  THIRD SECTION DECISION Application no. 5696/16 Grigoriy Eduardovich AVDEYENKO against Russia The European Court of Human Rights (Third Section), sitting on 5 February 2026 as a Committee composed of:  Úna Ní Raifeartaigh, President,  Mateja Đurović,  Vasilka Sancin, judges, and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 28 December 2015, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicant, Mr Grigoriy Eduardovich Avdeyenko, was born in 1988 and died in 2016. At the material time, he was serving his prison sentence in correctional colony No. IK-1 in Kostroma region. The applicant was represented by Mr A.V. Vinogradov, a lawyer practising in Kostroma. On 28 December 2015 the applicant lodged an application, notably complaining under Article 3 of Protocol 1 of the Convention about the ineligibility of convicted prisoners to vote in legislative elections. On 5 June 2019 this complaint was communicated to the Government and the remainder of the application was declared inadmissible. On 22 January 2020 the applicant’s representative informed the Registry that the applicant had died and that his mother expressed her will to continue the application. On 14 April 2020 the Government submitted their observations and considered that the present application should be struck out of the Court’s list of cases following the applicant’s death. THE LAW The Court notes that the case concerns issues falling under Article 3 of Protocol No. 1, which are so closely linked to the person of the original applicant that they cannot be regarded as transferable (see Kolomoytsev‑Rybalka and Others v. Ukraine (dec.) [Committee], nos. 39808/02 and 11632/03, 30 August 2011). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
