. Von den Kosten des Rechtsstreits trägt die Beklagte 1/4 der Gerichtskosten sowie die außergerichtlichen Kosten der Klägerin zu 3. Die Klägerinnen zu 1, 2 und 4 tragen jeweils 1/4 der Gerichtskosten.
I. Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrages vorläufig vollstreckbar. 1 Die Beklagte ist Inhaberin des die Prioritäten US 615377 P vom
- Oktober 2004 und US 706360 P vom
- August 2005 beanspruchenden europäischen Patents 1 797 659, dessen Patentschrift als EP 1 797 659 B1 (Streitpatent) am
- Februar 2015 in der Verfahrenssprache Englisch veröffentlicht wurde. Das Patent wird vom Deutschen Patent- und Markenamt unter der Nummer 60 2005 045 846.8 geführt. Die dem Streitpatent zugrundeliegende internationale Anmeldung wurde am
- April 2006 mit der WO 2006/038078 A2 offengelegt. 2 Das Streitpatent umfasst 33 Patentansprüche mit den drei unabhängigen Ansprüchen 1, 12 und 23, die auf ein Verfahren, ein Computerprogrammprodukt, sowie eine Mobilstation gerichtet sind. 3 Die Klägerin zu 1 hat mit Schriftsatz vom
- Oktober 2020, die Klägerin zu 2 hat mit Schriftsatz vom
- April 2021 und die Klägerin zu 4 hat mit Schriftsatz vom
- April 2021 ihre Nichtigkeitsklage zurückgenommen. 4 Die Klägerin zu 3 begehrt die Nichtigerklärung des deutschen Teils des Streitpatents in vollem Umfang. Die Beklagte verteidigt ihr Patent in der Fassung des Hauptantrags sowie beschränkt in den Fassungen der Hilfsanträge A.I.1, A.I.1‘, A.I.2, A.I.2‘, A.I.3, A.I.3‘, A.I.4, A.I.4‘, A.

- Verfahren, das durch eine Mobilstation für eine autonome erweiterte Aufwärtsstreckenübertragung, bei der eine Ablaufplanungsgewährung von einem Netzwerk nicht benötigt wird, durchgeführt wird, mit einem Bestimmen eines virtuellen Übertragungszeitintervalls für eine Medienzugriffssteuereinheit, wobei das virtuelle Übertragungszeitintervall ein Minimalzeitintervall festlegt, das zwischen erweiterten Aufwärtsstreckenübertragungen erlaubt ist, 12 einem Überprüfen, um zu bestimmen, ob die Medienzugriffssteuereinheit Datenpakete in einem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, und 13 für den Fall, in dem bestimmt ist, dass die Medienzugriffssteuereinheit nicht in dem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, mit einem Übertragen eines nächsten Datenpakets erst nachdem eine durch das virtuelle Übertragungszeitintervall bestimmte Periode als verstrichen bestimmt ist. 14 Der erteilte Patentanspruch 12 lautet gemäß EP 1 797 659 B1 in der Verfahrenssprache Englisch: 15

- Computerprogrammprodukt, das auf einem Computer lesbaren Medium ausgebildet ist und durch einen Prozessor ausführbar ist, um Aktionen durch eine Mobilstation für eine autonome erweiterte Aufwärtsstreckenübertragung, bei der eine Ablaufplanungsgewährung von einem Netzwerk nicht benötigt wird, durchzuführen, wobei die Aktionen umfassen ein Bestimmen eines virtuellen Übertragungszeitintervalls für eine Medienzugriffssteuereinheit, wobei das virtuelle Übertragungszeitintervall unabhängig von einem Luftschnittstellenübertragungszeitintervall ist und ein Minimalzeitintervall festlegt, das zwischen erweiterten Aufwärtsstreckenübertragungen erlaubt ist, 21 ein Überprüfen, um zu bestimmen, ob die Medienzugriffssteuereinheit Datenpakete in einem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, und 22 für den Fall, in dem bestimmt ist, dass die Medienzugriffssteuereinheit nicht in dem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, ein Übertragen eines nächsten Datenpakets erst nachdem eine durch das virtuelle Übertragungszeitintervall bestimmte Periode als verstrichen bestimmt ist. 23 Der erteilte Patentanspruch 23 lautet gemäß EP 1 797 659 B1 in der Verfahrenssprache Englisch: 24
- A mobile station comprising: 25 a memory adapted to store computer program instructions and a virtual transmission time interval that is independent from the air interface transmission time interval and defines a minimum time interval that is allowed between enhanced uplink transmissions; 26 a wireless transceiver; 27 a processor coupled to the memory and to the wireless transceiver, and adapted to: 28 check to determine whether the mobile station is transmitting data packets in a current air interface transmission time interval; and for the case where it is determined that the mobile station is not transmitting in the current air interface transmission time interval, to cause the transmitter to transmit a next data packet only after a period determined by the virtual transmission time interval is determined to have elapsed, wherein the virtual transmission time interval is used for autonomous enhanced uplink transmission in which a scheduling grant from a network is not required. 29 In der Verfahrenssprache Deutsch lautet der erteilte Patentanspruch 23 gemäß EP 1 797 659 B1: 30
- Mobilstation, mit 31 einem Speicher, der dazu eingerichtet ist, um Computerprogrammanweisungen und ein virtuelles Übertragungszeitintervall zu speichern, das unabhängig von einem Luftschnittstellenübertragungszeitintervall ist und ein Minimalzeitintervall festlegt, das zwischen erweiterten Aufwärtsstreckenübertragungen erlaubt ist, 32 einem Drahtlosempfänger, 33 einem Prozessor, der mit dem Speicher und dem Drahtlossendeempfänger gekoppelt ist, und dazu eingerichtet ist, um 34 zu überprüfen, um zu bestimmen, ob die Mobilstation Datenpakete in einem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, und 35 für der Fall, in dem bestimmt ist, dass die Mobilstation nicht in dem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt, um den Sender dazu zu bringen, ein nächste Datenpaket erst nachdem eine durch das virtuelle Übertragungszeitintervall bestimmte Periode als verstrichen bestimmt ist, zu übertragen, wobei das virtuelle Übertragungszeitintervall für eine autonome erweiterte Aufwärtsstreckenübertragung, bei der eine Ablaufplanungsgewährung von einem Netzwerk nicht benötigt wird, verwendet ist. 36 Die Klägerin zu 3 macht sich mit Schriftsatz vom

- Februar 2021 hat die Klägerin zu 3 zudem das Dokument 60 BP1 vorläufige Meinung der Einspruchsabteilung des EPA vom
- Januar 2021 zum Patent EP 3 300 421 61 zur Stützung ihres Vorbringens in das Verfahren eingeführt. 62 Die Klage der Klägerin zu 3 wird gestützt auf den Nichtigkeitsgrund der fehlenden Patentfähigkeit, und zwar mangelnde Neuheit (Art. 54 EPÜ) und mangelnde erfinderische Tätigkeit (Art. 56 EPÜ), der mangelnden Ausführbarkeit gemäß Art. 138 Abs. 1 lit. b) EPÜ, Art. || § 6 Abs. 1 Satz 1 Nr. 2 IntPatÜG sowie der unzulässigen Erweiterung gemäß Art. 138 Abs. 1 lit. c) EPÜ, Art. Il § 6 Abs. 1 Satz 1 Nr. 3 IntPatÜG. Die Inanspruchnahmen der Prioritäten – so behauptet die Klägerin zu 3 – seien ungültig, weil in der PCT-Anmeldung diverse Merkmale enthalten seien, die den Prioritätsdokumenten nicht entnehmbar seien. Die Berechtigung der Patentanmelderin zur Inanspruchnahme der Priorität werde bestritten. Weder bestehe Anmelderidentität zwischen den Prioritätsdokumenten noch zwischen den Prioritätsdokumenten und der Anmeldung. Die Hilfsanträge seien wegen unzulässiger Erweiterung nicht zulässig, die Gegenstände der Hilfsanträge seien nicht patentfähig. 63 Die Klägerin zu 3 stellt den Antrag, 64 das europäische Patent EP 1 797 659 B1 mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland für nichtig zu erklären. 65 Die Beklagte beantragt sinngemäß, 66 die Klage abzuweisen, 67 hilfsweise 68 das europäische Patent dadurch teilweise für nichtig zu erklären, dass seine Patentansprüche die Fassung eines der Hilfsanträge 69

Mai 2021 94 in dieser Reihenfolge, erhalten. 95 Die Beklagte erklärt, 96 dass in allen ´-Hilfsanträgen im Anspruch 1 im Merkmal 1.2.1 der Begriff „new“ wie folgt hinzugefügt wird: 97 „which virtual transmission time interval defines a minimum time interval that is allowed between enhanced uplink transmissions.” 98 sowie 99 dass in allen ´-Hilfsanträgen im Anspruch 23 im Merkmal 23.4.2.1 der Begriff „new“ wie folgt zu ergänzen sei: 100 „the transmitter to transmit a next data packet.” 101 Die Beklagte erklärt, dass sie die Anspruchssätze gemäß Hauptantrag und Hilfsanträgen als jeweils geschlossene Anspruchssätze ansieht, die jeweils insgesamt beansprucht werden. 102 Die Beklagte tritt der Argumentation der Klägerin zu 3 in allen wesentlichen Punkten entgegen. Sie vertritt die Auffassung, dass die von der Klägerin zu 3 vorgebrachten Druckschriften die im Streitpatent offenbarte Erfindung weder neuheitsschädlich vorwegnähmen noch sie nahelegten. I‘ der Nichtigkeitsgrund der unzulässigen Erweiterung des Schutzbereichs entgegen. 290 Weil der Gegenstand des Streitpatents hinsichtlich des Hauptantrags und der Hilfsanträge über den Inhalt der Anmeldung in der ursprünglich eingereichten Fassung hinausgeht bzw. der Schutzbereich des Streitpatents erweitert worden ist und das Streitpatent deshalb mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland für nichtig zu erklären war, kann die Frage, ob die Inanspruchnahmen der Prioritäten US 615377 P vom 1. Oktober 2004 und US 706360 P vom 8. August 2005 ungültig sind, dahingestellt bleiben. I. 291 1. Das Streitpatent bezieht sich auf die Standards des 3GPP für Funkzugangsnetzwerke (RAN), Hochgeschwindigkeits-Uplink-Paketzugang (HSUPA) und Hochgeschwindigkeits-Downlink-Paketzugang (HSDPA), 3GPP-Kernnetzwerk- und Sprachcodecs und insbesondere auf ein System und Verfahren für eine langsame Medienzugriffssteuereinheit (MAC-
- e)zur autonomen Übertragung während HSUPA und für die dienstspezifische Übertragungszeitsteuerung in HSUPA (vgl. Abs. [0001] der Streitpatentschrift). 292 Gemäß dem 3GPP-Standard TS 25.309 "Frequency Division Duplex (FDD) Enhanced Uplink; Overall description; Stage 2 TS" ist ein gewisses Maß an E-DCH(enhanced-dedicated channel)-Mindestsatz-Unterstützung erforderlich, um eine Abwärtssystemkompatibilität zu gewährleisten. Mit einem Mindestsatz kann eine autonome Übertragung von Datenpaketen in einem Uplink-Signal ohne vorherige Zuweisung von Ressourcen durch einen Planer (Scheduler) der Basisstation (Knoten B) erfolgen. Für jedes Teilnehmergerät (UE) definiert der Mindestsatz einen Satz von Transportformaten (TFs), für die keine gültige „Ablaufplanungsgewährung“ (scheduling grant) erforderlich ist, damit Pakete übertragen werden können. Im Gegensatz dazu weist unter normalen Bedingungen der Knoten B dem UE einen Anteil einer Uplink-Ressource über eine „Ablaufplanungsgewährung“ (scheduling grant) zu. Erst nach dieser Zuweisung von Ressourcen kann das UE Pakete im Uplink-Signal übertragen. Der definierte Mindestsatz garantiert immer eine Mindestbitrate, die typischerweise für Signalisierungszwecke verwendet wird (vgl. Abs. [0002]). 293 Die Möglichkeit für nicht-geplante (non-scheduled) UEs, einen Satz von Transportformaten (TFs) autonom zu übertragen, hat Auswirkungen auf die Verarbeitungsressourcen des Knoten B, da die Knoten B jederzeit bereit sein müssen, Übertragungen von solchen UEs zu verarbeiten, und dies unabhängig von der Zahl der UEs, die tatsächlich eine autonome Übertragung durchführen. Infolgedessen wird die Fähigkeit der Knoten B, die verfügbaren Verarbeitungsressourcen über die Planung zu optimieren, eingeschränkt. Die Möglichkeit der UEs, außerplanmäßige autonome Übertragungen durchzuführen, kann die Reservierung einer "Rise over Thermal" (RoT)-Marge für diese UEs erfordern. Bei einer großen Anzahl von UEs kann die erforderliche RoT-Marge so signifikant werden, dass dadurch die Leistung der geplanten (scheduled) Übertragungen beeinträchtigt wird (vgl. Abs. [0003], [0004]). 294 In der R1-041069 wurde vorgeschlagen, die Szenarien in denen der Mindestsatz verwendbar ist, beispielsweise auf solche, in denen kein dedizierter physischer Datenkanal (DPDCH) vorhanden ist, zu beschränken. In der R1-041087 (NK6) wurde vorgeschlagen, dass autonome Übertragungen nur in einer Teilmenge von Übertragungszeitintervallen (TTIs) zulässig sind. In der R1-041211 (NK4) wurde vorgeschlagen, die zulässige Anzahl von hybriden automatischen Wiederholungsanforderungen (hybrid automatic repeat request, HARQ) für autonome Übertragungsraten zu erhöhen oder die Anzahl der HARQ-Prozesse, die das UE für autonome Übertragungen verwenden darf, zu beschränken. Jede dieser Lösungen ist jedoch nicht optimal, da sie alle ein hohes Maß an Komplexität erfordern (vgl. Abs. [0005]). 295 Das Konzept der Unterstützung erweiterter dedizierter Kanäle (enhanced dedicated channels, E-DCH) wurde in der 3GPP Version 6 eingeführt. Für eine E-DCH-Übertragung ist eine Gewährung (grant) erforderlich, d. h., für eine geplante (scheduled) Übertragung ist eine Zustellungsgewährung (serving grant) und für nicht-geplante (non-scheduled) MAC-d-Flüsse ist eine nicht-geplante Gewährung (non-scheduled grant) erforderlich. Für die geplanten (scheduled) MAC-d-Datenflüsse steuert der Knoten-B, wann das UE Pakete übertragen darf. Für die nicht-geplanten (non-scheduled) MAC-d-Flüsse ist das Netzwerk berechtigt, eine maximale Anzahl von Bits zu definieren, die in einer MAC-e-PDU für bestimmte MAC-d-Flüsse enthalten sein können. Im Fall eines 2 ms E-DCH-TTI ist jede nicht-geplante Gewährung (non-scheduled grant) für den spezifischen Satz von HARQ-Prozessen, die durch die Funkressourcensteuerung (RRC) angezeigt werden, anwendbar, wobei die Funkressourcensteuerung (RRC) auch den Satz von HARQ-Prozessen einschränken kann, für die geplante Gewährungen (scheduled grants) anwendbar sind. Hier werden die auf nicht-geplanten (non-scheduled) MAC-d-Flüssen abgebildeten Daten so schnell wie möglich durch die möglichen HARQ-Prozessbeschränkungen übertragen. Das Netzwerk (UTRAN) kann den TTI entweder auf 2 ms oder 10 ms einstellen. Bei einem 2 ms TTI kann das UTRAN die zulässigen Prozesse für geplante (scheduled) und nicht-geplante (non-scheduled) MAC-d-Flüsse definieren. Hier entscheidet die Sende-Empfangseinheit der Basisstation (BTS) über die Ablaufplanungsgewährungen (scheduling grants) der geplanten (scheduled) Übertragung (vgl. Abs. [0006] bis [0008]). 296 Vorzugsweise kann das UTRAN das Übertragungsintervall für bestimmte Dienste wie Voice-over-IP (VoIP) im UTRAN erhöhen, um die Übertragungskapazität zu erhöhen. Gemäß Kapitel 5.1.1 der Spezifikation TS 26.236 existiert bei VoIP-Verbindungen ein Paket pro Sprachrahmen, d.h. ein Paket in 20 ms. Auf dem E-DCH führt dies zu einer Übertragungsrate von einem Transportblock (TB) pro 20 ms. Die Sprachübertragung kann jedoch eine gewisse Verzögerung tolerieren, so dass die Datenpakete gemäß Spezifikation zur Verbesserung der Übertragungskapazität auch weniger häufig (einmal alle 40 ms oder 60
- ms)gesendet werden können (vgl. Abs. [0009] - [0011]). 297 1.1 Vor diesem Hintergrund liegt dem Streitpatent als technisches Problem die Aufgabe zugrunde, den dedizierten Uplink-Kanal (E-DCH) für den Paketdatenverkehr zu verbessern (vgl. Abs. Der hier zuständige Fachmann ist als ein Ingenieur der Fachrichtung Nachrichtentechnik mit Universitätsabschluss sowie mehrjähriger Berufserfahrung und einschlägigen Kenntnissen auf dem Gebiet der Datenübertragung in Mobilfunksystemen zu definieren. 379 3. Die Merkmale bedürfen der Auslegung. 380 3.1 Beansprucht wird mit Anspruch 1 des Hauptantrags ein Verfahren für eine autonome erweiterte Uplink-Übertragung, bei dem eine Ablaufplanungsgewährung von einem Netzwerk nicht benötigt wird. Das Verfahren wird von einer Mobilstation ausgeführt (Merkmale 1, 1.1). 381 Das Verfahren betrifft ausschließlich Übertragungen in der Aufwärtsstrecke, die somit vom Mobilgerät zur Basisstation erfolgen. 382 Das Verfahren wird für autonome erweiterte Übertragungen ausgeführt. 383 Unter einer autonomen Übertragung versteht das Streitpatent eine Übertragung einer Mobilstation ohne vorherige Ressourcen-Zuweisung durch einen Planer (scheduler) einer Basisstation. Dabei ist keine gültige „Ablaufplanungsgewährung“ (scheduling grant) der Basisstation erforderlich, damit Pakete übertragen werden können, da bereits ein für die Mobilstation definierter Mindestsatz an Transportformaten eine autonome Übertragung ermöglicht. Diese autonome Übertragung unterscheidet das Streitpatent von normalen Übertragungen, für die eine Basisstation einer Mobilstation einen Anteil einer Uplink-Ressource über eine „Ablaufplanungsgewährung“ (scheduling grant) explizit zuweist (vgl. Abs. [0002]). 384 Darüber hinaus bezeichnet das Streitpatent die autonom übertragenden UEs als „non-scheduled UEs“ und die autonomen Übertragungen als „unscheduled autonomous transmissions“. Diesen Angaben entnimmt der Fachmann, dass es sich aus Sicht der Basisstation bei autonomen Übertragungen um ungeplante bzw. außerplanmäßige Übertragungen des UE handelt, die der Scheduler der Basisstation nicht steuert. 385 Entsprechend versteht der Fachmann das Teilmerkmal „in which a scheduling grant from a network is not required“ derart, dass eine „Ablaufplanungsgewährung“ (scheduling grant) einer Basisstation für eine autonome Übertragung des UE nicht erforderlich ist. Dieses Teilmerkmal bezieht sich dabei auch nur auf die „Ablaufplanungsgewährung“ (scheduling grant) und nicht auf einen „non-scheduled grant“, mit dem das Netzwerk eine maximale Anzahl von Bits definiert, die in einer MAC-e-PDU für bestimmte MAC-d-Flüsse enthalten sein können (vgl. Abs. [0006]). 386 Im Absatz [0005] verweist das Streitpatent bezüglich autonomer Übertragungen u.a. auf das Dokument R1-041087 (NK6). Auch dieses offenbart im Kapitel 2.1, dass ein Benutzergerät (UE) bei einer autonomen Übertragung jederzeit E-DCH-Daten senden kann, ohne einen Planungsbefehl (scheduling command) von einer Basisstation zu erhalten (vgl. NK6, Kap. 2.1). 387 Dieses Verfahren soll für autonome Übertragungen explizit ausgeführt werden („A method which is executed by a mobile station for autonomous enhanced uplink transmission“). 388 Klägerseits wird ausgeführt, dass dieses nur so verstanden werden müsse, dass das beanspruchte Verfahren ausschließlich für autonome Übertragungen ausgeführt werde und nicht für geplante Übertragungen. Ein Verfahren, das unterschiedslos für autonome wie geplante Übertragungen durchgeführt werde, sei nicht anspruchsgemäß. Die Verzögerung geplanter Übertragungen sei nicht nur nicht erforderlich, sondern laufe der Aufgabe gerade zuwider. 389 Im Umkehrschluss bedeute das Merkmal 1.1, dass bei Vorliegen geplanter (nicht-autonomer) Übertragungen, das beanspruchte Verfahren gerade nicht angewendet werde. 390 Diese Argumentation kann nicht überzeugen, da sich das Merkmal 1.1 ausschließlich auf autonome Übertragungen bezieht und sich nicht mit dem befasst, was mit geplanten Übertragungen geschieht. Es definiert somit nicht, wie geplante Übertragungen durchgeführt werden und lässt deren Übertragung offen. 391 Unter einer erweiterten Übertragung versteht das Streitpatent die Nutzung eines erweiterten Kanals, wie dem mit der Version 6 des 3GPP-Standards definierten E-DCH (vgl. Abs. [0002], [0006], [0014]). Bei dem E-DCH handelt es sich um einen Transportkanal (vgl. Abs. [0014]). Das Streitpatent erwähnt darüber hinaus einen erweiterten dedizierten physikalischen Datenkanal (E-DPDCH) und einen erweiterten dedizierten physikalischen Steuerkanal (E-DPCCH) (vgl. Abs. [0006], [0054]). Insofern fallen unter den Anspruch nur Verfahren, bei denen ein erweiterter Kanal für die Übertragung genutzt wird, und keine Übertragung auf beliebigen, nicht-erweiterten Kanälen. Diese Beschränkung auf erweiterte Übertragungen wird zudem auch im Merkmal 1.2.1 vorgenommen. 392 3.2 Gemäß den Merkmalen 1.2 und 1.2.1 wird zunächst ein virtuelles Übertragungszeitintervall für eine Medienzugriffssteuereinheit (MAC) bestimmt, wobei das virtuelle Übertragungszeitintervall (vTTI) ein Minimalzeitintervall festlegt, das zwischen erweiterten Uplink-Übertragungen erlaubt ist. 393 Abbildung in Originalgröße in neuem Fenster öffnen Figur 5 des Streitpatents 394 Gemäß Ausführungsbeispiel der Figur 5 werden RLC-SDUs, die jeweils ein VoIP-Paket enthalten, alle 20 ms von der Applikations-Schicht an die MAC-Schicht geliefert (siehe vertikale Pfeile). In der MAC-d-Schicht werden die VoIP Pakete #1 (A) und #2 (B) zusammengefasst und zusammen in einer PDU beim HARQ Prozess Nr. 2, im selben TTI, gesendet. Das virtuelle Übertragungszeitintervall (vTTI) beträgt 40 ms (vgl. N1, Abs. [0039] und Fig. 5). Aufgrund des vTTI darf die MAC-Schicht die Datenübertragung nur alle 40 ms starten. Daher ist der nächste Punkt, an dem eine MAC-PDU gesendet werden kann, 40 ms später, wiederum unter Verwendung des HARQ-Prozesses Nr. 2. In diesem Beispiel erfolgt aber zunächst eine Wiederholungsübertragung der ersten MAC-PDU (die die gestrichelten SDUs #1 (C) und #2 (D) enthält). Die MAC-PDU, die die nächsten zwei Pakete (#3 (E), #4 (F)) enthält, wird bis zum nächsten TTI verzögert und beim HARQ-Prozess Nr. 3 gesendet. Beim Start des nächsten vTTI kann die MAC-PDU mit den Paketen #5 und #6 auf dem HARQ-Prozess 2 gesendet werden, gefolgt von einer erneuten Übertragung der zweiten MAC-PDU mit den Paketen #3 und #4 (vgl. N1, Abs. [0040] und Fig. 5). 395 Das vTTI definiert somit den zyklischen Startpunkt, von dem aus eine Übertragung erfolgen darf. Das vTTI definiert oder bestimmt jedoch nicht die Länge der Lücke zwischen dem Ende einer Übertragung und dem Anfang der nächsten. Der genaue Zeitpunkt, zu dem eine MAC-PDU tatsächlich gesendet wird, kann sich verzögern. 396 Die tatsächlichen Lücken vom Ende einer Übertragung bis zum Beginn der nächsten Übertragung reichen in der Figur 5 von 20 ms bis 30 ms, obwohl das vTTI 40 ms beträgt. 397 Dem Streitpatent ist zwar zu entnehmen, dass das virtuelle TTI vom Funknetzwerkcontroller (RNC) an das UE signalisiert werden könnte; das UE könnte dann das virtuelle TTI in der MAC-d-Schicht implementieren (vgl. Abs. [0019]). Das Merkmal 1.2 ist allerdings nicht auf eine bestimmte MAC-Schicht, z.B. die MAC-d-Schicht, beschränkt. 398 Dementsprechend könnte das Endgerät den Wert des virtuellen Übertragungszeitintervalls auch selbst, beispielsweise mittels eines gespeicherten Wertes oder eines Algorithmus, bestimmen oder dadurch bestimmen, dass es eine Eingabe von außen auswertet. 399 3.3 Gemäß Merkmal 1.3 folgt ein Prüfschritt, um zu bestimmen, ob die Medienzugriffssteuereinheit (MAC) Datenpakete in einem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt. 400 Da sich das Merkmal 1.3 auf eine Übertragung der Medienzugriffssteuereinheit bezieht, kann es sich bei dem Begriff „Übertragung“ nur um die Übertragung von der MAC-Schicht zur physikalischen Schicht handeln. Somit wird bestimmt, ob die MAC-Schicht in einem aktuellen Zeitintervall (TTI) Datenpakete überträgt. 401 Das Merkmal ist auch auf autonome erweiterte Übertragungen beschränkt, da sich zum einen das gesamte Verfahren gemäß Merkmal 1.1 auf autonome Übertragungen bezieht, und zum anderen im Merkmal 1.3 die MAC genannt ist, für die in den Merkmalen 1.2 und 1.2.1 ein vTTI für erweiterte Übertragungen definiert wurde. 402 Das Merkmal 1.3 definiert dabei jedoch nicht, wann und welche Art von Prüfung („checking“) erfolgt, um daraus zu bestimmen, ob die MAC im aktuellen TTI überträgt, oder nicht, sondern nur, dass eine Prüfung erfolgt. 403 Darüber hinaus erfolgt auch keine Prüfung, ob die MAC im aktuellen TTI überträgt, sondern nur eine Prüfung, um zu bestimmen, ob die MAC im aktuellen TTI überträgt. 404 Dementsprechend verlangt der Wortlaut des Merkmals 1.3 auch nicht, dass gleichzeitig oder zusätzlich ein Pufferfüllstand zu überprüfen ist, noch, dass die MAC-Einheit bestimmt, ob nach dem derzeitigen TTI noch weitere Daten zu übertragen sind, sondern ausschließlich eine beliebige Prüfung, um zu bestimmen, ob die MAC im aktuellen TTI überträgt. 405 Die Beklagte führt aus, dass im Zusammenhang mit einem TTI der Begriff „current“ keine Erwähnung in der Beschreibung des Streitpatents finde. Dem Fachmann erschließe sich unter Berücksichtigung der Bezugnahme auf eine erweiterte Aufwärtsstreckenübertragung („enhanced uplink transmission“) im Anspruch, dass es sich bei dem „a current“ TTI um das gerade beginnende TTI handele. Weiter ergebe sich für den Fachmann aus der Anmeldung auch eindeutig, dass die Prüfung, ob die MAC-Einheit bis zum Ende des vorangehenden TTIs („this TTI“) den RLC-Puffer leeren könne, gleichbedeutend sei mit der im Streitpatent beanspruchten Prüfung, ob die MAC-Einheit in dem beginnenden TTI („current TTI“) eine Datenübertragung vornehme oder nicht. Bestimme die MAC-Einheit, dass sie in dem gerade beendeten TTI („during this TTI“) den RLC-Puffer leeren könne, sei dies gleichbedeutend mit der Bestimmung, dass die MAC-Einheit im gerade beginnenden TTI („a current“ TTI) keine Daten übertrage. Bestimme die MAC-Einheit hingegen, dass sie in dem gerade beendeten TTI („during this TTI“) den RLC-Puffer nicht leeren könne, sei dies gleichbedeutend mit der Bestimmung, dass die MAC-Einheit im gerade beginnenden TTI („a current“ TTI) Daten übertrage. 406 Diese Argumentation kann nicht überzeugen. Unter dem „current“ TTI im Merkmal 1.3 versteht der Fachmann das aktuelle TTI. Auch die Verwendung des „present continuous“ in der Formulierung „is transmitting“ weist den Fachmann darauf hin, dass der Übertragungsvorgang noch nicht abgeschlossen ist und momentan in der Gegenwart stattfindet. Der Anspruch schränkt das aktuelle TTI auch weder auf den Beginn, noch auf dessen Ende ein und verlangt nur eine beliebige Prüfung, um zu bestimmen, ob der MAC im aktuellen TTI überträgt. Dem Streitpatent ist zwar eine Prüfung zu entnehmen, ob der MAC den RLC-Puffer während dieses Luftschnittstellen-TTIs leeren kann (vgl. Abs. [0052]: „(
- i)if the MAC is able to empty the RLC buffer during this air interface TTI“), jedoch bezieht sich diese Prüfung zum einen ebenfalls auf das aktuelle TTI („this air interface TTI“). Zum anderen dient diese Prüfung ausschließlich der Bestimmung, wann erneut geprüft werden soll und nicht einer Bestimmung, ob der MAC im aktuellen TTI überträgt (vgl. Abs. [0052]: „(
- i)if the MAC is able to empty the RLC buffer during this air interface TTI, then the MAC will check the RLC buffer at the next predetermined subsequent time interval after the virtual TTI; (
) if the MAC is not able to empty the buffer, then the MAC will also check the RLC buffer for the next air interface TTI“). Im Fall, dass der Puffer im aktuellen TTI geleert werden kann, erfolgt die nächste Puffer-Prüfung erst nach einem vTTI (Fall (i)), ansonsten erneut im nächsten TTI (Fall (
)). Da im aktuellen TTI zur Beantwortung der Frage aus Absatz [0052] zudem immer übertragen wird, ist die in Abs. [0052] offenbarte Prüfung bereits nicht gleichbedeutend mit einer Prüfung, ob die MAC-Einheit im aktuellen TTI eine Datenübertragung vornimmt oder nicht. Des Weiteren entnimmt der Fachmann den Figuren 5 und 7 des Streitpatents, dass ein zum Ende des HARQ-Prozesses Nr. 3 jeweils im RLC Puffer bereits vorliegendes Datenpaket #5 nicht in dem jeweils folgenden HARQ-Prozess Nr. 0, sondern erst zu Beginn des nächsten vTTI mit dem HARQ-Prozess Nr. 2 übertragen wird. Insofern zeigen die Figuren 5 und 7 des Streitpatents unmittelbar und eindeutig, dass eine Bestimmung eines im gerade beendeten TTI (HARQ-Prozess Nr. 3) nicht geleerten Puffers (da das Paket #5 am Ende des HARQ Prozess Nr. 3 im Puffer jeweils vorliegt), eben nicht gleichbedeutend ist mit der Bestimmung, dass die MAC-Einheit im gerade beginnenden TTI (dieses wäre jeweils der HARQ-Prozess Nr. 0) Daten überträgt. Somit scheidet eine Auslegung, wonach dieses gleichbedeutend sei, zwingend aus. 407 3.4 Die Merkmale 1.4 bis 1.4.2 definieren ausschließlich was bei einem negativen Ergebnis des Bestimmungsschrittes gemäß Merkmal 1.3 passieren soll, also nur den Fall, in dem bestimmt wird, dass die Medienzugriffssteuer-einheit nicht in dem gegenwärtigen Luftschnittstellenübertragungszeitintervall überträgt. 408 Wird bestimmt, dass die MAC im aktuellen TTI nicht überträgt (Merkmal 1.4), erfolgt die Übertragung des nächsten Datenpakets erst nachdem eine durch das vTTI bestimmte Periode als verstrichen bestimmt ist (Merkmale 1.4.1, 1.4.2). 409 Die Merkmale des Anspruchs definieren dabei nicht, was passieren soll, wenn bestimmt wird, dass die MAC im aktuellen TTI überträgt. 410 Die Beklagte führt aus, dass sich das Merkmal 1.4 funktional an die Übertragungsüberprüfung aus Merkmal 1.3 anschließe. Ergebe diese, dass die MAC-Einheit in dem „a current“ TTI (d.h. dem gerade beginnenden TTI) kein Datenpaket übertrage, so seien weitere Übertragungen zunächst auszusetzen. Das nächste Datenpaket werde erst wieder nach Ablauf des virtuellen TTIs übertragen. 411 Dieser Argumentation ist nicht zu folgen, da im Merkmal 1.3 keine Übertragungsüberprüfung erfolgt, sondern nur eine Bestimmung, ob in dem aktuellen TTI übertragen wird. 412 3.5 Das Merkmal 1.3A.I.1 des Hilfsantrags A.I.1 präzisiert den Prüfschritt derart, dass geprüft wird, ob die Medienzugriffssteuereinheit (MAC) in der Lage ist, einen RLC-Puffer in einem ersten Luftschnittstellen-Übertragungszeitintervall zu leeren, um zu bestimmen, ob die MAC Datenpakete in einem gegenwärtigen Luftschnittstellen-Übertragungszeitintervall überträgt. 413 Die Bestimmung, ob die MAC-Schicht in dem aktuellen TTI Datenpakete überträgt, soll somit dadurch erfolgen, dass geprüft wird, ob die MAC in der Lage ist, einen RLC-Puffer in einem ersten TTI zu leeren. 414 Der Fachmann versteht die RLC-Schicht als eine über der MAC-Schicht angeordnete Schicht, wobei beide Schichten über logische Kanäle miteinander verbunden sind. Die RLC-Schicht übergibt Datenpakete an die MAC-Schicht, kann diese aber auch in einem RLC-Puffer speichern. 415 Unter einem ersten TTI versteht der Fachmann beispielsweise das erste TTI in einem virtuellen TTI, so dass durch den Prüfschritt, ob die MAC im ersten TTI des vTTI den RLC-Puffer leeren kann, bestimmt wird, ob in dem aktuellen TTI Pakete übertragen werden. 416 Ist die MAC in der Lage, den Puffer in diesem ersten TTI zu leeren, wird gemäß Merkmal 1.4A.I.1 bestimmt, dass die MAC im aktuellen TTI nicht überträgt. 417 3.6 Gemäß Merkmal 1.1A.I.2 des Hilfsantrags A.I.2 und allen folgenden Hilfsanträgen betrifft das Verfahren ausschließlich autonome erweiterte Uplink-Übertragungen in einem HSUPA-Übertragungsverfahren (High Speed Uplink Packet Access). 418 Das Merkmal 1.3A.I.2 präzisiert, dass das aktuelle Luftschnittstellen-Sendezeitintervall das nächste Luftschnittstellen-Sendezeitintervall nach dem ersten Luftschnittstellen-Sendezeitintervall ist. 419 3.7 Gemäß Merkmal 1.4.1A.I.3 des Hilfsantrags A.I.3 erfolgt - wenn die MAC in der Lage ist, den Puffer in dem ersten TTI zu leeren und damit bestimmt wird, dass die MAC im aktuellen TTI nicht überträgt - nicht nur die Übertragung des nächsten Datenpakets, sondern auch die Überprüfung des RLC-Puffers erst, nachdem eine durch das vTTI bestimmte Periode als verstrichen bestimmt ist. 420 3.8 Das Merkmal 1.3A.I.4 des Hilfsantrags A.I.4 definiert zudem, dass die MAC Datenpakete in dem ersten Luftschnittstellenübertragungszeitintervall überträgt. 421 Somit wird überprüft, ob die MAC durch die Übertragung während des ersten TTI in der Lage ist, einen RLC-Puffer in diesem ersten TTI zu leeren. 422 Gemäß Merkmal 1.4.1A.I.4 erfolgt - wenn die MAC in der Lage ist, den Puffer in dem ersten TTI zu leeren und damit bestimmt wird, dass die MAC im aktuellen TTI nicht überträgt - die Überprüfung des RLC-Puffers bei einem nächsten vorbestimmten nachfolgenden TTI nach dem vTTI. 423 3.9 Die Ergänzung des Begriffs „new“ im Merkmal 1.2.1‘ des Anspruchs 1 des Hilfsantrags A.
.2 sowie in allen mit ‘ versehenen Hilfsanträgen bestimmt, dass das virtuelle TTI ein minimales Zeitintervall definiert, welches zwischen neuen erweiterten Uplink-Übertragungen zulässig ist. 424 Dadurch bezieht sich das vTTI nur auf neue Übertragungen und hat keinen Einfluss auf Wiederholungsübertragungen. 425 Das Merkmal 1.6 der Hilfsanträge A.
.1 und A.
.2 definiert für den Fall, dass die MAC den RLC-Puffer in dem ersten TTI nicht leeren kann, ein Prüfen des RLC-Puffers auch für das nächste TTI nach dem ersten TTI. 426 Es ergänzt somit einen bei einem negativen Prüfungsergebnis durchzuführenden Verfahrensschritt. 427 3.10 Gemäß Merkmal 1.3A.
I des Hilfsantrags A.
I erfolgt im Unterschied zum Merkmal 1.3 des Hauptantrags eine Prüfung, ob die MAC in der Lage ist, einen RLC-Puffer in einem ersten TTI zu leeren, in dem die MAC Datenpakete überträgt. Eine Bestimmung, ob die MAC Datenpakete in einem aktuellen TTI überträgt, erfolgt nicht. 428 Für den Fall, dass die MAC in der Lage ist, den RLC-Puffer im ersten TTI zu leeren, wird gemäß den Merkmalen 1.4A.
I und 1.4.1A.
I der RLC-Puffer erst wieder bei einem nächsten vorbestimmten nachfolgenden TTI nach dem virtuellen TTI geprüft. 429 Im Unterschied zu den Merkmalen 1.4 bis 1.4.2 des Hauptantrags erfolgt im Anspruch 1 des Hilfsantrags A.
I weder eine Bestimmung einer Nicht-Übertragung, noch eine Bestimmung einer nächsten Datenpaketübertragung. 430 Für den Fall, dass die MAC nicht in der Lage ist, den RLC-Puffer im ersten TTI zu leeren, definiert das Merkmal 1.6A.
I ein Prüfen des RLC-Puffers für das nächste TTI. 431 3.11 Das Merkmal 1.3B.I.1 des Hilfsantrags B.I.1 präzisiert, dass das Prüfen, um zu bestimmen, ob die MAC Datenpakete in dem aktuellen TTI überträgt, ein Prüfen umfasst, ob die MAC in der Lage ist, einen RLC-Puffer in einem vorherigen TTI zu leeren. 432 Unter einem vorherigen TTI versteht der Fachmann ein beliebiges vorhergehendes TTI, und damit nicht nur ein unmittelbar vorhergehendes TTI. 433 3.12 Ist die MAC in der Lage, den Puffer in dem vorherigen TTI zu leeren, wird gemäß Merkmal 1.4B.I.2 des Hilfsantrags B.I.2 bestimmt, dass die MAC im aktuellen TTI nicht überträgt. 434 3.13 Das Merkmal 1.6B.
des Hilfsantrags B.
definiert für den Fall, dass die MAC den RLC-Puffer in dem vorherigen TTI nicht leeren kann, ein Prüfen des RLC-Puffers auch für das aktuelle TTI. 435 3.14 Das Merkmal 1.3C.I.1 des Hilfsantrags C.I.1 präzisiert, dass das Prüfen, um zu bestimmen, ob die MAC Datenpakete in dem aktuellen TTI überträgt, ein Prüfen umfasst, um zu bestimmen, ob die MAC einen RLC-Puffer geleert hat. 436 Aufgrund der verwendeten Vergangenheitsform „emptied“ soll gemäß Wortlaut bestimmt werden, ob die MAC ihren RLC-Puffer geleert hat. Das Merkmal 1.3C.I.1 definiert dabei weder, welche Prüfung erfolgt, noch zu welchem Zeitpunkt eine derartige Prüfung durchgeführt wird. Darüber hinaus bleibt undefiniert, wann der RLC-Puffer geleert wurde. 437 Dieses versteht der Fachmann beispielsweise als eine Überprüfung in einem aktuellen TTI, ob die MAC ihren RLC-Puffer in einem vorherigen TTI bereits geleert hat. Dieses Ergebnis dient zur Bestimmung, ob die MAC im aktuellen TTI Pakete überträgt. 438 3.15 Für den Fall, dass die MAC den RLC-Puffer geleert hat, wird gemäß Merkmal 1.4C.I.2 des Hilfsantrags C.I.2 bestimmt, dass die MAC im aktuellen TTI nicht überträgt. 439 3.16 Das Merkmal 1.6C.

definiert für den Fall, dass die MAC den RLC-Puffer nicht geleert hat, ein Prüfen des RLC-Puffers auch für das aktuelle TTI. 440 4. Zum Hauptantrag 441 4.1. In der erteilten Fassung ist das Streitpatent nach Art.
§ 6Abs. 1 Satz 1 Nr. 3 Int
PatÜG i. V. m. Art. 138 Abs. 1c) EPÜ für nichtig zu erklären, da der Gegenstand des Anspruchs 1 über den Inhalt der europäischen Patentanmeldung in ihrer bei der für die Einreichung der Anmeldung zuständigen Behörde ursprünglich eingereichten Fassung hinausgeht. 442 4.1.
- Nach ständiger Rechtsprechung gehört zum Offenbarungsgehalt einer Patentanmeldung nur das, was den ursprünglich eingereichten Unterlagen in der Gesamtheit ihrer Offenbarung unmittelbar und eindeutig als zu der zum Patent angemeldeten Erfindung gehörend zu entnehmen ist. Danach ist es erforderlich, aber auch ausreichend, dass der Fachmann die im Anspruch bezeichnete technische Lehre den Ursprungsunterlagen unmittelbar und eindeutig als Ausgestaltung der Erfindung bzw. als mögliche Ausführungsform entnehmen kann (BGH, Urteil vom
- November 2014, X ZR 119/09, GRUR 2015, 249 – Schleifprodukt; BGH, Urteil vom
- Februar 2014, X ZR 107/12, BGHZ 200, 63 Rn. 19 ff. m. w. N. = GRUR 2014, 542– Kommunikationskanal). 443 Eine unzulässige Erweiterung liegt hingegen vor, wenn der Gegenstand des Patents sich für den Fachmann erst aufgrund eigener, von seinem Fachwissen getragener Überlegungen ergibt, nachdem er die ursprünglichen Unterlagen zur Kenntnis genommen hat. Zu einer unzulässigen Erweiterung führen auch solche Änderungen, durch die der Gegenstand der Anmeldung über den Inhalt der ursprünglich eingereichten Anmeldungsunterlagen hinaus zu einem Aliud abgewandelt wird. Dies ist unter anderem dann der Fall, wenn die Hinzufügung einen technischen Aspekt betrifft, der den ursprünglich eingereichten Unterlagen in seiner konkreten Ausgestaltung oder wenigstens in abstrakter Form nicht als zur Erfindung gehörend zu entnehmen ist (BGH, Urteil vom
- Oktober 2020 – X ZR 158/18, GRUR 2021, 571 - Zigarettenpackung; BGH, Urteil vom
- April 2013, X ZR 130/11, GRUR 2013, 809 – Verschlüsselungsverfahren). 444 Ein „breit“ formulierter Patentanspruch kann als unbedenklich zu erachten sein, wenn sich ein in der ursprünglichen Anmeldung beschriebenes Ausführungsbeispiel der Erfindung für den Fachmann als Ausgestaltung der im Patentanspruch umschriebenen allgemeineren technischen Lehre darstellt und diese Lehre in der beanspruchten Allgemeinheit für ihn bereits der Anmeldung – sei es in Gestalt eines in der Anmeldung formulierten Patentanspruchs, sei es nach dem Gesamtzusammenhang der Unterlagen – als zu der angemeldeten Erfindung gehörend zu entnehmen ist (BGH, Urteil vom

- Juli 2012, X ZR 117/11, GRUR 2012, 1124 – Polymerschaum). 445 Unzulässig ist eine Verallgemeinerung hingegen, wenn den ursprünglich eingereichten Unterlagen zu entnehmen ist, dass einzelne Merkmale in untrennbarem Zusammenhang miteinander stehen, der Patentanspruch diese Merkmale aber nicht in ihrer Gesamtheit vorsieht (BGH, Urteil vom
- Juni 2016, X ZR 41/14, GRUR 2016, 1038 Fahrzeugscheibe
; BGH, Beschluss vom
- September 2001, X ZB 18/00, GRUR 2002, 49 – Drehmomentübertragungs-einrichtung). 446 4.1.
- Das Merkmal 1.2 des erteilten Patentanspruchs 1, wonach ein virtuelles Übertragungszeitintervall für eine Medienzugangskontrollinstanz bestimmt wird („determining a virtual transmission time interval for a medium access control entity“), ist für den Fachmann in der beanspruchten Allgemeinheit nicht aus den ursprünglich eingereichten Anmeldungsunterlagen (N1c) zu entnehmen. 447 Denn der von der Beklagten zitierten Offenbarungsstelle ist nur zu entnehmen, dass das vTTI das minimale Zeitintervall zwischen nachfolgenden neuen Übertragungen definiert und keine Auswirkungen auf Wiederholungsübertragungen hat, die normal ausgeführt werden (vgl. N1c, S. 7, Z. 26-31: „This control defines the minimum time interval between subsequent new transmissions. The control has no impact on retransmissions, which are performed normally.“). 448 Da der Fachmann unter erweiterten Aufwärtsstreckenübertragungen sowohl neue, als auch wiederholte Übertragungen versteht, führt die fehlende Beschränkung des vTTI auf neue Aufwärtsstrecken-Übertragungen zu einer unzulässigen Erweiterung. 449 4.1.
- Der ursprünglichen Anmeldung ist darüber hinaus kein Verfahrensschritt mit einer Bestimmung zu entnehmen, ob die MAC-Einheit Datenpakete in einem gegenwärtigen TTI überträgt. Auch ist an keiner Stelle unmittelbar und eindeutig offenbart, dass eine Prüfung stattfindet, um zu bestimmen, ob aktuell übertragen wird, insbesondere nicht, ob die MAC-Einheit in dem aktuellen TTI Datenpakete überträgt. Ein Zusammenhang zwischen Überprüfung und Bestimmung ist in der gesamten Anmeldung nicht offenbart (Merkmal 1.3). 450 Die Beklagte führt aus, dass sich für den Fachmann aus der Anmeldung eindeutig ergebe, dass die Prüfung, ob die MAC-Einheit bis zum Ende des vorangehenden TTIs („this TTI“) den RLC-Puffer leeren könne, gleichbedeutend sei mit der im Streitpatent beanspruchten Prüfung, ob die MAC-Einheit in dem beginnenden TTI („current TTI“) eine Datenübertragung vornehme oder nicht. 451 Die in Merkmal 1.3 offenbarte Übertragungsprüfung weiche demnach zwar sprachlich von dem Absatz ab, welcher sich von Zeile 5 bis 16 auf Seite 17 der Anmeldung erstrecke. Darauf komme es bei der Beurteilung der Erfindungsidentität nicht an, weil maßgeblich nur sei, ob der Fachmann mit einer neuen technischen Information konfrontiert werde. Insoweit ergäben sich indes keine Unterschiede. Die beanspruchte Übertragungsprüfung sei im maßgeblichen Zusammenhang einer autonomen erweiterten Datenübertragung nichts Anderes als die ursprünglich offenbarte RLC-Pufferprüfung. 452 Diese Argumentation kann nicht überzeugen, da es sich um unterschiedliche Gegenstände handelt. 453 Zum einen handelt es sich im Merkmal 1.3 bereits nicht um eine Prüfung, ob die MAC-Einheit in dem beginnenden TTI („current TTI“) eine Datenübertragung vornimmt oder nicht. Beansprucht ist eine beliebige Prüfung, die zu einer Bestimmung führt, ob die MAC-Einheit in dem aktuellen TTI („current TTI“) eine Datenübertragung vornimmt oder nicht. 454 Zum anderen ist eine Prüfung, ob die MAC-Einheit bis zum Ende des vorangehenden TTIs („this TTI“) den RLC-Puffer leeren kann, nicht gleichbedeutend mit einer Prüfung, ob die MAC-Einheit in dem beginnenden TTI („current TTI“) eine Datenübertragung vornimmt oder nicht. Denn in dem ersten Fall wird geprüft, ob ein RLC-Puffer geleert werden kann und in dem zweiten Fall, ob eine Datenübertragung überhaupt vorgenommen wird, zudem noch zu unterschiedlichen Zeitpunkten. 455 Konkret ursprünglich offenbart ist lediglich eine Überprüfung, ob die MAC den RLC-Puffer in einem aktuellen TTI leeren kann, um zu bestimmen, ob diese Prüfung für das nächste TTI (Fall
) oder im nächsten vorbestimmten nachfolgenden TTI nach einem vTTI wiederholt wird (Fall
- i)(vgl. N1c, S. 17, Z. 6 - 9: „(
- i)if the MAC is able to empty the RLC buffer during this air interface TTI, then the MAC will check the RLC buffer at the next predetermined subsequent time interval after the virtual TTI; (
) if the MAC is not able to empty the buffer, then the MAC will also check the RLC buffer for the next air interface TTI.“). Da zur Pufferleerung im aktuellen TTI übertragen werden muss, kann dieser Offenbarungsstelle auch kein abstrakter Hinweis auf eine Prüfung zur Bestimmung einer Übertragung entnommen werden. 456 Auch den Figuren 5 und 7 der Anmeldung ist weder ein konkreter, noch ein abstrakter Hinweis auf eine Prüfung zur Bestimmung einer Übertragung zu entnehmen. Diesen Figuren ist bereits nicht zweifelsfrei zu entnehmen, wann eine Pufferprüfung, insbesondere im Hinblick auf die Re-Übertragungen und die Übertragung des Pakets #5, stattfindet, noch, ob basierend auf dieser Prüfung überhaupt bestimmt wird, wann übertragen wird. Selbst unter der abstrakten Annahme einer Bestimmung eines im gerade beendeten TTI (jeweils am Ende des von links gesehen zweiten HARQ-Prozesses mit der Nr. 3) nicht geleerten Puffers (da das Paket #5 am Ende des HARQ Prozess Nr. 3 im Puffer jeweils vorliegt), führt diese Bestimmung nicht zu einer Datenübertragung im folgenden TTI (HARQ-Prozess Nr. 0). Somit kann die ursprüngliche Anmeldung dem Fachmann auch nicht in abstrakter Form offenbaren, dass eine Bestimmung eines im gerade beendeten TTI nicht geleerten Puffers gleichbedeutend sei mit der Bestimmung, dass die MAC-Einheit im gerade beginnenden TTI Daten überträgt, da die Figuren 5 und 7 das Gegenteil zeigen. 457 Es bleibt danach festzustellen, dass es sich bei dem im Merkmal 1.3 beanspruchten beliebigen Prüfschritt, um zu bestimmen, ob die MAC Datenpakete in einem gegenwärtigen TTI überträgt, um eine nicht unter den Offenbarungsgehalt der Ursprungsanmeldung fallende und hierzu ein Aliud bildende Lehre handelt. 458 4.1.
- Der ursprünglichen Anmeldung ist auch nicht zu entnehmen, bei einer negativen Bestimmung des Merkmals 1.3 das nächste Datenpaket erst nach Ablauf des vTTI zu übertragen (Merkmale 1.4 bis 1.4.2). 459 Die Beklagte führt aus, dass der in Merkmal 1.4 genannte Fall, wonach die MAC-Einheit bestimmt, dass in einem gegenwärtigen („a current“) TTI (d.h. das gerade beginnende TTI) keine Datenübertragung stattfindet, nichts anderes sei als der Fall, in dem die MAC-Einheit zu besagtem Zeitpunkt bestimmt, dass sie in „diesem TTI“ (d.h. das gerade beendete TTI) in der Lage war, den RLC-Puffer zu leeren. 460 Auch diese Argumentation kann nicht überzeugen, denn die ursprüngliche Anmeldung offenbart lediglich für den Fall (i), dass die MAC in der Lage ist, den RLC-Puffer während dieses TTI zu leeren, sie den RLC-Puffer erst im nächsten TTI nach dem vTTI wieder überprüft (vgl. N1c, S. 17, Z. 6-8: „(i) if the MAC is able to empty the RLC buffer during this air interface TTI, then the MAC will check the RLC buffer at the next predetermined subsequent time interval after the virtual TTI“). Auch eine Bestimmung, wonach die MAC im aktuellen TTI nicht überträgt, ist der ursprünglichen Anmeldung nicht zu entnehmen. Dementsprechend ist der ursprünglichen Anmeldung auch nicht zu entnehmen, dass eine Bestimmung einer Nicht-Übertragung die weitere Übertragung bis zum Ablauf von vTTI verzögert (Merkmale 1.4.1, 1.4.2), sondern nur, dass, wenn der Puffer geleert werden kann, die weitere Pufferprüfung entsprechend verzögert wird. 461 Darüber hinaus offenbart die ursprüngliche Anmeldung auch nicht in abstrakter Form, wie zum Merkmal 1.3 bereits ausgeführt, dass eine Nicht-Übertragung im HARQ-Prozess Nr. 0 gemäß den ursprünglichen Figuren 5 und 7 gleichbedeutend mit einer Bestimmung sei, dass im beendeten TTI der RLC-Puffer geleert wurde, da gemäß den Figuren 5 und 7 am Ende des HARQ-Prozesses 3 das Paket #5 bereits im Puffer vorliegt. 462 4.1.
- Die weiteren, von den Klägerinnen als unzulässig erweitert geltend gemachten Merkmale im erteilten Anspruch 1 gehen in zulässiger Weise auf die Patentanmeldung in der ursprünglich eingereichten Fassung zurück. Der Senat folgt insoweit dem Vortrag der Beklagten. 463 4.1.
- Da der erteilte Patentanspruch 1 mangels ursprünglicher Offenbarung keinen Bestand hat, kann dahingestellt bleiben, ob die weiteren von den Klägerinnen vorgetragenen Nichtigkeitsgründe ebenfalls Erfolg gehabt hätten. 464 4.1.
- Da die Beklagte erklärt, dass sie die erteilte Fassung als geschlossenen Anspruchssatz versteht und das Streitpatent nur in der Reihenfolge des Hauptantrags und der Hilfsanträge jeweils als Ganzes verteidigt, bedarf es keiner Entscheidung, ob die übrigen Ansprüche für sich genommen etwas Erfinderisches enthalten (vgl. BGH, Beschluss vom

- Zu den Hilfsanträgen 466 5.1 Zu den Hilfsanträgen A.I.1 und A.I.1‘ 467 Der mit dem Merkmal 1.3A.I.1 festgelegte Zusammenhang des Prüfens, ob die MAC in der Lage ist, einen RLC-Puffer in einem ersten TTI zu leeren, mit dem Bestimmen, ob die MAC Pakete in einem aktuellen TTI überträgt, findet in den ursprünglich eingereichten Unterlagen weder eine wortgetreue noch eine sinngemäße Stütze. 468 Wie zum Merkmal 1.3 des Hauptantrags ausgeführt, ist den ursprünglichen Unterlagen lediglich ein Zusammenhang zwischen einem Prüfen, ob die MAC in der Lage ist, einen RLC-Puffer in einem aktuellen TTI zu leeren, und einer Bestimmung, wann erneut geprüft wird, zu entnehmen (vgl. N1c, S. 17, Z. 5 – 9: „(i) if the MAC is able to empty the RLC buffer during this air interface TTI, then the MAC will check the RLC buffer at the next predetermined subsequent time interval after the virtual TTI; (
) if the MAC is not able to empty the buffer, then the MAC will also check the RLC buffer for the next air interface TTI.“). 469 Die Beklagte führt aus, dass die in den ursprünglichen Unterlagen offenbarte Prüfung, ob der RLC-Puffer geleert werden könne, nur zur Entscheidung diene, ob eine Übertragung im nachfolgenden TTI möglich sei, oder nicht. Im E-DCH werde immer autonom übertragen, so dass, wenn der Puffer geleert werden konnte, keine weitere Übertragung im Anschluss erfolge. Ob der Puffer leer sei, könne nur am Ende des vorherigen TTI überprüft werden. Insofern sei der Ausdruck „to determine“ eine Art Zweckangabe. 470 Diese Argumentation kann nicht überzeugen, denn zum einen versteht der Fachmann den Ausdruck „to determine“ im Merkmal 1.3 des Verfahrensanspruchs 1 nicht als Zweckangabe, sondern explizit als Verfahrensschritt der Bestimmung, dessen Ergebnis die weiteren Verfahrensschritte 1.4 bis 1.4.2 beeinflusst. Zum anderen ist den ursprünglichen Unterlagen (vgl. N1c, S. 17, Z. 5 - 9) unmittelbar und eindeutig zu entnehmen, dass die Prüfung ausschließlich zur Entscheidung dient, wann der Puffer erneut zu prüfen ist (Fall (i) oder (
)). Eine Übertragungsbestimmung ist in dieser Textstelle überhaupt nicht angesprochen. Darüber hinaus offenbart die Textstelle auch keine in die Vergangenheit gerichtete Überprüfung, ob der Puffer leer ist, sondern nur eine in die Zukunft gerichtete Prüfung, ob der MAC den Puffer im aktuellen TTI auch leeren kann (vgl. N1c, S. 17, Z. 6: „if the MAC is able to empty“). Im aktuellen TTI wird dabei selbstverständlich übertragen. 471 Darüber hinaus offenbart die ursprüngliche Anmeldung auch nur drei Prüfzeitpunkte „this air interface TTI“, „next air interface TTI“ und „next predetermined subsequent time interval after the virtual TTI“ (vgl. N1c, S. 17, Z. 5 - 9). Ein gemäß Merkmal 1.3A.I.1 beliebiges „erstes TTI“ ist der Anmeldung nicht zu entnehmen. 472 Dass die Schlussfolgerung der Beklagten, wonach eine Überprüfung am Ende des vorherigen TTI nur zur Entscheidung diene, ob eine Übertragung im nachfolgenden TTI möglich sei, nicht zutrifft, zeigen auch die Figuren 5 und 7 der ursprünglichen Anmeldung, bei denen im TTI des dritten HARQ Nr. 0 trotz jeweils
