W imieniu Rzeczypospolitej Polskiej PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ podaje do powszechnej wiadomoÊci: W dniu 22 kwietnia 2004 r. zosta∏a podpisana w Hanoi Umowa mi´dzy Rzàdem Rzeczypospolitej Polskiej a Rzàdem Socjalistycznej Republiki Wietnamu o przekazywaniu i przyjmowaniu obywateli obu Paƒstw, w nast´pujàcym brzmieniu: UMOWA AGREEMENT mi´dzy Rzàdem Rzeczypospolitej Polskiej a Rzàdem Socjalistycznej Republiki Wietnamu o przekazywaniu i przyjmowaniu obywateli obu Paƒstw between the Government of the Republic of Poland and the Government of the Socialist Republic of Vietnam on transferring and readmitting citizens of both States Rzàd Rzeczypospolitej Polskiej i Rzàd Socjalistycznej Republiki Wietnamu, zwane dalej „Umawiajàcymi si´ Stronami”, The Government of the Republic of Poland and the Government of the Socialist Republic of Vietnam, hereinafter referred to as ”the Contracting Parties”, — kierujàc si´ pragnieniem rozwoju wzajemnej wspó∏pracy i zapewnienia podró˝owania obywateli Paƒstw Umawiajàcych si´ Stron, — desiring to develop mutual cooperation and ensure travelling of the citizens of the States of the Contracting Parties, — przestrzegajàc postanowieƒ umów mi´dzynarodowych oraz przeciwdzia∏ajàc nielegalnej migracji, — respecting the provisions of the international agreements and counteracting illegal migration, — majàc na celu okreÊlenie dla w∏aÊciwych organów Paƒstw Umawiajàcych si´ Stron jednolitych warunków przekazywania i przyjmowania obywateli Paƒstwa jednej Umawiajàcej si´ Strony niespe∏niajàcych warunków dla wjazdu i pobytu na terytorium Paƒstwa drugiej Umawiajàcej si´ Strony, — aiming to set forth for the competent authorities of the States of the Contracting Parties the uniform terms and conditions of transferring and readmitting the citizens of the State of a Contracting Party who are out of compliance with the terms and conditions of entry and stay on the territory of the State of the other Contracting Party, uzgodni∏y, co nast´puje: have agreed as follows: Artyku∏ 1 Article 1 1. Zgodnie z postanowieniami niniejszej umowy, na wniosek Strony polskiej, Strona wietnamska przyjmie obywateli Socjalistycznej Republiki Wietnamu niespe∏niajàcych warunków dla wjazdu i pobytu na terytorium Rzeczypospolitej Polskiej — zwanych dalej „osobami przekazywanymi”. 1. Pursuant to the provisions of this Agreement, upon the request of the Polish Party, the Vietnamese Party shall readmit the citizens of the Socialist Republic of Vietnam, who are out of compliance with the terms and conditions of entry and stay on the territory of the Republic of Poland, hereinafter referred to as ”transferred persons”. 2. Strona polska przyjmie niezw∏ocznie z powrotem bez zb´dnych formalnoÊci osoby przekazane, je˝eli po przyjeêdzie do Socjalistycznej Republiki Wietnamu i sprawdzeniu przez w∏aÊciwe organy Strony wietnamskiej oka˝e si´, ˝e osoby te nie posiadajà obywatelstwa wietnamskiego lub nie spe∏niajà innych warunków okreÊlonych w niniejszej umowie. 2. The Polish Party shall immediately readmit, without unnecessary formalities, any transferred persons, provided that upon the arrival into the Socialist Republic of Vietnam and verification by the competent authorities of the Vietnamese Party, it turns out that these persons do not hold the Vietnamese citizenship or are out of compliance with other terms and conditions of this Agreement. Dziennik Ustaw Nr 156 — 9556 — Poz. 1306 Artyku∏ 2 Article 2 1. Przekazywanie i przyjmowanie musi si´ odbywaç zgodnie z prawem Paƒstw obu Umawiajàcych si´ Stron oraz prawem mi´dzynarodowym, a tak˝e musi gwarantowaç zachowanie zasad porzàdku i bezpieczeƒstwa, poszanowania godnoÊci, z uwzgl´dnieniem aspektów humanitarnych oraz integralnoÊci rodziny osoby przekazywanej. 1. The transfer and readmission shall be subject to the national laws of the States of both Contracting Parties and the international law, and shall also guarantee the observance of order and safety rules, respect for dignity, including the humanitarian aspects and integrity of the transferred persons’ family. 2. Je˝eli osoba przekazywana wyka˝e, ˝e niezb´dne jest za∏atwienie przez nià szczególnych spraw osobistych i majàtkowych, Strona polska umo˝liwi jej przed przekazaniem przez czas okreÊlony, uzasadniony konkretnà sytuacjà, za∏atwienie tych spraw. 2. If the transferred persons presents the evidence that it is necessary for this person to settle particular personal or property matters, the Polish Party, for a definite period of time, shall allow this person, prior to transferring, on case-by-case basis justified by the specific situation, to settle these matters. 3. Osoby przekazywane majà prawo, zgodnie z przepisami prawa wewn´trznego Rzeczypospolitej Polskiej, do zabrania ze sobà lub przekazania do Socjalistycznej Republiki Wietnamu majàtku, w tym Êrodków p∏atniczych, legalnie zgromadzonych podczas pobytu w Rzeczypospolitej Polskiej. 3. The transferred persons have the right, in accordance with the provisions of the national laws of the Republic of Poland, to take or transfer to the Socialist Republic of Vietnam any property, including any means of payment, legally acquired during the stay in the Republic of Poland. Artyku∏ 3 Article 3 Strona wietnamska, po przeprowadzeniu procedury sprawdzajàcej, przyjmie osob´ przekazywanà zgodnie z artyku∏em 1 ust´p 1, je˝eli osoba ta spe∏nia nast´pujàce warunki: The Vietnamese Party, upon carrying out the verification procedure, shall readmit the transferred person pursuant to paragraph 1 of Article 1 provided that the person concerned meets the following terms and conditions: 1) posiada obywatelstwo wietnamskie i nie posiada ˝adnego innego obywatelstwa, 1) holds the Vietnamese citizenship and does not hold any other citizenship, 2) kiedykolwiek przed przybyciem na terytorium Rzeczypospolitej Polskiej mia∏a miejsce sta∏ego zamieszkania na terytorium Socjalistycznej Republiki Wietnamu i nie ma miejsca sta∏ego zamieszkania w paƒstwie trzecim, 2) had, at any time, prior to arrival on the territory of the Republic of Poland, a permanent residence on the territory of the Socialist Republic of Vietnam and does not have a permanent residence in a third country, 3) otrzyma∏a decyzj´ o wydaleniu, podlegajàcà wykonaniu zgodnie z przepisami prawa wewn´trznego Rzeczypospolitej Polskiej. 3) has received an expel decision to be implemented in accordance with the provisions of the national laws of the Republic of Poland. Artyku∏ 4 Article 4 1. Strona polska ponownie, na wniosek Strony wietnamskiej, rozwa˝y przekazanie osoby w przypadku, gdy nie nastàpi∏o jeszcze jej przekazanie, po otrzymaniu od Strony wietnamskiej dodatkowych ustaleƒ dokonanych w toku przeprowadzonej procedury sprawdzajàcej, o której mowa w artykule 3. 1. Upon the request of the Vietnamese Party, the Polish Party shall once more reconsider the transfer, provided that the person concerned has not already been transferred, following the receipt from the Vietnamese Party of any additional findings resulting from the verification procedure referred to in Article 3. 2. W przypadku kiedy osoba przekazywana posiada wa˝ne zezwolenie na wjazd i pobyt w paƒstwie trzecim, Strona polska umo˝liwi jej wyjazd do tego paƒstwa i odstàpi od przekazania tej osoby Stronie wietnamskiej. 2. In the event the transferred person holds a valid permit for entry and stay in a third country, the Polish Party shall enable the transferred person to leave to this country and shall refrain from transferring this person to the Vietnamese Party. Artyku∏ 5 Article 5 1. Strona wietnamska udzieli Stronie polskiej odpowiedzi na wniosek o przyj´cie osoby przekazywanej 1. The Vietnamese Party shall answer to the readmission request concerning the transferred Dziennik Ustaw Nr 156 — 9557 — Poz. 1306 w terminie do 45 dni od dnia otrzymania wniosku. Strona wietnamska zobowiàzuje si´ maksymalnie skróciç termin udzielenia odpowiedzi w przypadku, gdy Strona polska powiadomi Stron´ wietnamskà, ˝e osoba przekazywana zosta∏a umieszczona w strze˝onym oÊrodku lub w areszcie w celu wydalenia. person issued by the Polish Party within 45 days from the date of receipt of such a request. The Vietnamese Party shall put its best efforts to shorten the response time when the Polish Party notifies the Vietnamese Party that the transferred person has been put in a guarded facility or under detention in order to be expelled. 2. Strona polska poinformuje Stron´ wietnamskà o planowanym terminie przekazania osoby co najmniej 15 dni przed dniem przekazania. 2. The Polish Party shall notify the Vietnamese Party of the scheduled transfer date of a transferred person at least 15 days prior to this date. 3. Zg∏oszenie Stronie polskiej przez Stron´ wietnamskà osoby przekazanej, do przyj´cia w trybie artyku∏u 1 ust´p 2, mo˝e nastàpiç w terminie 90 dni od dnia przekazania Stronie wietnamskiej tej osoby, z wyjàtkiem przypadku, gdy osoba ta nie posiada∏a w dniu przekazania obywatelstwa wietnamskiego. 3. The readmission request subject to paragraph 2 of Article 1 shall be filed by the Vietnamese Party to the Polish Party within 90 days from the transfer date of the person concerned to the Vietnamese Party, except when this person, on the transfer date, did not hold a Vietnamese citizenship. Artyku∏ 6 Article 6 Wszelkie koszty zwiàzane z przekazaniem osoby, o której mowa w artykule 1 ust´py 1 i 2, b´dà pokrywane przez Stron´ polskà. Any costs associated with the transfer of the person referred to in paragraphs 1 and 2 of Article 1, shall be borne by the Polish Party. Artyku∏ 7 Article 7 W celu zapewnienia sprawnej realizacji postanowieƒ Umowy Umawiajàce si´ Strony b´dà wspó∏pracowaç w zakresie wymiany ekspertów, doÊwiadczeƒ, prowadzenia szkoleƒ, a tak˝e b´dà si´ wspieraç organizacyjnie, technicznie i technologicznie. In order to ensure effective implementation of the provisions of this Agreement, the Contracting Parties shall cooperate in the field of exchange of experts and experience, and delivery of training and also organisationally, technically and technologically support each other. Artyku∏ 8 Article 8 1. Dane osobowe, niezb´dne do realizacji niniejszej umowy, mogà obejmowaç: 1. Personal data required for the implementation of this Agreement may include:

  1. a)dane personalne osoby przekazywanej i, w razie potrzeby, cz∏onków jej rodziny, to jest nazwisko, imi´, ewentualnie poprzednie nazwiska, przydomki lub pseudonimy, przezwiska, dat´ i miejsce urodzenia, p∏eç, aktualne i ewentualne wczeÊniejsze obywatelstwa,
  2. a)personal information on the transferred person and, if necessary, the members of his/her family, i.e. surname, first name, previous names (if applicable), nicknames or pseudonyms, other names, date and place of birth, sex, present and possible previous citizenship(s),
  3. b)paszport, dowód osobisty i inne dokumenty stwierdzajàce to˝samoÊç, dokumenty s∏u˝àce ustaleniu to˝samoÊci, przepustki graniczne lub inne dokumenty uprawniajàce do przekraczania granicy (numer, data wa˝noÊci, data wydania, organ wydajàcy, miejsce wydania itd.),
  4. b)passport, identity card and documents for identity confirmation, documents for identity verification, border passes or other border-crossing authorisations (number, validity, date of issue, issuing authority, place of issue, etc.),
  5. c)inne dane s∏u˝àce identyfikacji osób przekazywanych,
  6. c)other information used to identify the transferred persons,
  7. d)miejsca pobytu i opis tras podró˝y,
  8. d)places of stay and description of the travel routes,
  9. e)wydane zezwolenia na pobyt lub wiz´,
  10. e)issued stay permits or a visa,
  11. f)inne materia∏y s∏u˝àce identyfikacji osób, które mog∏yby mieç znaczenie dla sprawdzenia warunków przyj´cia osób przekazywanych, zgodnie z niniejszà umowà.
  12. f)other materials serving persons identification, if applicable, which could be used to check the terms and conditions of readmission of the transferred persons, subject to this Agreement. Przekazywanie danych osobowych b´dzie nast´powaç zgodnie z prawem wewn´trznym Paƒstwa ka˝dej Umawiajàcej si´ Strony, z uwzgl´dnieniem nast´pujàcych zasad: 2. The transfer of personal data shall be performed in accordance with the national laws of the States of each of the Contracting Parties, subject to the following principles:
  13. a)dane osobowe mogà byç wykorzystywane tylko w podanym celu i na warunkach okreÊlonych przez organ przekazujàcy,
  14. a)personal data may only be used for the purpose and subject to conditions specified by the transferring authority,
  15. b)na wniosek organu przekazujàcego organ otrzymujàcy powiadomi go o sposobie wykorzystania przekazanych danych oraz o uzyskanych wynikach,
  16. b)upon request of the transferring authority the receiving authority shall notify the transferring authority of the method of using the provided data and achieved results,
  17. c)dane osobowe mogà byç przekazywane wy∏àcznie w∏aÊciwym organom i s∏u˝bom. Przekazywanie danych innym organom lub s∏u˝bom b´dzie mo˝liwe jedynie po uprzednim uzyskaniu zgody organu przekazujàcego,
  18. c)personal data may be provided only to competent authorities and services. The data may be provided to other authorities or services only upon a prior consent of the transferring authority,
  19. d)organ przekazujàcy zobowiàzany jest zwróciç uwag´ na prawid∏owoÊç przekazywanych danych oraz na potrzeb´ i wspó∏miernoÊç ich przekazania do zamierzonego celu. Nale˝y przy tym przestrzegaç zakazów przekazywania danych, jakie obowiàzujà w prawie wewn´trznym paƒstwa organu przekazujàcego. W przypadku przekazania b∏´dnych danych lub których nie wolno by∏o przekazywaç, nale˝y o tym niezw∏ocznie powiadomiç organ otrzymujàcy, który zobowiàzany jest skorygowaç lub zniszczyç te dane,
  20. d)the transferring authority shall pay attention to the exactness of the transferred data as well as the need and commensurability of their transferring for the intended purpose. The prohibitions of transferring data as permitted by the existing national laws of the State of the transferring authority must be observed. In the event of transferring the incorrect or prohibited data, the receiving authority should be immediately notified and is obliged to correct or destroy such data,
  21. e)organ przekazujàcy oraz organ otrzymujàcy zobowiàzane sà do udokumentowania faktu przekazania i otrzymania danych osobowych,
  22. e)the transferring authority and the receiving authority shall document the fact of transfer and receipt of the personal data,
  23. f)organ przekazujàcy oraz organ otrzymujàcy zobowiàzane sà do skutecznej ochrony przekazanych danych osobowych przed dost´pem do nich osób nieuprawnionych, ich zmianà lub ujawnieniem.
  24. f)the transferring authority and the receiving authority shall effectively protect the provided personal data against access by unauthorised persons, change and disclosure. Artyku∏ 9 Article 9 Sposób i tryb realizacji niniejszej umowy oraz organy w∏aÊciwe do jej wykonywania okreÊlone sà w Protokole. Protokó∏ stanowi integralnà cz´Êç niniejszej umowy. Methods and procedure of implementation of this Agreement as well as competent authorities responsible for its enforcement are specified in the Protocol. The Protocol constitutes an integral part of this Agreement. Artyku∏ 10 Article 10 W przypadku gdy obywatel Rzeczypospolitej Polskiej nie spe∏nia warunków obowiàzujàcych dla wjazdu i pobytu na terytorium Socjalistycznej Republiki Wietnamu, postanowienia niniejszej umowy b´dà odpowiednio stosowane. In the event a citizen of the Republic of Poland is out of compliance with the terms and conditions of entry and stay on the territory of the Socialist Republic of Vietnam, the provisions of this Agreement shall be applied accordingly. Artyku∏ 11 Article 11 Umawiajàce si´ Strony nie b´dà stosowaç postanowieƒ niniejszej umowy wobec obywateli jednej z Umawiajàcych si´ Stron, je˝eli zosta∏o ustalone, ˝e wjechali oni na terytorium Paƒstwa drugiej Umawia- The Contracting Parties shall not apply the provisions of this Agreement to the citizens of one Contracting Party, if determined that these citizens entered the territory of the State of the other Dziennik Ustaw Nr 156 — 9559 — Poz. 1306 jàcej si´ Strony przed dniem wejÊcia w ˝ycie niniejszej umowy. Contracting Party prior to the date of entry into force of this Agreement. Artyku∏ 12 Article 12 Umawiajàce si´ Strony b´dà dokonywa∏y okresowej oceny realizacji postanowieƒ niniejszej umowy, nie rzadziej ni˝ w okresach pi´cioletnich. The Contracting Parties shall periodically evaluate the implementation of the provisions of this Agreement, not less frequently than in 5 year periods. Artyku∏ 13 Article 13 Postanowienia niniejszej umowy nie naruszajà praw i zobowiàzaƒ ka˝dej z Umawiajàcych si´ Stron, wynikajàcych z innych umów mi´dzynarodowych, których sà stronami. The provisions of this Agreement do not affect any rights and obligations of each of the Contracting Parties under any other international agreements, to which they are a party. Artyku∏ 14 Article 14 Spory dotyczàce interpretacji lub stosowania niniejszej umowy b´dà rozstrzygane w drodze uzgodnieƒ mi´dzy w∏aÊciwymi organami okreÊlonymi w Protokole. W przypadku nieosiàgni´cia porozumienia spory b´dà rozstrzygane na drodze dyplomatycznej. Any disputes arising from the interpretation or implementation of this Agreement shall be settled by way of consultations between the competent authorities specified in the Protocol. In the event if an agreement can not be reached, the disputes shall be resolved through the diplomatic channels. Artyku∏ 15 Article 15 1. Niniejsza umowa podlega zatwierdzeniu lub ratyfikacji zgodnie z prawem wewn´trznym Paƒstwa ka˝dej z Umawiajàcych si´ Stron, co zostanie stwierdzone w drodze wymiany not dyplomatycznych. Umowa wejdzie w ˝ycie po up∏ywie 30 dni od dnia otrzymania noty póêniejszej stwierdzajàcej takie zatwierdzenie lub ratyfikacj´. 1. This Agreement is subject to approval or ratification in accordance with the national laws of the State of each of the Contracting Parties, which shall be confirmed through the exchange of the diplomatic notes. This Agreement shall entry into force after 30 days from the date of receipt of the later note confirming such an approval or ratification. 2. Niniejsza umowa zawarta jest na czas nieokreÊlony. Mo˝e byç ona wypowiedziana przez ka˝dà z Umawiajàcych si´ Stron w drodze notyfikacji. W takim przypadku Umowa traci moc po up∏ywie 90 dni od dnia otrzymania noty informujàcej o wypowiedzeniu. 2. This Agreement is concluded for an indefinite period of time. It may be terminated by each of the Contracting Parties by way of notification. In such a case this Agreement expires after 90 days from the date of receipt of the note of termination. 3. Niniejsza umowa mo˝e byç zmieniana w formie pisemnej, za wzajemnà zgodà obu Umawiajàcych si´ Stron. 3. This Agreement may be amended in writing by mutual consent of both Contracting Parties. NINIEJSZÑ UMOW¢ sporzàdzono w Hanoi dnia 22 kwietnia 2004 r. w dwóch egzemplarzach, ka˝dy w j´zykach polskim, wietnamskim i angielskim, przy czym wszystkie teksty sà jednakowo autentyczne. W przypadku rozbie˝noÊci przy ich interpretacji tekst angielski b´dzie uwa˝any za rozstrzygajàcy. THIS AGREEMENT is done at Hanoi, on 22.04.2004, in two original copies, each one in Polish, Vietnamese and English languages, all texts being equally authentic. In the event of any discrepancies in their interpretation, the English text shall prevail. Obywatelstwo wietnamskie stwierdza si´ na podstawie jednego z nast´pujàcych dokumentów: 1. Documents determining Vietnamese citizenship shall include one of the following:
  25. a)wa˝nego paszportu wietnamskiego,
  26. a)valid Vietnamese passport,
  27. b)wa˝nego wietnamskiego dowodu osobistego,
  28. b)valid Vietnamese identity card,
  29. c)wa˝nego Êwiadectwa posiadania obywatelstwa wietnamskiego,
  30. c)valid certificate of Vietnamese citizenship,
  31. d)decyzji o przyj´ciu obywatelstwa wietnamskiego,
  32. d)decision on Vietnamese naturalization,
  33. e)decyzji o przywróceniu do obywatelstwa wietnamskiego.
  34. e)decision on restoration of Vietnamese citizenship. 2. Obywatelstwo polskie stwierdza si´ na podstawie jednego z nast´pujàcych dokumentów: 2. Documents determining Polish citizenship shall include one of the following:
  35. a)wa˝nego paszportu polskiego,
  36. a)valid Polish passport,
  37. b)wa˝nego dowodu osobistego,
  38. b)valid identity card,
  39. c)poÊwiadczenia obywatelstwa polskiego,
  40. c)certificate of Polish citizenship,
  41. d)wa˝nej ksià˝eczki ˝eglarskiej.
  42. d)valid sailor’s book. 3. Dokumenty, na podstawie których mo˝na domniemywaç obywatelstwo wietnamskie: 3. Documents that may be used as reference in presuming Vietnamese citizenship:
  43. a)paszport wietnamski, który utraci∏ wa˝noÊç,
  44. a)expired Vietnamese passport,
  45. b)karta identyfikacyjna wydana dla osoby zamieszkujàcej w strefie przygranicznej,
  46. b)border people’s identity card,
  47. c)ksià˝eczka wojskowa,
  48. c)Army’s identity card,
  49. d)dokument podró˝y ze zdj´ciem,
  50. d)Vietnamese laissez-passer with photo,
  51. e)ksià˝eczka ˝eglarska,
  52. e)ship-crew passport,
