[ S.L.10.28 L A N DI N G C HA R GE S 1 SUBSIDIARY LEGISLATION 10.28 LANDING CHARGES REGULATIONS 4th April, 1973 LEGAL NOTICE 32 of 1973, as amended by Act XVII of 1991; Legal Notice 407 of 2007; and Act XV of 2009. 1. The title of these regulations is Landing Charges Regulations. Title. 2. The charges payable by consignees of goods to a person, firm or body, other than the Authority for Transport in Malta or its contractor, who undertakes the landing from ship’s tackle to any wharf or other place appointed for the purpose of the goods specified in Column 1 of the First Schedule to these Regulations shall be those shown in Column 2 or in Column 3 of Part I of the said Schedule or in Column 2 of Part II thereof; such charges shall be payable whether or not such person, firm or body is specifically mentioned in the bill of lading: Charges payable by consignees. Amended by: XVII. 1991.81; XV. 2009.49. Provided that where cranes have to be used for cargo of an exceptional nature or where the use of cranes is obligatory under the Ports and Shipping Act, or under the Port Workers Ordinance, an additional charge to cover the additional expense incurred shall be payable by consignees. Cap. 352. Cap. 171. 3. The charges shown in the First Schedule shall be calculated in the manner set out in the Second Schedule: Manner of calculating charges. Provided that for the purpose of calculating charges on unit loads or unitised cargo, the tonnage shall be calculated on the actual cargo forming the unit load or the unitised cargo and shall be calculated in the manner specified in the Second Schedule: Provided further that when both the actual weight and measurement in respect of every bill of lading of unit loads or unitised cargo is not recorded in the ship’s manifest or bill of lading, the rates shall be calculated on the overall weight or measurement of the cargo and the trailer or container on which or in which such cargo is loaded. 4. These regulations shall not apply to consignees who receive their goods under ship’s tackle.
