- The title of these regulations is the Limits of Liability Regulations.
- In these regulations, unless the context otherwise requires - Title. Interpretation. "the Ordinance"means the Motor Vehicles Insurance (ThirdParty Risks) Ordinance. Cap.
- For the purposes of article 4
(1)of the Ordinance the total liability which shall be required to be covered by a policy of insurance in respect of the use of a motor vehicle, which is normally based in Malta or in the territory of a designared State, shall be: Limitation of liability. Amended by: L.N. 409 of 2007; L.N. 190 of 2008; L.N. 3 of 2019. (
- a)in the case of death or bodily injury, an amount not less than six million and seventy thousand euro (€6,070,000) for every claim, whatever the number of injured parties; (
- b)in the case of damage to property, an amount not less than one million two hundred and twenty thousand euro (€1,220,000) for every claim, whatever the number of injured parties. 4. The amounts of compensation mentioned in regulation 3(
- a)and (
- b)shall come into force as follows: (
- a)as from the 5th August, 2008 until the 10th day of December, 2009, the amounts of compensation mentioned in regulation 3(
- a)shall be that of up to one million, one hundred and sixty-four thousand and six hundred and eighty-six euro and seventy cents (€1,164,686.70) per accident, irrespective of the number of injured parties involved; whereas the amounts of compensation mentioned in regulation 3(
- b)shall be that of up to two hundred and thirty-two thousand and nine hundred and thirty-seven euro and thirty-four cents (€ 232,937.34) irrespective of the number of parties involved or the nature of the damage; (
- b)as from the 11th day of December, 2009 the amounts of compensation, in the case of claims relating to death or bodily injury, mentioned in paragraph (
- a)shall be increased to that of two million five hundred thousand euro (€2,500,000) for every claim, whatever the number of injured parties; whereas the amounts of compensation in the case of claims relating to property mentioned in the said paragraph shall be increased to Provisions relating to time. - c)as from the 11th day of June, 2012 the amounts of compensation applicable shall be those amounts prescribed in regulation 3(
- a)and (b). Adjustment to the amounts of compensation. Added by: L.N. 190 of 2008. 5. The amounts of compensation mentioned in regulation 3 shall be adjusted on the 11th day of June, 2017, then every five years thereafter, and shall be increased automatically, by the percentage change indicated by the European Index of Consumer Prices (EICP) for a period of five years immediately preceding the rev ie w, and ro un de d up t o a m ul ti pl e of ten t h ou sand euro (€10,000).
