- The title of these regulations is the Control of Sale of Pigs for Slaughtering and of Pork Regulations. Title.

- these regulations, unless the context otherwise "sale" means any disposal under any onerous or gratuitous title; "retailer" means any person who purchases pigs and/or pork for sale by retail; "wholesaler" means any person who purchases pigs and/or pork and sells them to third parties; "Director" means the Director of Agriculture; "distributor" means any person licensed under these Regulations to purchase pork from the government abattoir on behalf of retailers and to transport pork from the government abattoir to retail shops; "manufacturer" means any person who processes pigs and/or pork for disposal to third parties; "producer" means any person who keeps, breeds or fattens pigs for disposal thereof; "purchase" means any acquisition made under any onerous or gratuitous title.
- The Director may from time to time by order in the Gazette fix minimum prices at which wholesalers, retailers, and manufacturers may purchase pigs and/or pork from any producer and specify the conditions under which such prices are to apply. Fixing of minimum prices. 4.
(1)Any sale or purchase of pigs and/or pork by any producer, wholesaler, retailer, distributor or manufacturer shall be accompanied by a duly receipted bill which shall be shown on demand to the Director or to any other person acting on his behalf. Receipts to accompany sales, etc. Amended by: L.N. 76 of 1990.
(2)No such receipted bill shall be destroyed before the lapse of three months from the date of the relative purchase or sale. 5.
(1)No person shall act as a distributor unless he is in possession of a licence issued by the Director authorising him so to act. *These regulations have been repealed by Legal Notice 249 of 2022. Licences. Added by: L.N. 76 of 1990. 2 [ S.L.117.22 CONTROL OF SALE OF PIGS FOR SLAUGHTERING AND PORK
(2)Any such licence shall remain valid for the period for which it is issued or renewed, or until it is withdrawn by the Director, whichever is the earliest date; and if no period is mentioned in the licence or in any renewal thereof it shall, unless it is earlier withdrawn as aforesaid, expire on the 31st day of December of the year of its issue or renewal.
(3)The Director may, in issuing such a licence, attach thereto any condition or conditions as he may deem fit.
(4)The Director shall have the right at any time to withdraw any licence issued under these regulations, and in particular if he is satisfied that any of the conditions of the licence have not been observed.
(5)A licence issued by the Director under these regulations shall not exempt the holder from the requirement of having any other licence under any other law. Fees. Added by: L.N. 76 of 1990. The annual fee leviable for the first issue of a distributor’s licence shall be twelve euro and ninety cents (€12.90), and the annual fee leviable on every renewal of such licence shall be seven euro and seventy cents (€7.70). Penalties. Amended by: L.N. 76 of 1990; L.N. 409 of 2007. 7. Any person who contravenes any of the provisions of these Regulations or of any order made thereunder shall be guilty of an offence and shall be liable (
- a)an a first conviction to a fine (multa) of not less than one hundred and sixteen euros and forty-seven cents (116.47) but not exceeding six hundred and ninetyeight euros and eighty-one cents (698.81), and (
- b)on a second or subsequent conviction, to imprisonment for a term not exceeding three months and to a fine (multa) of not less than two hundred and thirty-two euros and ninety-four cents (232.94) but not exceeding six hundred and ninety-eight euros and eighty-one cents (698.81), and the Court shall, at the instance of the prosecution, suspend for a period not exceeding six months any licence held by the offender in connection with the transaction carried out by him.
