The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Republic of Poland and has the honour to propose, with reference to the Co-operation Agreement between the Republic of Poland and the European Police Office of 3 October 2001 (hereinafter ”the Agreement”), and in view of Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on the European Union, on the establishment of a European Police Office (Europol Convention, 26 July 1995), that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol referred to in Article 14 and Annex 3 of the Agreement, be agreed upon as set out in the Attachment. If this proposal is acceptable to the Ministry of Foreign Affairs of the Republic of Poland, the Embassy proposes that this note and the affirmative note of the Ministry of foreign Affairs shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Poland, which (shall be applied provisionally from the day on which this affirmative note has been received by the Embassy, and which) shall enter into force on the first day of the second month following the date on which the Kingdom of the Netherlands and the Republic of Poland have informed each other that the formalities required for the entry into force have been complied with. Art. 2. Przywileje i immunitety 2. Privileges and immunities 1. Na mocy postanowieƒ niniejszej umowy oficerowi ∏àcznikowemu oraz cz∏onkom jego rodziny zamieszkujàcym wraz z nim w jednym gospodarstwie domowym, a nieposiadajàcym obywatelstwa holenderskiego, b´dà przys∏ugiwaç, na terenie Królestwa Niderlandów i poza nim, przywileje i immunitety, które na mocy Konwencji wiedeƒskiej z dnia 18 kwietnia 1961 r. o stosunkach dyplomatycznych przys∏ugujà cz∏onkom korpusu dyplomatycznego. 1. Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not possess Dutch nationality, shall enjoy in and vis-∫-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplomatic Relations of 18 April 1961. 2. Immunitet przyznany osobom wymienionym w ust´pie 1 niniejszego artyku∏u nie obejmuje: 2. The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:

1. i)powództw cywilnych wnoszonych przez stron´ trzecià z tytu∏u szkód komunikacyjnych spowodowanych przez t´ osob´ (w∏àczajàc uszkodzenia cia∏a lub Êmierç); ani
2. i)civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such person; or
3. ii)jurysdykcji karnej i cywilnej wobec czynów pope∏nionych bez zwiàzku z wykonywaniem obowiàzków oficera.
4. ii)criminal and civil jurisdiction over acts performed outside the course of their official duties. 3. Zobowiàzania Paƒstwa wysy∏ajàcego i jego personelu, które na mocy Konwencji wiedeƒskiej stosuje si´ do cz∏onków jego personelu dyplomatycznego, stosuje si´ odpowiednio do osób wymienionych w ust´pie 1 niniejszego artyku∏u. 3. The obligations of Sending States and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article. Art. 3. Przyjazd, pobyt i wyjazd 3. Entry, stay and departure 1. JeÊli b´dzie to konieczne, Rzàd u∏atwi przyjazd, pobyt i wyjazd oficerowi ∏àcznikowemu oraz cz∏onkom jego rodziny pozostajàcym wraz z nim we wspólnym gospodarstwie domowym. 1. The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household. 2. Artyku∏ niniejszy nie zdejmuje z osób domagajàcych si´ traktowania w sposób okreÊlony w niniejszym artykule obowiàzku udokumentowania przez te osoby statusu, o którym mowa w ust´pie 1. 2. This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article. 3. Wizy, które mogà byç wymagane dla osób, o których mowa w niniejszym artykule, zostanà wydane bezp∏atnie i niezw∏ocznie. 3. Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible. Dziennik Ustaw Nr 91 — 5564 — Poz. 610 Art. 4. Zatrudnienie 4. Employment Cz∏onkowie rodziny pozostajàcy wraz z oficerem ∏àcznikowym we wspólnym gospodarstwie domowym, a nieposiadajàcy obywatelstwa Paƒstwa Unii Europejskiej, sà zwolnieni z obowiàzku uzyskiwania zezwolenia na prac´ w okresie oddelegowania oficera ∏àcznikowego. Members of the family forming part of the household of the liaison officer not having the nationality of an EU Sending State shall be exempt from the obligation to obtain working permits for the duration of the secondment of the liaison officer. Art. 5. NienaruszalnoÊç archiwów 5. Inviolability of archives Archiwa oficera ∏àcznikowego sà nietykalne, niezale˝nie od miejsca, w którym si´ znajdujà, i osoby, w posiadaniu której pozostajà. The archives of the liaison officer wherever located and by whomsoever held shall be inviolable. Art. 6. Ochrona osobista 6. Personal Protection Na wniosek Paƒstwa wysy∏ajàcego instytucje Paƒstwa-Gospodarza podejmà wszelkie uzasadnione kroki zgodnie ze swoim prawem wewn´trznym, które sà konieczne w celu zapewnienia bezpieczeƒstwa i ochrony oficerowi ∏àcznikowemu, jak równie˝ cz∏onkom jego rodziny pozostajàcym wraz z nim we wspólnym gospodarstwie domowym, a których bezpieczeƒstwo zosta∏o zagro˝one w zwiàzku z wykonywaniem obowiàzków przez oficera ∏àcznikowego w Europolu. The Host State authorities shall, if so requested by the Sending State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as members of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol. Art. 7. Udogodnienia i immunitety zwiàzane z ∏àcznoÊcià 7. Facilities and immunities in respect of communication 1. Rzàd zezwoli oficerowi ∏àcznikowemu na swobodne i nie wymagajàce specjalnych zezwoleƒ komunikowanie si´ w celach s∏u˝bowych oraz zabezpieczy jego prawo do tych czynnoÊci. Oficer ∏àcznikowy ma prawo do u˝ywania szyfrów oraz przesy∏ania i odbierania urz´dowej korespondencji, a tak˝e innych urz´dowych wiadomoÊci, za poÊrednictwem kuriera albo w opiecz´towanym baga˝u, z zastrze˝eniem tych samych przywilejów i immunitetów, które dotyczà kurierów i toreb dyplomatycznych. 1. The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immunities as diplomatic couriers and bags. 2. Oficer ∏àcznikowy korzysta, w zakresie wynikajàcym z Mi´dzynarodowej konwencji telekomunikacyjnej z dnia 6 listopada 1982 r., w zakresie komunikowania si´ w celach s∏u˝bowych, z nie mniej korzystnego statusu ni˝ status przyznawany przez Królestwo Niderlandów wszelkim organizacjom mi´dzynarodowym i rzàdom odnoÊnie do priorytetów w ∏àcznoÊci elektronicznej, pocztowej, telegraficznej, teleksowej, radiowej, telewizyjnej, telefonicznej, faksowej, satelitarnej lub innego rodzaju. 2. The liaison officer shall, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organisation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite, or other means. Art. 8. Powiadomienie 8. Notification 1. Paƒstwo wysy∏ajàce niezw∏ocznie powiadomi Rzàd o imieniu i nazwisku oficera ∏àcznikowego, dacie jego przyjazdu i ostatecznego wyjazdu oraz o zakoƒczeniu okresu jego oddelegowania, a tak˝e o dacie przyjazdu i ostatecznego wyjazdu cz∏onków jego rodziny pozostajàcych z nim we wspólnym gospodarstwie domowym, a tak˝e o sytuacji, w której którakolwiek z tych osób przestaje przebywaç we wspólnym gospodarstwie domowym. 1. The Sending State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the termination of his secondment as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household. 2. This card shall serve to identify the holder in relation to all Host State authorities. Art. 9. Rozstrzyganie sporów 9. Settlement of Disputes 1. Wszelkie spory pomi´dzy Paƒstwem wysy∏ajàcym i Rzàdem dotyczàce interpretacji lub stosowania niniejszej umowy, a tak˝e jakiekolwiek kontrowersje odnoszàce si´ do oficera ∏àcznikowego lub stosunku pomi´dzy Paƒstwem wysy∏ajàcym a Rzàdem, które nie zosta∏y rozwiàzane polubownie, b´dà na ˝yczenie Paƒstwa wysy∏ajàcego lub Rzàdu poddane pod rozstrzygni´cie trybuna∏u trzech arbitrów. Ka˝da Strona powo∏uje po jednym arbitrze. Tak powo∏ani arbitrzy wybiorà trzeciego arbitra, który b´dzie przewodniczàcym trybuna∏u. 1. Any dispute between the Sending State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Sending State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Sending State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators. 2. JeÊli jedna ze Stron nie powo∏a arbitra w ciàgu dwóch miesi´cy po sformu∏owaniu takiego ˝àdania przez drugà Stron´, druga Strona mo˝e za˝àdaç wyznaczenia arbitra przez Przewodniczàcego Trybuna∏u SprawiedliwoÊci Wspólnot Europejskich, a w razie jego nieobecnoÊci — przez wiceprzewodniczàcego. 2. If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice-President, to make such an appointment. 3. JeÊli w ciàgu dwóch miesi´cy od ich powo∏ania dwóch pierwszych arbitrów nie dojdzie do porozumienia w sprawie powo∏ania trzeciego arbitra, ka˝da ze Stron mo˝e za˝àdaç powo∏ania trzeciego arbitra przez Przewodniczàcego Trybuna∏u SprawiedliwoÊci Wspólnot Europejskich, a w razie jego nieobecnoÊci — przez wiceprzewodniczàcego. 3. Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice-President, to make such appointment. 4. JeÊli Strony nie uzgodnià inaczej, trybuna∏ przyjmie procedur´ swojego procedowania. 4. Unless the parties agree otherwise, the tribunal shall determine its own procedure. 5. The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and binding on the Parties to the dispute. Art. 10. Na mocy postanowieƒ niniejszej umowy oficerowi ∏àcznikowemu oraz cz∏onkom jego rodziny zamieszkujàcym wraz z nim w jednym gospodarstwie domowym, a nieposiadajàcym obywatelstwa holenderskiego, b´dà przys∏ugiwaç, na terenie Królestwa Niderlandów i poza nim, przywileje i immunitety, które na mocy Konwencji wiedeƒskiej z dnia 18 kwietnia 1961 r. o stosunkach dyplomatycznych przys∏ugujà cz∏onkom korpusu dyplomatycznego. 1. Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not possess Dutch nationality, shall enjoy in and vis-a-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplomatic Relations of 18 April 1961. 2. Immunitet przyznany osobom wymienionym w ust´pie 1 niniejszego artyku∏u nie obejmuje: 2. The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:
5. i)powództw cywilnych wnoszonych przez stron´ trzecià z tytu∏u szkód komunikacyjnych spowodowanych przez t´ osob´ (w∏àczajàc uszkodzenia cia∏a lub Êmierç); ani
6. i)civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such person; or
7. ii)jurysdykcji karnej i cywilnej wobec czynów pope∏nionych bez zwiàzku z wykonywaniem obowiàzków oficera.
8. ii)criminal and civil jurisdiction over acts performed outside the course of their official duties. 3. Zobowiàzania Paƒstwa wysy∏ajàcego i jego personelu, które na mocy Konwencji wiedeƒskiej stosuje si´ do cz∏onków jego personelu dyplomatycznego, stosuje si´ odpowiednio do osób wymienionych w ust´pie 1 niniejszego artyku∏u. 3. The obligations of Sending State and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article. Art. 3. Przyjazd, pobyt i wyjazd 3. Entry, stay and departure 1. JeÊli b´dzie to konieczne, Rzàd u∏atwi przyjazd, pobyt i wyjazd oficerowi ∏àcznikowemu oraz cz∏onkom jego rodziny pozostajàcym wraz z nim we wspólnym gospodarstwie domowym. 1. The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household. 2. Artyku∏ niniejszy nie zdejmuje z osób domagajàcych si´ traktowania w sposób okreÊlony w niniejszym artykule obowiàzku udokumentowania przez te osoby statusu, o którym mowa w ust´pie 1. 2. This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article. 3. Wizy, które mogà byç wymagane dla osób, o których mowa w niniejszym artykule, zostanà wydane bezp∏atnie i niezw∏ocznie. 3. Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible. Art. 4. Zatrudnienie 4. Employment Cz∏onkowie rodziny pozostajàcy wraz z oficerem ∏àcznikowym we wspólnym gospodarstwie domowym, a nieposiadajàcy obywatelstwa Paƒstwa Unii Europejskiej, sà zwolnieni z obowiàzku uzyskiwania zezwolenia na prac´ w okresie oddelegowania oficera ∏àcznikowego. Members of the family forming part of the household of the liaison officer not having the nationality of an EU Sending State shall be exempt from the obligation to obtain working permits for the duration of the secondment of the liaison officer. Art. 5. NienaruszalnoÊç archiwów 5. Inviolability of archives Archiwa oficera ∏àcznikowego sà nietykalne, niezale˝nie od miejsca, w którym si´ znajdujà, i osoby, w posiadaniu której pozostajà. Personal Protection Na wniosek Paƒstwa wysy∏ajàcego instytucje Paƒstwa–Gospodarza podejmà wszelkie uzasadnione kroki zgodnie ze swoim prawem wewn´trznym, które sà konieczne w celu zapewnienia bezpieczeƒstwa i ochrony oficerowi ∏àcznikowemu, jak równie˝ cz∏onkom jego rodziny pozostajàcym wraz z nim we wspólnym gospodarstwie domowym, a których bezpieczeƒstwo zosta∏o zagro˝one w zwiàzku z wykonywaniem obowiàzków przez oficera ∏àcznikowego w Europolu. The Host State authorities shall, if so requested by the Sending State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as members of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol. Art. 7. Udogodnienia i immunitety zwiàzane z ∏àcznoÊcià 7. Facilities and immunities in respect of communication 1. Rzàd zezwoli oficerowi ∏àcznikowemu na swobodne i nie wymagajàce specjalnych zezwoleƒ komunikowanie si´ w celach s∏u˝bowych oraz zabezpieczy jego prawo do tych czynnoÊci. Oficer ∏àcznikowy ma prawo do u˝ywania szyfrów oraz przesy∏ania i odbierania urz´dowej korespondencji, a tak˝e innych urz´dowych wiadomoÊci, za poÊrednictwem kuriera albo w opiecz´towanym baga˝u, z zastrze˝eniem tych samych przywilejów i immunitetów, które dotyczà kurierów i toreb dyplomatycznych. 1. The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immunities as diplomatic couriers and bags. 2. Oficer ∏àcznikowy korzysta, w zakresie wynikajàcym z Mi´dzynarodowej konwencji telekomunikacyjnej z dnia 6 listopada 1982 r., w zakresie komunikowania si´ w celach s∏u˝bowych, z nie mniej korzystnego statusu ni˝ status przyznawany przez Królestwo Niderlandów wszelkim organizacjom mi´dzynarodowym i rzàdom odnoÊnie do priorytetów w ∏àcznoÊci elektronicznej, pocztowej, telegraficznej, teleksowej, radiowej, telewizyjnej, telefonicznej, faksowej, satelitarnej lub innego rodzaju. 2. The liaison officer shall, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organisation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite, or other means. Art. 8. Powiadomienie 8. Notification 1. Paƒstwo wysy∏ajàce niezw∏ocznie powiadomi Rzàd o imieniu i nazwisku oficera ∏àcznikowego, dacie jego przyjazdu i ostatecznego wyjazdu oraz o zakoƒczeniu okresu jego oddelegowania, a tak˝e o dacie przyjazdu i ostatecznego wyjazdu cz∏onków jego rodziny pozostajàcych z nim we wspólnym gospodarstwie domowym, a tak˝e o sytuacji, w której którakolwiek z tych osób przestaje przebywaç we wspólnym gospodarstwie domowym. 1. The Sending State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the termination of his secondment as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household. 2. The Government shall issue to the liaison officer and members of his family forming part of the household, an identification card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all Host State authorities. Art. 9. Rozstrzyganie sporów 9. Settlement of Disputes 1. Wszelkie spory pomi´dzy Paƒstwem wysy∏ajàcym i Rzàdem dotyczàce interpretacji lub stosowania niniejszej umowy, a tak˝e jakiekolwiek kontrowersje odnoszàce si´ do oficera ∏àcznikowego lub stosunku 1. Any dispute between the Sending State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Sen- Dziennik Ustaw Nr 91 — 5569 — Poz. 610 pomi´dzy Paƒstwem wysy∏ajàcym a Rzàdem, które nie zosta∏y rozwiàzane polubownie, b´dà na ˝yczenie Paƒstwa wysy∏ajàcego lub Rzàdu poddane pod rozstrzygni´cie trybuna∏u trzech arbitrów. Ka˝da Strona powo∏uje po jednym arbitrze. Tak powo∏ani arbitrzy wybiorà trzeciego arbitra, który b´dzie przewodniczàcym trybuna∏u. ding State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Sending State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators. 2. JeÊli jedna ze Stron nie powo∏a arbitra w ciàgu dwóch miesi´cy po sformu∏owaniu takiego ˝àdania przez drugà Stron´, druga Strona mo˝e za˝àdaç wyznaczenia arbitra przez Przewodniczàcego Trybuna∏u SprawiedliwoÊci Wspólnot Europejskich, a w razie jego nieobecnoÊci — przez wiceprzewodniczàcego. 2. If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice–President, to make such an appointment. 3. JeÊli w ciàgu dwóch miesi´cy od ich powo∏ania dwóch pierwszych arbitrów nie dojdzie do porozumienia w sprawie powo∏ania trzeciego arbitra, ka˝da ze Stron mo˝e za˝àdaç powo∏ania trzeciego arbitra przez Przewodniczàcego Trybuna∏u SprawiedliwoÊci Wspólnot Europejskich, a w razie jego nieobecnoÊci — przez wiceprzewodniczàcego. 3. Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice–President, to make such appointment. 4. JeÊli Strony nie uzgodnià inaczej, trybuna∏ przyjmie procedur´ swojego procedowania. 4. Unless the parties agree otherwise, the tribunal shall determine its own procedure. 5. Decyzje trybuna∏u b´dà podejmowane wi´kszoÊcià g∏osów. G∏os przewodniczàcego b´dzie decydujàcy. Decyzja trybuna∏u b´dzie ostateczna i wià˝àca dla Stron sporu. 5. The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and binding on the Parties to the dispute. Art. 10. Zakres terytorialny 10. Territorial scope W odniesieniu do Królestwa Niderlandów niniejsza umowa ma zastosowanie wy∏àcznie do europejskiej cz´Êci Królestwa.”. With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.”. The Ministry of Foreign Affairs of the Republic of Poland has the honour to inform the Embassy that the Republic of Poland agrees to the content of the above-mentioned note and accept proposal of the Embassy that the above-mentioned note and this answer for it shall constitute an Agreement between the Republic of Poland and the Kingdom of the Netherlands on the privileges and immunities of the liaison officers at Europol, which (shall be applied provisionally from the day on which this affirmative note has been received by the Embassy, and which) shall enter into force on the first day of the second month following the date on which the Republic of Poland and the Kingdom of the Netherlands have informed each other that the formalities required for the entry into force have been complied with.
