SUBJECT MATTER OF THE CASE
On the dates set out in the appended table Mr R. Senyk, the applicants’ brother and uncle in application no. 17688/22, and Ms O. Zhukovska, the applicant in application no. 29783/22, were shot and injured allegedly by police officers while taking part in the series of protests in Ukraine between 21 November 2013 and 21 February 2014, commonly referred to as “Euromaidan” and/or “Maidan” (see Shmorgunov and Others v. Ukraine, nos. 15367/14 and 13 others, §§ 9-17, 21 January 2021). Further details are set out in the appended table. The applicants complain under Articles 2 and 6 of the Convention regarding the infliction of firearm injuries and the authorities’ failure to conduct an effective official investigation in this regard; under Articles 10 and 11 of the Convention regarding Mr R. Senyk and under Article 11 of the Convention regarding Ms O. Zhukovska that the police officers unlawfully prevented them from participating in the protests and thus from expressing their political views; and under Article 13 of the Convention that there are no effective remedies for these complaints at the domestic level.
 
 
QUESTIONS TO THE PARTIES
1.  Has there been a violation of the substantive aspect of Article 2 of the Convention on account of the circumstances in which Mr R. Senyk and Ms O. Zhukovska sustained firearm injuries (compare Farmanyan and Others v. Armenia, nos. 15998/11 and 8 others, §§ 193-234, 18 September 2025, with further references, and Selçuk v. Türkiye, no. 23093/20, § 73, 9 July 2024)? Did Mr R. Senyk’s death result from a use of force which was absolutely necessary for the purposes of paragraph 2 of this Article?
 
2. Having regard to the procedural protection of the right to life (see Farmanyan and Others, cited above, §§ 248-53), have the domestic authorities conducted an effective official investigation into Mr R. Senyk’s and Ms O. Zhukovska’s firearm injuries and Mr R. Senyk’s death, as required by Articles 2 of the Convention?
 
3. Was an interference with Mr R. Senyk’s rights to freedom of expression and freedom of peaceful assembly, and Ms O. Zhukovska’s right to freedom of assembly, contrary to Articles 10 and 11 of the Convention on account of their firearm injuries (see Shmorgunov and Others, cited above, §§ 482-94)?
 
4. Have there been effective domestic remedies available for the above complaints under Articles 2, 10 and 11, as required by Article 13 of the Convention?

The applicants are a sister and a niece of Mr R. Senyk, who was shot in the chest allegedly by the police on 22 January 2014 during the Maidan protests in Kyiv. On 23 January 2014 an official investigation was launched into attempted murder. Following Mr R. Senyk’s death on 25 January 2014 while undergoing medical treatment regarding his injuries, the investigation was reclassified as murder. On 10 September 2021 the applicants filed a civil claim in the criminal proceedings, which were ongoing as of September 2025.

The applicant was shot in the neck allegedly by the police during the violent clashes between the police and the Maidan protesters in Kyiv on 20 February 2014. As of September 2025, the criminal proceedings into this incident were still ongoing.
