Published on 24 March 2025   SECOND SECTION Application no. 47448/20 Yakup ASLANTEPE against Türkiye and 2 other applications (see list appended) communicated on 5 March 2025 SUBJECT MATTER OF THE CASE The applications concern the applicants’ allegations of ill-treatment due to regular strip searches conducted by the prison authorities. At the time of the events, the applicants were detained in Silivri L-Type Prison. On various dates, they lodged complaints before the Silivri enforcement judge, claiming that they were subjected to regular strip searches following every open visit, in violation of the relevant legislation concerning body searches. The enforcement judge rejected the applicants’ complaints, stating that the searches were conducted in line with the regulations to ensure the security of the prison. The Constitutional Court found the applicants’ individual applications inadmissible for being manifestly ill-founded. The applicants complain under Article 3 of the Convention that they were subjected to inhuman and degrading treatment due to the regular strip searches conducted by the prison authorities. QUESTION TO THE PARTIES Have the applicants been subjected to inhuman or degrading treatment in violation of Article 3 of the Convention on account of the regular strip searches carried out by the prison authorities? In particular, have the authorities put forward any legitimate purpose for the applicants’ repeated strip searches (see Frérot v. France, no. 70204/01, §§ 35-48, 12 June 2007, and Roth v. Germany, nos. 6780/18 and 30776/18, §§ 64-72, 22 October 2020)?   The Government are invited to provide information on the nature of the strip searches carried out by the prison authorities, as well as the number of such searches the applicants went through.   APPENDIX No. Application no.
