  2. a)ensuring that all chemicals are evaluated to determine their hazards,

  5. b)providing employers with a mechanism to obtain from suppliers information about the chemicals used at work so that they can implement effective programmes to protect workers from chemical hazards,

CZ¢Âå I PART I PARTIE I ZAKRES STOSOWANIA I DEFINICJE SCOPE AND DEFINITIONS CHAMP D’APPLICATION ET DÉFINITIONS Artyku∏ 1 Article 1 Article 1 1. Niniejsza konwencja ma zastosowanie do wszystkich ga∏´zi dzia∏alnoÊci gospodarczej, w których u˝ywane sà substancje i preparaty chemiczne. 1. This Convention applies to all branches of economic activity in which chemicals are used. 1. The competent authority of a Member ratifying this Convention, after consulting the most representative organisations of employers and workers concerned, and on the basis of an assessment of the hazards involved and the protective measures to be applied — 2.   15. a)may exclude particular branches of economic activity, undertakings or products from the application of the Convention, or certain provisions thereof, when — (
  16. i)special problems of a substantial nature arise; and

  25. a)okreÊlenie „substancje i preparaty chemiczne” oznacza pierwiastki chemiczne, ich zwiàzki i preparaty, zarówno naturalne, jak i syntetyczne; (
  26. a)the term “chemicals” means chemical elements and compounds, and mixtures thereof, whether natural or synthetic;
  27. a)les termes «produits chimiques» s’appliquent aux éléments et composés chimiques, et ∫ leurs mélanges, qu’ils soient naturels ou synthétiques;
  28. b)okreÊlenie „niebezpieczne substancje i preparaty chemiczne” obejmuje wszystkie substancje i preparaty chemiczne, które zosta∏y sklasyfikowane jako niebezpieczne zgodnie z artyku∏em 6 lub co do których istniejà odpowiednie informacje wskazujàce, ˝e sà niebezpieczne; (
  29. b)the term “hazardous chemical” includes any chemical which has been classified as hazardous in accordance with Article 6 or for which relevant information exists to indicate that the chemical is hazardous;

  41. iv)the transport of chemicals;

  43. v)usuwanie i przetwarzanie odpadów chemicznych; (
  44. v)the disposal and treatment of waste chemicals;
  45. v)l’élimination et le traitement des déchets de produits chimiques;
  46. vi)emisj´ substancji i preparatów chemicznych wynikajà z dzia∏alnoÊci zawodowej; (
  47. vi)the release of chemicals resulting from work activities;
  48. vi)l’émission de produits chimiques résultant d’activités professionnelles; vii) konserwacj´, napraw´ oraz czyszczenie sprz´tu i pojemników u˝ywanych do substancji i preparatów chemicznych; (vii) the maintenance, repair and cleaning of equipment and containers for chemicals; vii) l’entretien, la réparation et le nettoyage du matériel et des récipients utilisés pour des produits chimiques;
  49. d)okreÊlenie „ga∏´zie dzia∏alnoÊci gospodarczej” oznacza wszystkie ga∏´zie, w których zatrudnieni sà pracownicy, w∏àczajàc w to s∏u˝by publiczne; (
  50. d)the term “branches of economic activity” means all branches in which workers are employed, including the public service;

  53. e)the term “article” means an object which is formed to a specific shape or design during its manufacture or which is in its natural shape, and whose use in that form is dependent in whole or in part on its shape or design;
  54. e)le terme «article» désigne tout objet fabriqué en vue d’obtenir une certaine forme ou configuration, ou qui se présente sous sa forme naturelle et dont l’utilisation sous lesdites formes est liée en tout ou partie ∫ sa forme ou ∫ sa configuration;
  55. f)okreÊlenie „przedstawiciele pracowników” oznacza osoby uznane za takie przez ustawodawstwo lub praktyk´ krajowà, zgodnie z Konwencjà dotyczàcà przedstawicieli pracowników, z 1971 r. (
  56. f)the term “workers’ representatives” means persons who are recognised as such by national law or practice, in accordance with the Workers’ Representatives Convention, 1971.
  57. f)les termes «représentants des travailleurs» désignent des personnes reconnues comme tels par la législation ou la pratique nationales, selon la convention concernant les représentants des travailleurs, 1971. CZ¢Âå II PART II PARTIE II ZASADY OGÓLNE GENERAL PRINCIPLES PRINCIPES GÉNÉRAUX Artyku∏ 3 Article 3 Article 3 Ârodki, jakie majà byç podj´te w celu wprowadzenia w ˝ycie postanowieƒ niniejszej konwencji, b´dà konsultowane z najbardziej reprezentatywnymi zainteresowanymi organizacjami pracodawców i pracowników. The most representative organisations of employers and workers concerned shall be consulted on the measures to be taken to give effect to the provisions of this Convention. Les organisations les plus représentatives d’employeurs et de travailleurs intéressées doivent ˘tre consultées sur les measures ∫ prendre pour donner effet aux dispositions de la convention. In the light of national conditions and practice and in consultation with the most representative organisations of employers and workers, each Member shall formulate, implement and periodically review a coherent policy on safety in the use of chemicals at work. Artyku∏ 5 Article 5 Article 5 W∏aÊciwa w∏adza b´dzie mia∏a mo˝liwoÊç, jeÊli jest to uzasadnione wzgl´dami bezpieczeƒstwa i zdrowia, zakazaç lub ograniczyç u˝ywanie pewnych niebezpiecznych substancji i preparatów chemicznych lub wymagaç powiadomienia lub uzyskania zezwolenia przed ich u˝ywaniem. The competent authority shall have the power, if justified on safety and health grounds, to prohibit or restrict the use of certain hazardous chemicals, or to require advance notification and authorisation before such chemicals are used.   14. Each Member which has ratified this Convention and which does not, within the year following the expiration of the period of ten years mentioned in the preceding paragraph, exercise the right of denunciation provided for in this Article, will be bound for another period of ten years and, thereafter, may denounce this Convention at the expiration of each period of ten years under the terms provided for in this Article.
