Recalling that, in their 1994 Marrakesh decision on measures concerning least-developed countries and net food-importing developing countries, Ministers of WTO member countries agreed to review the level of food aid established under the Food Aid Convention as further elaborated at the 1996 Singapore Ministerial Conference; Rappelant que, dans leur décision de Marrakech de 1994 sur les mesures relatives aux pays les moins avancés et aux pays en développement importateurs nets de produits alimentaires, les ministres des pays membres de l’OMC sont convenus de passer en revue le niveau d’aide alimentaire fixé par la Convention relative ∫ l’aide alimentaire et conformément aux recommandations élaborées par la suite lors de la Conférence ministérielle de Singapour en 1996;   1. a)making appropriate levels of food aid available on a predictable basis, as determined by the provisions of this Convention;
  2. a)assurant la disponibilité de niveaux adéquats d’aide alimentaire sur une base prévisible, selon les dispositions de la présente Convention; (
  3. b)encouraging members to ensure that the food aid provided is aimed particularly at the alleviation of poverty and hunger of the most vulnerable groups, and is consistent with agricultural development in those countries;
  4. b)encourageant les membres ∫ veiller ∫ ce que l’aide alimentaire fournie vise particuli¯rement ∫ réduire la pauvreté et la faim des groupes les plus vulnérables et soit compatible avec le développement agricole de ces pays; (
  5. c)including principles for maximising the impact, the effectiveness and quality of the food aid provided as a tool in support of food security; and,

  7. d)okreÊlanie ram wspó∏pracy, koordynacji i wymiany informacji mi´dzy cz∏onkami w kwestiach zwiàzanych z pomocà ˝ywnoÊciowà w celu osiàgni´cia wi´kszej wydajnoÊci dzia∏aƒ we wszystkich aspektach pomocy ˝ywnoÊciowej oraz wi´kszej spójnoÊci pomocy ˝ywnoÊciowej i innych instrumentów polityki dzia∏ania.   8. d)providing a framework for co-operation, co-ordination and information-sharing among members on food aid related matters to achieve greater efficiency in all aspects of food aid operations and better coherence between food aid and other policy instruments.

  11. a)Under this Convention, unless the context otherwise requires, any reference to:

  13. i)„CIF” oznacza koszty, ubezpieczenie i fracht; (
  14. i)„c.i.f.” means cost, insurance and freight;
  15. i)„c.a.f.” signifie coût, assurance et fret; (
  16. a)udost´pnianie odpowiedniego i przewidywalnego poziomu pomocy ˝ywnoÊciowej, zgodnie z postanowieniami niniejszej konwencji; (
  17. b)zach´canie cz∏onków do zapewnienia, aby celem dostarczanej pomocy ˝ywnoÊciowej by∏o zmniejszanie biedy i g∏odu w grupach znajdujàcych si´ w potrzebie oraz aby by∏a ona spójna z rozwojem rolnictwa w tych krajach; (

  19. ii)„zobowiàzanie” oznacza minimalnà wielkoÊç pomocy ˝ywnoÊciowej dostarczanej rocznie przez cz∏onka na podstawie artyku∏u III ust´p (e); (
  20. ii)„Commitment” means the minimum amount of food aid to be provided annually by a member under Article III (e);
  21. ii)le terme „engagement” signifie la quantité minimale d’aide alimentaire devant ˘tre fournie annuellement par un membre aux termes de l’article IlI e); (iii) „Komitet” oznacza Komitet ds. Pomocy ˚ywnoÊciowej, o którym mowa w artykule XV; (iii) „Committee” means the Food Aid Committee referred to in Article XV; iii) le „Comité” désigne le Comité de l’aide alimentaire visé ∫ l’article XV; (
  22. iv)„wk∏ad” oznacza wielkoÊç pomocy ˝ywnoÊciowej, jakiej dany cz∏onek rocznie dostarcza i jakà deklaruje Komitetowi, zgodnie z przepisami niniejszej konwencji; (
  23. iv)„Contribution” means the amount of food aid provided and reported to the Committee by a member annually in accordance with the provisions of this Convention;
  24. iv)le terme „contribution” signifie la quantité d’aide alimentaire fournie et notifiée au Comité annuellement par un membre conformément aux dispositions de la présente Convention; (
  25. v)„konwencja” oznacza Konwencj´ o pomocy ˝ywnoÊciowej z 1999 r.; (
  26. v)„Convention” means the Food Aid Convention, 1999;
  27. v)le terme „Convention” désigne la Convention relative ∫ l’aide alimentaire de 1999; (
  28. vi)„KPR” oznacza Komitet Pomocy Rozwojowej Organizacji Wspó∏pracy Gospodarczej i Rozwoju; (
  29. vi)„DAC” means the Development Assistance Committee of OECD;
  30. vi)le sigle „CAD” signifie le Comité d’assistance au développement de l’OCDE; (vii) „kraj rozwijajàcy si´” oznacza ka˝dy kraj lub terytorium kwalifikujàce si´ do otrzymania pomocy ˝ywnoÊciowej na podstawie artyku∏u VII; (vii) „Developing country” means any country or territory eligible to receive food aid under Article VII; vii) l’expression „pays en développement” signifie tout pays ou territoire éligible ∫ recevoir de l’aide alimentaire aux termes de l’article VII; (viii) „produkt kwalifikujàcy si´” oznacza produkt, o którym mowa w artykule IV, który mo˝e byç dostarczany w ramach pomocy ˝ywnoÊciowej przez cz∏onka jako jego wk∏ad na podstawie niniejszej konwencji; (viii) „Eligible product” means a product, referred to in Article IV, which may be provided as food aid by a member as its contribution under this Convention; viii) l’expression „produit éligible” signifie un produit, visé ∫ l’article IV, qui peut ˘tre fourni en guise d’aide alimentaire par un membre comme étant sa contribution aux termes de la présente Convention; (
  31. ix)„Dyrektor Zarzàdzajàcy” oznacza Dyrektora Zarzàdzajàcego Mi´dzynarodowej Rady Zbo˝owej; (
  32. ix)„Executive Director” means the Executive Director of the International Grains Council;
  33. ix)le „Directeur exécutif” désigne le Directeur exécutif du Conseil international des céréales; (
  34. x)„FOB” oznacza „franco statek”; (
  35. x)„f.o.b.” means free on board;
  36. x)le sigle „f.o.b.” signifie franco ∫ bord; (
  37. xi)„˝ywnoÊç” lub „pomoc ˝ywnoÊciowa”, tam gdzie jest to w∏aÊciwe, obejmuje odniesienie do nasion roÊlin spo˝ywczych; (
  38. xi)„Food” or „food aid” includes, as appropriate, a reference to seed for food crops;
  39. xi)les termes „produits alimentaires” ou „aide alimentaire” incluent, le cas échéant, les semences de cultures vivri¯res; (xii) „cz∏onek” oznacza stron´ niniejszej konwencji; (xii) „Member” means a party to this Convention; xii) le terme „membre” désigne une partie ∫ la présente Convention; Dziennik Ustaw Nr 118 — 7981 — Poz. 813 (xiii) „sk∏adniki mikrood˝ywcze” oznaczajà witaminy i minera∏y wykorzystywane do wzbogacenia lub uzupe∏nienia produktów pomocy ˝ywnoÊciowej, zaliczanych, na podstawie artyku∏u IV ust´p (c), do wk∏adu danego cz∏onka; (xiii) „Micronutrients” means vitamins and minerals used to fortify or complement food aid products which are eligible, under Article IV (c), to be counted as a member’s contribution; xiii) le terme „micronutriments” signifie les vitamines et minéraux utilisés pour fortifier ou compléter les produits d’aide alimentaire qui peuvent, aux termes du paragraphe
  40. c)de l’article IV, ˘tre pris en compte comme contribution d’un membre; (xiv) „OECD” oznacza Organizacj´ Wspó∏pracy Gospodarczej i Rozwoju; (xiv) „OECD” means the Organisation for Economic Co-operation and Development; xiv) le sigle „OCDE” désigne l’Organisation de coopération et de développement économiques; (
  41. xv)„produkty przetwarzania wst´pnego” obejmujà: (
  42. xv)„Products of primary processing” include:
  43. xv)les „produits de premi¯re transformation” incluent: • màki zbo˝owe; • cereal flours; • les farines de céréales; • kasze i màczki zbo˝owe; • cereal groats and cereal meal; • les gruaux et les semoules; • ziarna zbó˝ poddane innej obróbce (np. toczone, p∏atkowane, polerowane, pere∏kowane i Êrutowane, ale dalej nieprzetworzone) z wyjàtkiem ry˝u ∏uskanego, glazurowanego, polerowanego lub ∏amanego; • other worked cereal grains (e.g. rolled, flaked, polished, pearled and kibbled, but not further prepared) except husked, glazed, polished or broken rice; • les grains mondés, perlés, concassés, aplatis (y compris les flocons) ∫ l’exception du riz pelé, glacé, poli ou en brisures; • zarodki zbó˝, ca∏e, mia˝d˝one, p∏atkowane lub mielone; • germ of cereals, whole, rolled, flaked or ground; • les germes de céréales, m˘me en farine; • kasz´ z ziarna pszennego oraz • bulgur; and • le bulgur; et • inne podobne produkty zbo˝owe wybrane przez Komitet; • any other similar grain product which the Committee may decide; • tout autre produit similaire que le Comité pourra décider; (xvi) „produkty przetwarzania wtórnego” obejmujà: (xvi) „Products of secondary processing” include: xvi) les „produits de deuxi¯me transformation” comprennent: • makarony, spaghetti i produkty podobne oraz • macaroni, spaghetti and similar products; and • le macaroni, le spaghetti et les produits analogues; et • inne produkty, których produkcja wymaga wykorzystania produktu przetwarzania pierwotnego, wybrane przez Komitet; • any other product, whose manufacture involves the use of a product of primary processing, which the Committee may decide; • tout autre produit, dont la fabrication demande l’utilisation d’un produit de premi¯re transformation, que le Comité pourra décider; (xvii) „ry˝” obejmuje ry˝ ∏uskany, glazurowany, polerowany lub ∏amany; (xvii) „Rice” includes husked, glazed, polished or broken rice; xvii) le „riz” comprend le riz pelé, glacé, poli ou en brisures; Dziennik Ustaw Nr 118 — 7982 — Poz. 813 (xviii) „Sekretariat” oznacza Sekretariat Mi´dzynarodowej Rady Zbo˝owej; (xviii) „Secretariat” means the Secretariat of the International Grains Council; xviii) le „Secrétariat” désigne le secrétariat du Conseil international des céréales; (xix) „tona” oznacza ton´ metrycznà równà 1 000 kilogramów; (xix) „Tonne” means a metric ton of 1,000 kilograms; xix) le terme „tonne” signifie une tonne métrique de 1 000 kilogrammes; (
  44. xx)„koszty transportu i inne koszty operacyjne”, zgodnie z za∏àcznikiem A, oznaczajà koszty poniesione po etapie FOB lub w przypadku zakupów lokalnych, poniesione po zakupie, zwiàzane z dzia∏aniami na rzecz pomocy ˝ywnoÊciowej, które mo˝na zaliczyç w ca∏oÊci lub w cz´Êci do wk∏adu danego cz∏onka; (
  45. xx)„Transport and other operational costs”, as listed in Annex A, mean costs beyond the f.o.b. stage or, in the case of local purchases, beyond the point of purchase, associated with a food aid operation, which may be counted in whole or in part towards a member’s contribution;
  46. xx)les „coûts de transport et autres coûts opérationnels” qui sont énumérés ∫ l’Annexe A signifient un coût associé ∫ une opération d’aide alimentaire et encouru au-del∫ de la position f.o.b. ou, dans le cas d’achats locaux, au-del∫ du lieu d’achat, susceptible d’˘tre pris en compte en tout ou partie dans la contribution d’un membre; (xxi) „wartoÊç” oznacza zobowiàzanie cz∏onka wyra˝one w walucie wymienialnej; (xxi) „Value” means the commitment of a member in a convertible currency; xxi) le terme „valeur” signifie l’engagement d’un membre dans une monnaie convertible; (xxii) „ekwiwalent pszenicy” oznacza wielkoÊç zobowiàzania lub wk∏adu danego cz∏onka oszacowanà zgodnie z artyku∏em V; (xxii) „Wheat equivalent” means the amount of a member’s commitment or contribution as evaluated in accordance with Article V; xxii) l’expression „équivalent blé” désigne le montant de l’engagement ou de la contribution d’un membre, telle qu’évaluée selon l’article V; (xxiii) „WTO” oznacza Âwiatowà Organizacj´ Handlu; (xxiii) „WTO” means the World Trade Organization; xxiii) le sigle „OMC” désigne l’Organisation mondiale du commerce; (xxiv) „rok” oznacza okres od dnia 1 lipca do dnia 30 czerwca nast´pnego roku, o ile nie zaznaczono inaczej. (xxiv) „Year” means the period from 1 July to the following 30 June, unless otherwise stated. xxiv) le terme „année” désigne, sauf indication contraire, la période du 1er juillet au 30 juin. (
  47. b)Ka˝de odniesienie w niniejszej konwencji do „rzàdu” lub „rzàdów” albo „cz∏onka” jest rozumiane jako zawierajàce odniesienie do Wspólnoty Europejskiej (zwanej dalej „WE”). Odpowiednio, ka˝de odniesienie w niniejszej konwencji do „podpisu” lub „z∏o˝enia dokumentów ratyfikacji, przyj´cia lub zatwierdzenia” lub „dokumentu przystàpienia” albo „deklaracji tymczasowego stosowania” przez rzàd, w przypadku WE jest rozumiane jako obejmujàce podpisanie lub deklaracj´ tymczasowego stosowania w imieniu WE przez jej w∏aÊci- (
  48. b)Any reference in this Convention to a „Government” or „Governments” or „member” shall be construed as including a reference to the European Community (hereinafter referred to as the EC). Accordingly, any reference in this Convention to „signature” or to the „deposit of instruments of ratification, acceptance, or approval” or „an instrument of accession” or „a declaration of provisional application” by a Government shall, in the case of the EC, be construed as including signature or declaration of provisional application on behalf of the EC
  49. b)Toute mention dans la présente Convention d’un „gouvernement” ou de „gouvernements” ou d’un „membre” est réputée valoir aussi pour la Communauté européenne (dénommée ci-apr¯s la CE).   18. i)The commitment of an acceding member referred to in paragraph (
  19. h)ot this Article shall not be less than 20,000 tonnes or an appropriate value as the Committee may approve. This will normally apply in full starting in the first year during which the country is deemed by the Committee to have acceded to the Convention. However, to facilitate the accession of Governments other than those referred to in paragraph (
  20. e)of this Article, the Committee may agree that an acceding member’s commitment should be phased in over a period of not more than three years, provided that the commitment is at least 10,000 tonnes or an appropriate value in the first year, and increases by at least 5,000 tonnes a year or an appropriate value in each succeeding year.

  81. c)For the purposes of fulfilment of their commitments, members may provide micro-nutrients in conjunction with eligible products. They are encouraged to provide, when appropriate, fortified food aid products, particularly in emergency situations and targeted development projects.

  196. b)In planning food aid operations, due account shall be taken of potential difficulties which may affect transport, processing or storage of food aid, and the effects that the delivery of the aid may have on marketing of local harvests in the recipient country.

  253. d)When food aid is sold within a recipient country, the sale shall be carried out, as far as possible, through the private sector and be based on market analysis. In targeting proceeds from such sales, priority shall be given to projects aiming to improve the food security of beneficiaries.

  349. a)The Committee shall meet at least twice a year in conjunction with the statutory sessions of the International Grains Council.   402. c)Any Government acceding to this Convention under paragraph (
  403. a)of this Article, or whose accession has been agreed by the Committee under paragraph (
  404. b)of this Article, may deposit with the depositary a declaration of provisional application of this Convention pending the deposit of its instrument of accession. Any such Government shall provisionally apply this Convention in accordance with its laws and regulations and be provisionally regarded as a party thereto.
