8. člen Navedene nepremičnine pridobijo status »grajenega javnega dobra lokalnega pomena« z ugotovitveno odločbo, ki jo po uradni dolžnosti izda občinska uprava.
9. člen Po pravnomočnosti odločbe se le-ta pošlje pristojnemu sodišču v izvršitev vpisa zaznambe grajenega javnega dobra.
