Artikel 1

29. h)Sprachgutachten über die Sprache der betroffenen Person;
30. h)linguistic expertise on the language of the person concerned;
31. i)jakiegokolwiek innego dokumentu akceptowanego przez Umawiajàcà si´ Stron´ wezwanà.

Wzór wniosku o przyj´cie okreÊla za∏àcznik nr 1 do niniejszego protoko∏u. Wszystkie rubryki wniosku powinny byç wype∏nione lub przekreÊlone. 2. Eine Formularvorlage für das Rückübernahmegesuch findet sich in Anhang 1 dieses Protokolls. Sämtliche Abschnitte des Formulars sind entweder auszufüllen oder durchzustreichen. 2. A template of the readmission request can be found in the Appendix 1 of this Protocol. All sections of the form are to be either completed or crossed out. 3. Wniosek o przyj´cie b´dzie przekazywany bezpiecznymi Êrodkami ∏àcznoÊci, w szczególnoÊci faksem, bezpoÊrednio do w∏aÊciwego organu. 3. Jedes Rückübernahmegesuch wird der zuständigen Behörde auf einem sicheren Übertragungsweg, insbesondere per Telefax, direkt übermittelt. 3. Any readmission request is to be transmitted via secured communication channels, in particular by fax, directly to the competent authority. 4. Umawiajàca si´ Strona wezwana udzieli, tak szybko, jak to mo˝liwe, odpowiedzi na wniosek o przyj´cie, najpóêniej w terminie oÊmiu dni roboczych od dnia otrzymania wniosku. 4. Die ersuchte Vertragspartei beantwortet das Rückübernahmegesuch so schnell wie möglich, spätestens aber innerhalb von acht Arbeitstagen nach Eingang des Gesuchs. 4. The requested Contracting Party replies to the readmission request as quickly as possible, at the latest within eight working days from the date of receipt of the request. 5. Przekazanie osoby nie mo˝e nastàpiç przed zaakceptowaniem przez Umawiajàcà si´ Stron´ wezwanà wniosku o przyj´cie i powiadomieniem o tym pisemnie Umawiajàcej si´ Strony wnioskujàcej. Zgoda na przyj´cie jest wa˝na przez okres 30 dni. Okres ten mo˝e zostaç przed∏u˝ony za zgodà Umawiajàcych si´ Stron. 5. Die Übergabe einer Person erfolgt erst, nachdem die ersuchte Vertragspartei dem Rückübernahmegesuch zugestimmt und dies der ersuchenden Vertragspartei schriftlich mitgeteilt hat. Die Zustimmung zu der Rückübernahme gilt 30 Tage lang. Diese Frist kann nach Absprache zwischen den beiden Vertragsparteien verlängert werden. 5. The transfer of a person shall not take place until the requested Contracting Party has accepted the readmission request and has notified the requesting Contracting Party thereof in writing. The acceptance of readmission is valid for 30 days. This time-limit may be extended after consultation between the Contracting Parties. 6. Umawiajàca si´ Strona wnioskujàca powiadamia pisemnie Stron´ wezwanà o terminie przybycia osoby wymienionej we wniosku o przyj´cie najpóêniej na trzy dni przed jej przybyciem. 6. Die ersuchende Vertragspartei teilt der ersuchten Vertragspartei die Ankunftszeit der von dem Rückübernahmegesuch betroffenen Person spätestens drei Tage vorher mit. 6. The requesting Contracting Party notifies the requested Contracting Party of the date of arrival of the person concerned by the readmission request at the latest three days in advance. 7. Je˝eli osoba podlegajàca przekazaniu posiada podrobione lub przerobione dokumenty Umawiajàcej si´ Strony wezwanej, dokumenty te b´dà przes∏ane przez Umawiajàcà si´ Stron´ wnioskujàcà po akceptacji wniosku o przyj´cie tej osoby. 7. Besitzt die von dem Rückübernahmegesuch betroffene Person verfälschte oder gefälschte Dokumente der ersuchten Vertragspartei, werden diese Dokumente von der ersuchenden Vertragspartei übersandt, wenn die Zustimmung zu der Rückübernahme erteilt worden ist. 7. If the person concerned by the readmission request is in possession of forged or false documents of the requested Contracting Party, these documents are to be transmitted by the requesting Contracting Party when readmission has been accepted. 8. Je˝eli osoba podlegajàca przekazaniu potrzebuje opieki medycznej, Umawiajàca si´ Strona wnioskujàca zobowiàzana jest zapewniç równie˝, je˝eli le˝y to w interesie tej osoby, informacje na temat potrzeby specjalnej opieki medycznej lub innej sta∏ej opieki przez innà osob´, lub transportu karetkà pogotowia. 8. Ist die rückzuübernehmende Person auf medizinische Betreuung angewiesen, liefert die ersuchende Vertragspartei zudem, sofern dies im Interesse dieser Person liegt, Informationen darüber, ob sie einer besonderen ärztlichen oder anderen Behandlung bedarf, überwacht oder mit der Ambulanz transportiert werden muss. 8. If the person subject to readmission is in need of medical care, the requesting Contracting Party shall also provide, if this is in the interest of the person concerned, information about the need for special treatment, such as medical or other care, supervision, or transport by ambulance. 9. The entry of a third-country citizen or stateless person into the territory of the requested Contracting Party or his/her stay there may be proved on the basis of one of the following pieces of evidence:

1. a)odcisku piecz´ci wjazdowej lub wyjazdowej lub innego rodzaju adnotacji w∏aÊciwych organów Umawiajàcej si´ Strony wezwanej umieszczonych w oryginalnych, przerobionych lub podrobionych dokumentach podró˝y albo w innych dokumentach to˝samoÊci,
2. a)Einreise- oder Ausreisestempel oder andere gleichwertige Vermerke, die von einer zuständigen Behörde der ersuchten Vertragspartei in echten, verfälschten oder gefälschten Reisedokumenten oder Identitätsauweisen angebracht wurden;
3. a)entry or departure stamp or other equivalent remark affixed by a competent authority of the requested Contracting Party in the authentic, forged or false travel or identity documents;
4. b)jakiegokolwiek wa˝nego dokumentu, potwierdzajàcego legalny pobyt na terytorium Umawiajàcej si´ Strony wezwanej,
5. b)gültiges Dokument, das einen rechtmässigen Aufenthalt im Hoheitsgebiet der ersuchten Vertragspartei belegt;

8. c)Dokument, das einen rechtmässigen Aufenthalt im Hoheitsgebiet der ersuchten Vertragspartei belegt und seit weniger als sechs Monaten vor Einreichung des Rückübernahmegesuchs abgelaufen ist;
9. c)any document confirming an authorised stay on the territory of the requested Contracting Party which expired less than six months before the day of the submission of the readmission request;
10. d)jakiejkolwiek wa˝nej wizy zezwalajàcej na pobyt na terytorium Umawiajàcej si´ Strony wezwanej,
11. d)gültiges Visum, das zum Aufenthalt im Hoheitsgebiet der ersuchten Vertragspartei berechtigt;
12. d)any valid visa allowing to stay on the territory of the requested Contracting Party;
13. e)jakiejkolwiek wizy, która zezwala∏a na pobyt na terytorium Umawiajàcej si´ Strony wezwanej i utraci∏a wa˝noÊç w okresie krótszym ni˝ szeÊç miesi´cy przed dniem z∏o˝enia wniosku o przyj´cie,
14. e)Visum, das zum Aufenthalt im Hoheitsgebiet der ersuchten Vertragspartei berechtigt und seit weniger als sechs Monaten vor Einreichung des Rückübernahmegesuchs abgelaufen ist;
15. e)any visa allowing to stay on the territory of the requested Contracting Party which expired less than six months before the day of the submission of the readmission request;

19. g)wa˝nego dokumentu, na podstawie którego mo˝na ustaliç to˝samoÊç osoby (w szczególnoÊci prawa jazdy, ksià˝eczki ˝eglarskiej, legitymacji s∏u˝bowej), wydanego przez organy Umawiajàcej si´ Strony wezwanej w okresie krótszym ni˝ 6 miesi´cy przed dniem z∏o˝enia wniosku o przyj´cie.
