Having regard to the above application against Georgia lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 17 January 2023,
Having deliberated, decides as follows:
FACTS AND PROCEDUREThe applicant company’s details are set out in the appended table.
The applicant company was represented by Mr V. Macharashvili, a lawyer practising in Tbilisi.
The applicant’s complaints under Article 1 of Protocol No. 1 and Article 13 of the Convention concerning the freezing of its assets and the lack of any effective remedy in domestic law were communicated to the Georgian Government (“the Government”), represented by their Agent, Mr B. Dzamashvili, of the Ministry of Justice.
On 19 January 2024 the applicant company informed the Registry that the matter underlying the application had been resolved at domestic level and it did not wish to pursue the application.
THE LAWIn the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
