Published on 23 February 2026   FIRST SECTION Application no. 30579/25 Kristian TURKALJ against Croatia lodged on 24 September 2025 communicated on 2 February 2026 SUBJECT MATTER OF THE CASE The application concerns the Constitutional Court’s decision to award the applicant compensation for the excessive length of proceedings but to refuse to grant him the costs of his legal representation, which exceeded the amount of the compensation. The applicant complains under Article 6 § 1 of the Convention that the Constitutional Court’s refusal to award him the costs of his legal representation had a deterrent effect on the exercise of his right of access to that court. QUESTION TO THE PARTIES Was the Constitutional Court’s refusal to award the applicant the costs of his legal representation before that court in breach of his right of access to a court under Article 6 § 1 of the Convention (see Moskalj v. Croatia, no. 60272/21, §§ 79-94, 15 October 2024)?
