Dziennik Ustaw Nr 114 — 6015 — Poz. 727 727 ROZPORZÑDZENIE MINISTRA FINANSÓW1) z dnia 30 czerwca 2008 r. zmieniajàce rozporzàdzenie w sprawie struktury logicznej deklaracji i podaƒ, sposobu ich przesy∏ania oraz rodzajów podpisu elektronicznego, którymi powinny byç opatrzone Na podstawie art. 3b § 2 ustawy z dnia 29 sierpnia 1997 r. — Ordynacja podatkowa (Dz. U. z 2005 r. Nr 8, poz. 60, z póên. zm.2)) zarzàdza si´, co nast´puje: §

1. W rozporzàdzeniu Ministra Finansów z dnia 24 grudnia 2007 r. w sprawie struktury logicznej deklaracji i podaƒ, sposobu ich przesy∏ania oraz rodzajów podpisu elektronicznego, którymi powinny byç opatrzone (Dz. U. Nr 246, poz. 1820 oraz z 2008 r. Nr 55, poz. 336) wprowadza si´ nast´pujàce zmiany: 1) w § 7 dodaje si´ pkt 45—60 w brzmieniu: „45) zawiadomienia naczelnika urz´du skarbowego o wyborze miejsca opodatkowania/o rezygnacji z wyboru miejsca opodatkowania w przypadku sprzeda˝y wysy∏kowej z terytorium kraju (VAT-21) — okreÊla za∏àcznik nr 48 do rozporzàdzenia; 46) informacji o wysokoÊci wycofanego wk∏adu budowlanego lub mieszkaniowego wniesionego do spó∏dzielni mieszkaniowej/wysokoÊci wycofanych lub przeniesionych na rzecz osób trzecich oszcz´dnoÊci z kasy mieszkaniowej (PIT-14) — okreÊla za∏àcznik nr 49 do rozporzàdzenia; 47) deklaracji o osiàgni´tych przychodach z odp∏atnego zbycia nieruchomoÊci lub praw majàtkowych, obj´tych zrycza∏towanym podatkiem dochodowym (PIT-23) — okreÊla za∏àcznik nr 50 do rozporzàdzenia; 48) informacji o dochodach oraz o pobranych zaliczkach na podatek dochodowy (PIT-11) — okreÊla za∏àcznik nr 51 do rozporzàdzenia; 49) deklaracji do wymiaru zaliczek podatku dochodowego od dochodów z dzia∏ów specjalnych produkcji rolnej za rok podatkowy (PIT-6/PIT-6L) — okreÊla za∏àcznik nr 52 do rozporzàdzenia; 50) informacji o wysokoÊci wyp∏aconego stypendium (PIT-8S) — okreÊla za∏àcznik nr 53 do rozporzàdzenia; 51) deklaracji w sprawie podatku od czynnoÊci cywilnoprawnych (PCC-3) — okreÊla za∏àcznik nr 54 do rozporzàdzenia; ——————— 1) Minister Finansów kieruje dzia∏em administracji rzàdowej — finanse publiczne, na podstawie § 1 ust. 2 pkt 2 rozporzàdzenia Prezesa Rady Ministrów z dnia 16 listopada 2007 r. w sprawie szczegó∏owego zakresu dzia∏ania Ministra Finansów (Dz. U. Nr 216, poz. 1592). 2) Zmiany tekstu jednolitego wymienionej ustawy zosta∏y og∏oszone w Dz. U. z 2005 r. Nr 85, poz. 727, Nr 86, poz. 732 i Nr 143, poz. 1199, z 2006 r. Nr 66, poz. 470, Nr 104, poz. 708, Nr 143, poz. 1031, Nr 217, poz. 1590 i Nr 225, poz. 1635 oraz z 2007 r. Nr 112, poz. 769, Nr 120, poz. 818, Nr 192, poz. 1378 i Nr 225, poz.
2. 52) deklaracji o wysokoÊci pobranego i wp∏aconego podatku przez p∏atnika (PCC-2) — okreÊla za∏àcznik nr 55 do rozporzàdzenia; 53) deklaracji o wysokoÊci pobranego i wp∏aconego przez p∏atnika podatku (SD-2) — okreÊla za∏àcznik nr 56 do rozporzàdzenia; 54) zg∏oszenia o nabyciu w∏asnoÊci rzeczy lub praw majàtkowych (SD-Z2) — okreÊla za∏àcznik nr 57 do rozporzàdzenia; 55) zeznania podatkowego o nabyciu rzeczy lub praw majàtkowych (SD-3) — okreÊla za∏àcznik nr 58 do rozporzàdzenia; 56) deklaracji dla podatku od gier (POG-3C) — okreÊla za∏àcznik nr 59 do rozporzàdzenia; 57) deklaracji dla podatku od gier (POG-3D) — okreÊla za∏àcznik nr 60 do rozporzàdzenia; 58) deklaracji dla podatku od gier (rycza∏t) (POG-R) — okreÊla za∏àcznik nr 61 do rozporzàdzenia; 59) informacji o wyp∏aconych podatnikowi kwotach z tytu∏u pe∏nienia obowiàzków spo∏ecznych i obywatelskich (PIT-R) — okreÊla za∏àcznik nr 62 do rozporzàdzenia; 60) zg∏oszenia aktualizacyjnego osoby fizycznej nieprowadzàcej samodzielnie dzia∏alnoÊci gospodarczej (NIP-3) — okreÊla za∏àcznik nr 63 do rozporzàdzenia.”; 2) za∏àcznik nr 1 do rozporzàdzenia otrzymuje brzmienie okreÊlone w za∏àczniku nr 1 do niniejszego rozporzàdzenia; 3) za∏àcznik nr 31 do rozporzàdzenia otrzymuje brzmienie okreÊlone w za∏àczniku nr 2 do niniejszego rozporzàdzenia; 4) za∏àcznik nr 36 do rozporzàdzenia otrzymuje brzmienie okreÊlone w za∏àczniku nr 3 do niniejszego rozporzàdzenia; 5) dodaje si´ za∏àczniki nr 48—63 do rozporzàdzenia w brzmieniu okreÊlonym w za∏àcznikach nr 4—19 do niniejszego rozporzàdzenia. §
3. Struktur´ logicznà okreÊlonà w za∏àczniku nr 31 do rozporzàdzenia, o którym mowa w § 1, w brzmieniu nadanym niniejszym rozporzàdzeniem, stosuje si´ do zaliczek od dochodów uzyskanych od dnia 1 stycznia 2008 r. §
4. Rozporzàdzenie wchodzi w ˝ycie z dniem 1 lipca 2008 r. Minister Finansów: J.
