- Senat (Nichtigkeitssenat) des Bundespatentgerichts auf Grund der mündlichen Verhandlung vom
- November 2020 durch die Vorsitzende Richterin Friehe, die Richterin Werner und die Richter Dipl.-Ing. Müller, Dipl.-Ing. Matter sowie Dipl.-Phys. Univ. Dr. Haupt für Recht erkannt: I. Das Europäische Patent 2 135 348 wird mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland für nichtig erklärt. II. Die Kosten des Rechtstreits einschließlich der außergerichtlichen Kosten der Streithelferin hat die Beklagte zu tragen. III. Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages vorläufig vollstreckbar. 1 Die Beklagte ist Inhaberin des mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland erteilten europäischen Patents 2 135 348 (Streitpatent). Das Streitpatent ist in englischer Sprache erteilt und in Kraft. 2 Das beim Deutschen Patent- und Markenamt unter dem Aktenzeichen 60 2007 043 816 geführte Streitpatent trägt die Bezeichnung 3 "Distributed Power Harvesting Systems Using DC Power Sources" 4 (auf Deutsch laut Streitpatentschrift: 5 "Verteilte Leistungswandler-Systeme mit Gleichstrom-Leistungsquellen") 6 und umfasst in der erteilten Fassung neun Patentansprüche, die die Klägerin mit der am
- November 2018 eingereichten Nichtigkeitsklage insgesamt angreift. 7 Die angegriffenen unabhängigen Patentansprüche 1 und 8 lauten in der Verfahrenssprache wie folgt: 8

A method for harvesting power from a distributed power system having a plurality of DC power sources (301,401,301,601,701) and a plurality of DC power converters (305,405,505,605,705), the method comprising: 20 coupling each of the power sources (301,401,301,601,701) to a respective DC power converter (305,405,505,605,705); 21 coupling the power converters (305,405,505,605,705) in series, to thereby form at least one serial string; 22 coupling the serial string to a power delivery device (304,404,504); 23 fixing the input voltage to the power delivery device (304,404,504) to a predetermined value, thereby forcing current flowing through the serial string to vary according to power provided by the power sources (301,401,301,601,701); and controlling power output from each power source (301,401,301,601,701) individually and individually varying the input voltage and current to each respective converter (305,405,505,605,705) according to a predetermined criteria, 24 wherein buck plus boost converters are used each comprising a buck converter, a boost converter, a controller

(606)in Antwort auf den MPPT-Teil und den Strom oder die Spannung aus den Ausgangsanschlüssen (610, 612) entweder den Abwärtswandler oder den Aufwärts-Wandler selektiv aktiviert oder den Abwärtswandler und den Aufwärts-Wandler zusammen aktiviert. 47 Die ebenfalls angegriffenen Patentansprüche 2 bis 7 sind unmittelbar auf Patentanspruch 1 und Patentanspruch 9 auf den Patentanspruch 8 rückbezogen. 48 Die Klägerin ist der Ansicht, das Patent sei für nichtig zu erklären, da die jeweiligen Gegenstände der erteilten Patentansprüche 1 sowie 8 über den Inhalt der Anmeldung hinausgingen. - Dezember 2018 hat sich die Streithelferin auf Seiten der Klägerin dem Rechtsstreit angeschlossen. Die Beklagte hat vor dem Landgericht Ansprüche wegen Patentverletzung gegen sie geltend gemacht. Das rechtliche Interesse an der Nebenintervention ergebe sich aus der gegen sie anhängigen Verletzungsklage. 64 Die Klägerin beantragt, 65 das europäische Patent 2 135 348 mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland in vollem Umfang für nichtig zu erklären. 66 Die Beklagte beantragt, 67 die Klage abzuweisen, 68 hilfsweise die Klage abzuweisen, soweit sie sich auch gegen eine der Fassungen des Streitpatents nach den Hilfsanträgen I bis XXIII nebst Hilfsantrag Ia aus dem Schriftsatz vom

II § 6 Abs. 1 Nr. 1 IntPatÜG i. V. m. Art. 138 Abs. 1 Buchst. a), Art. 52 i. V. m Art. 54 sowie Art. 56 EPÜ). A. 483 I. Zum Gegenstand des Streitpatents 484
- Hintergrund des Streitpatents sind Photovoltaik-Anlagen, auch wenn in den unabhängigen Patentansprüchen allgemein von Gleichstrom-Leistungsquellen die Rede ist. 485 Eine einzelne Photovoltaikzelle hat eine Ausgangsspannung von 0,5 Volt bis 4 Volt. Erst durch die Reihenschaltung vieler solcher Zellen zu Modulen (laut Absatz 0048 der Streitpatentschrift erzeugt jedes Paneel bzw. Modul 32 Volt) und schließlich zu Anlagen kann eine Systemspannung (Abs. 0048: 400 Volt) erreicht werden, die ein Mehrfaches der Modulspannung beträgt. 486 Gemäß Streitpatentschrift ist jeder einzelnen Gleichspannungsquelle ein separater DC/DC Wandler zugeordnet, wobei die Ausgänge der DC/DC-Wandler in Reihe geschaltet werden, so dass sich die resultierende Systemspannung aus der Summe der Ausgangsspannungen der DC/DC-Wandler ergibt. Über einen Wechselrichter wird dann schließlich in ein Wechselspannungsnetz eingespeist (Figur 3 i. V. m. den Absätzen 0036 und 0037). 487 In der Beschreibungseinleitung (Abs. 0003 bis 0011) ist eine ganze Reihe von Schwierigkeiten aufgelistet, die sich beim Betrieb einer PV-Anlage ergeben würden. 488 In der Beschreibungseinleitung ist angegeben, es bestehe Bedarf an Lösungen für eine effektive Topologie zur Verbindung von mehreren Gleichstrom-Leistungsquellen mit der Last, zum Beispiel Stromnetz, Stromspeicheranordnung usw. (Abs. 0016, letzter Satz). 489
- Als für die Lösung der Ausgabe zuständigen Fachmann geht der Senat von einem Diplomingenieur bzw. Master der Fachrichtung Elektrotechnik aus, der über mehrjährige Erfahrung in der Entwicklung von Leistungselektronikschaltungen für Photovoltaikanlagen, insbesondere der dafür erforderlichen Stromrichter verfügt. 490
- Gelöst werde die Aufgabe durch ein dezentrales Energieerzeugungssystem gemäß erteiltem Patentanspruch 1 (Hauptantrag), der wie folgt gegliedert werden kann (Übersetzung gemäß Streitpatentschrift EP 2 135 348 B1): 491

Der Senat legt seiner Entscheidung folgende Überlegungen des Fachmanns zu den Angaben in den Patentansprüchen 1 nach Haupt- und Hilfsanträgen zugrunde: 585
- a)Unter einem "distributed power harvesting system” (Merkmal 1) versteht der Fachmann ein System zur dezentralen Energieerzeugung, wobei Energie physikalisch betrachtet nicht erzeugt, sondern lediglich von einer in eine andere Form umgewandelt wird, was sowohl die deutsche Bezeichnung "Leistungswandler-System" als auch die englische Bezeichnung "harvesting system" mehr oder weniger treffend zum Ausdruckt bringt. 586
- b)Der Patentanspruch 1 ist auf beliebige Gleichspannungsquellen gerichtet (Merkmal 1.1.1), wenngleich die Ausführungsbeispiele ausschließlich auf Photovoltaikanlagen zielen. 587
- c)Mit dem "converter” (Merkmal 1.1.2) sind DC/DC-Wandler gemeint, die eine Gleichspannung in eine Gleichspannung mit anderer Spannungshöhe umwandeln, wobei die Ausgangsspannung höher, niedriger oder gleich der Eingangsspannung sein kann. 588
- d)Der Bezeichnung "power conversion portion” (Merkmal 1.1.2.3) sowie der angegebenen Wirkung, an den Eingangsanschlüssen empfangene Leistung in eine Ausgangsleistung an den Ausgangsanschlüssen umzusetzen, entnimmt der Fachmann nicht mehr, als er schon bei dem Begriff DC/DC-Wandler mitliest. Die Leistung sollte nämlich bis auf die unvermeidbaren Verluste konstant sein. Wird die Spannung verändert, ändert sich zwangsläufig auch der Strom, derart, dass die Leistung konstant bleibt. 589
- e)Unter dem an die Reihenschaltung der DC/DC-Wandler gekoppelten "power delivery device” (Merkmal 1.1.3) versteht der Fachmann unter Berücksichtigung der Beschreibung und der Zeichnungen einen DC/AC-Wandler, der die Verbindung zu dem die erzeugte Energie aufnehmenden Wechselspannungsnetz herstellt. 590
- f)Durch Merkmal 1.2 werden die DC/DC-Wandler als "buck plus boost converter" konkretisiert. Da diese Wortzusammenstellung dem Fachmann nicht bekannt ist, misst er dem keine andere inhaltliche Bedeutung bei, als dem ihm bekannten "buck-boost converter", im Deutschen "kaskadierter Ab-/ Aufwärtswandler". In der Beschreibung der Figur 6 (Absatz 0068) wird damit übereinstimmend ausgeführt, dass der buck plus boost converter in der Literatur auch als "cascaded buck-boost converter" bezeichnet werde, also entsprechend der deutschen Nomenklatur. 591
- g)Die Abkürzung "MPPT” (Merkmal 1.4) von "maximum power point tracking” steht für eine fachübliche Art, Solarmodule zu steuern. In den Absätzen 0008 und 0009 wird diese Funktionalität kurz beschrieben bzw. auf entsprechende Literatur verwiesen; der dazugehörige Algorithmus sowie die dazugehörige Hardware werden auch im Streitpatent als bekannt vorausgesetzt (Abs. 0085 i. V. m. Figur 7). 592 Die weiteren Angaben im Merkmal 1.4, wonach in Antwort auf den MPPT-Teil (gemeint ist die Eingangsspannung am DC/DC-Wandler) und den Strom oder die Spannung an den Ausgangsanschlüssen der Controller
(606)entweder den Abwärtswandler oder den Aufwärtswandler selektiv aktiviert oder den Abwärtswandler und den Aufwärtswandler zusammen aktiviert, ist bei einem buck-boost converter eine Selbstverständlichkeit. 593 Wenn Eingangs- und Ausgangsspannung in etwa gleich groß sind, arbeitet der DC/DC-Wandler de facto im Leerlauf, wobei theoretisch sowohl Abwärtswandler als auch Aufwärtswandler aktiviert sind. 594
- h)Da dem Fachmann gegenwärtig ist, dass Ausgangsstrom und –spannung der PV-Module, die zugleich Eingangsstrom und –spannung der DC/DC-Wandler sind, durch die jeweiligen MPPTs eingestellt werden, derart, dass das Produkt aus Strom und Spannung stets maximal ist, liest er die Angabe in Merkmal 1.3, wonach Spannung und den Strom an den Eingangsanschlüssen der DC/DC-Wandler durch eine Regelschleife, die Teil des DC/DC-Wandlers ist, dahingehend, dass die MPPT-Funktionalität im DC/DC-Wandler implementiert ist. 595
- i)Gemäß Merkmal 1.5 soll die Eingangsspannung der Leistungsabgabeeinrichtung (power delivery device), d. h. des DC/AC-Wandlers, der die Einspeisung in ein Wechselspannungsnetz ermöglicht, durch einen Regler auf einem vorgegebenen Wert gehalten werden. Darüber hinaus ist dem Fachmann bewusst, dass das System zusätzlich so geregelt werden muss, dass es Energie ins Netz, welches eine konstante Wechselspannung aufweist, einspeisen kann. Daher erwartet der Fachmann, dass auch die Ausgangsspannung auf einem durch das Netz vorgegebenen Wert gehalten wird. 596 Der dafür notwendige Regelkreis 320, 420 (Fig. 3, 4A, 4B, 4C) ist nur schematisch dargestellt und daher ebenfalls dem Wissen und Können des Fachmanns zuzurechnen. 597
- j)Da gemäß Merkmal 1.5 die Spannung auf dem DC-Bus, also am Eingang des DC/AC-Wandlers, auf einen konstanten Wert geregelt wird und sich zugleich die Leistung, die über den Bus übertragen wird, durch die Summe der von den einzelnen MPPTs eingestellten Leistungen ergibt, fließt in der ausgangsseitigen Reihenschaltung der DC/DC-Wandler ein quasi-eingeprägter Strom. 598 Die Eingangsleistung der DC/DC-Wandler ist, wie ausgeführt, durch die aktuelle Sonneneinstrahlung gegeben und damit auch deren Ausgangsleistung. Somit ergeben sich die jeweiligen Ausgangsspannungen der einzelnen DC/DC-Wandler aus der Beziehung , wobei wiederum selbstverständlich die Summe der Ausgangsspannungen der in Reihe geschalteten DC/DC-Wandler gleich der Eingangsspannung des DC/AC-Wandlers ist. Damit wechselwirken bei dem beanspruchten System eine Vielzahl von Regelkreisen, nämlich einer je Kombination DC-Quelle mit DC/DC-Wandler und derjenige des DC/AC-Wandlers. 599 II. Zum geltend gemachten Nichtigkeitsgrund der unzulässigen Erweiterung 600 1. Der Einwand der Klägerin, die Patentansprüche 1 sowie 8 seien gegenüber der ursprünglichen Anmeldung in unzulässiger Weise erweitert, greift nicht. Dies gilt auch soweit sie behauptet, dass im ursprünglichen Patentanspruch 7 beansprucht worden sei, dass die Steuerung unabhängig voneinander (selectively) entweder den Abwärtswandler oder den Aufwärtswandler aktiviert. 601 Dagegen umfasse das Merkmal 1.4 des erteilten Patentanspruchs 1 zusätzlich die Variante, dass Abwärtswandler und Aufwärtswandler zugleich aktiviert seien. 602 Es ist zwar zutreffend, dass auf die von der Klägerin als unzulässige Erweiterung angegriffene Variante ursprünglich kein Patentanspruch gerichtet war, jedoch ist in der Beschreibung der ursprünglichen Anmeldung WO 2008/132553 A2 (Absatz 0078, letzter Satz) angegeben, dass Ab- und Aufwärtswandler in Betrieb sind, wenn die Ausgangsspannung nahezu gleich der Eingangsspannung des Wandlers ist. Noch allgemeiner steht in Absatz 0079: "In some circumstances both the buck and boost portions may operate together.” 603 Da den ursprünglichen Patentansprüchen keine einschränkende Wirkung zukommt, konnte die Patentinhaberin später auf die Beschreibung zurückgreifen und die lediglich dort erwähnte Variante in die Patentansprüche aufnehmen. 604 Das Weglassen der Bedingung, dass die Ausgangsspannung nahezu gleich der Eingangsspannung sein muss, stellt zudem keine unzulässige Zwischenverallgemeinerung dar, da beide Schaltungsteile nur unter dieser Bedingung gleichzeitig arbeiten können. Zur Überzeugung des Senats ist diese Streichung unschädlich, auch wenn die unabhängigen Patentansprüche dadurch Varianten umfassen, die technisch nicht sinnvoll sind. Im Gegenteil wäre es eine unnötige Überfrachtung der Patentansprüche, wenn darin überflüssige Angaben genannt würden, die der Fachmann stillschweigend voraussetzt. 605 2. Auch soweit die Klägerin gegenüber den Hilfsanträgen I, Ia, sowie II geltend macht, diese seien unzulässig, da die geänderten Fassungen in den ursprünglichen Unterlagen nicht offenbart seien, führt dies nicht zum Erfolg. 606 2.1 Der Senat folgt nicht dem Vortrag der Klägerin, im Hilfsantrag I werde das Merkmal 8.1.4Hi I in unzulässiger Weise dahingehend eingeschränkt, dass das Fixieren der Eingangsspannung der Leistungsabgabeeinrichtung durch diese selbst erfolge, während Abs. 0027 sowie Anspruch 30 der PCT-Veröffentlichung WO 2008/132553 A2 der ursprünglichen Unterlagen dieses Merkmal nur im Zusammenhang mit einer Solarenergieinstallation sowie einem Kontrollteil offenbarten. 607 Nach Erkenntnis des Senats stellt das Weglassen der Solarenergieinstallation sowie des Kontrollteils keine unzulässige Zwischenverallgemeinerung dar, da der Fachmann erkennt, dass es nicht darauf ankommt, welche Gleichspannungsquelle vorhanden ist. Einen Kontrollteil, also eine Steuerung, liest der Fachmann im Zusammenhang mit einem Gleichstrom-Leistungswandler ohnehin mit, sodass es dessen Erwähnung nicht bedarf. 608 2.2 Auch die Annahme der Klägerin, die weitere Einschränkung des Patentanspruchs 8 durch das Merkmal 8.1.4Hi Ia gemäß Hilfsantrag la, wonach das Fixieren der Eingangsspannung durch einen Kontrollteil der Leistungsabgabeeinrichtung erfolge, sei unzulässig, ist unbegründet. 609 Dieses Merkmal ist zwar nur für die Leistungsabgabeeinrichtungen gemäß Fig. 3, Fig. 4A bis Fig. 4C offenbart. Zur Überzeugung des Senats reicht es jedoch, wenn nur ein Teil der Ausführungsbeispiele ein bestimmtes Merkmal zeigen. 610 2.3 Auch der Auffassung, der ursprüngliche Wortlaut sei durch den Hilfsantrag II dadurch unzulässig geändert worden, dass,,series connected portion of the circuit" durch,,serial string" ersetzt wurde, vermag sich der Senat nicht anzuschließen. 611 Bei dieser Ersetzung bzw. Gleichsetzung handelt es sich lediglich um eine sprachliche Änderung gegenüber der ursprünglichen Fassung, die laut Rechtsprechung des X. Senats des BGH in der Regel unbeachtlich ist. Zudem wird der Begriff "serial string" in der ursprünglichen Anmeldung mehrfach im Zusammenhang mit der Reihenschaltung der DC/DC-Wandler verwendet (Abs. 0025, 0026, 0027, 0031, 0062, ursprüngliche Ansprüche 1, 10, 21, 23, 25, 26, 30, 32, 33, 35). 612 3. Gegenüber dem Hilfsantrag III weist die Klägerin zwar zurecht darauf hin, dass die beanspruchten Bypass-Schalter gemäß den Figuren 9 und 10 nicht in den DC/DC-Wandlern angeordnet sind, sondern in den PV-Paneelen. Jedoch zeigt die Figur 11 eine Anordnung der Bypass-Schalter in einer sogenannten "junction box", die auch die typischen Schaltungselemente des DC/DC-Wandlers aufnimmt. Jedenfalls aus der Figur 11 entnimmt der Fachmann daher eine Anordnung der Bypass-Schalter in den DC/DC-Wandlern. 613 Zudem geht die gegenüber der erteilten Fassung in die unabhängigen Patentansprüche gemäß Hilfsantrag III zusätzlich aufgenommene Formulierung auf den erteilten Patentanspruch 7 (zugleich ursprünglicher Patentanspruch 17) zurück. Wären die Zulässigkeitsbedenken hinsichtlich der mit dem Hilfsantrag III gegenüber der erteilten Fassung vorgenommenen Änderungen berechtigt, wären diese ohnehin unbeachtlich, da sie bereits in den erteilten Ansprüchen vorlagen (BGH Urteil vom 27. Oktober 2015 - X ZR 11/13 "Fugenband"). 614 III. Zum geltend gemachten Nichtigkeitsgrund der fehlenden Patentfähigkeit 615 Das Patent ist für nichtig zu erklären, da es in den verteidigten Fassungen nach dem Hauptantrag und nach allen Hilfsanträgen gegenüber dem Stand der Technik gemäß der Druckschrift NK1 (Walker, G. R.; Sernia, P. C.: "Cascaded DC-DC Converter Connection of Photovoltaic Modules”) in Verbindung mit dem Fachwissen des Fachmanns nicht auf einer erfinderischen Tätigkeit beruht (Art. II § 6 Abs. 1 Nr. 1 IntPatÜG i. V. m. Art. 138 Abs. 1 Buchst. a), Art. 52, 56 EPÜ): 616 1. Hauptantrag 617 Der Gegenstand des erteilten Patentanspruchs 1 ergibt sich für den Fachmann in naheliegender Weise aus der Druckschrift NK1: 618 Aus der Druckschrift NK1 ist hinsichtlich des Gegenstandes des erteilten Patentanspruchs 1 (Hauptantrag) zumindest folgendes bekannt. 619 1.
