego wobec osoby, której dotyczy wniosek, mo˝e zostaç orzeczona kara Êmierci za przest´pstwo, w zwiàzku z którym wyst´puje si´ o wydanie, a prawo Paƒstwa wezwanego nie przewiduje kary Êmierci za to przest´pstwo — mo˝na odmówiç wydania, chyba ˝e Paƒstwo wzywajàce zagwarantuje w sposób uznany przez Paƒstwo wezwane za wystarczajàcy, ˝e kara Êmierci nie zostanie wykonana. If under the laws of the Requesting State the person sought is liable to the death penalty for the offence for which his extradition is requested, but the laws of the Requested State does not provide for death penalty in a similar case, extradition may be refused, unless the Requesting State gives such assurances as the Requested State considers sufficient that the death sentence will not be carried out. Artyku∏ 14 Article 14 Przekazanie Transfer 1. Tryb przekazania, w tym czas i miejsce przekazania, osoby podlegajàcej wydaniu zostanie uzgodniony przez w∏aÊciwe organy obu Umawiajàcych si´ Paƒstw. 1. The modalities of transfer of the person to be extradited, including the time and the place, shall be agreed upon by the competent authorities of both the Contracting States. 2. Paƒstwo wzywajàce odbierze osob´ podlegajàcà wydaniu z terytorium Paƒstwa wezwanego w ciàgu 30 dni od chwili powiadomienia Paƒstwa wzywajàcego o decyzji wydania. Je˝eli osoba ta nie zostanie odebrana w takim terminie, Paƒstwo wezwane mo˝e odmówiç wydania jej za to samo przest´pstwo. 2. The Requesting State shall take delivery of the person sought from the territory of the Requested State within 30 days of the date on which the Requesting State was notified of the extradition decision. If he is not removed within that period, the Requested State may refuse to extradite him for the same offence. 3. If circumstances beyond its control prevent a Contracting State from timely surrendering or taking delivery of the person to be extradited, it shall notify the other Contracting State before the expiration of the time limit. In such a case the competent authorities of the Contracting States may agree upon a new date for the surrender and for taking delivery. Article may be surrendered, to the extent permitted under the laws of the Requested State, even when extradition cannot be effected due to the death, disappearance, or escape of the person sought. 2. The Requested State may condition the surrender of the property upon satisfactory assurances from the Requesting State that the property will be returned to the Requested State as soon as practicable. Each Contracting State shall, to the extent permitted by its laws, afford the other Contracting State the widest measure of mutual assistance in criminal matters in connection with the offence for which extradition has been requested. The Requesting State shall bear the expenses related to the translation of documents and the transportation of the person surrendered. The Requested State shall pay all other expenses incurred in that State by reason of the extradition proceedings. Artyku∏ 18 Article18 J´zyki Languages W zakresie niniejszej umowy Umawiajàce si´ Paƒstwa u˝ywajà swoich j´zyków urz´dowych, do∏àczajàc t∏umaczenie na j´zyk urz´dowy drugiego Umawiajàcego si´ Paƒstwa lub na j´zyk angielski. While complying with the present Treaty, the Contracting States shall use their national language attaching the translation in the national language of the other Contracting State or in the English language. Artyku∏ 19 Article 19 Zobowiàzania na mocy umów mi´dzynarodowych Obligations under international Treaties Niniejsza umowa nie narusza praw i zobowiàzaƒ Umawiajàcych si´ Paƒstw wynikajàcych z innych umów mi´dzynarodowych, których stronami sà Umawiajàce si´ Paƒstwa. The present Treaty shall not affect the rights and obligations of the Contracting States arising from other international Treaties to which the Contracting States are parties. Artyku∏ 20 Article 20 Ratyfikacja i wypowiedzenie Ratification and termination 1. Niniejsza umowa podlega ratyfikacji, a dokumenty ratyfikacyjne zostanà wymienione w Warszawie lub New Delhi. Wejdzie ona w ˝ycie w dniu wymiany dokumentów ratyfikacyjnych. 1. This Treaty shall be subject to ratification and the instruments of ratification shall be exchanged at Warsaw or New Delhi. Either of the Contracting States may terminate this Treaty at any time by giving notice to the other through the diplomatic channel; in such a case, the Treaty shall cease to have effect six months after the receipt of the notice.
