ADMINISTRATIVE REVIEW TRIBUNAL (EMPOWERMENT AND PROCEDURE) [ S.L.117.33 1 SUBSIDIARY LEGISLATION 117.33 ADMINISTRATIVE REVIEW TRIBUNAL (EMPOWERMENT AND PROCEDURE) REGULATIONS 1st July, 2012 LEGAL NOTICE 226 of 2012. 1. The title of these regulations is the Administrative Review Tribunal (Empowerment and Procedure) Regulations. Citation. 2.
(1)The Administrative Review Tribunal shall continue to be competent to hear appeals from the Market Administration Unit in terms of regulation 11
(3)of the Farmers’ Markets Regulations. Empowerment of the Administrative Review Tribunal with regard to the Farmers’ Markets Regulations. S.L. 117.31.
(2)Such appeals shall be heard by the Products and Services Panel of the Administrative Review Tribunal established by regulation 2 of the Administrative Review Tribunal (Establishment of Panels) Regulations.
(3)The Administrative Review Tribunal, in hearing appeals under the Farmers’ Markets Regulations, shall enjoy all the powers conferred on it by the Administrative Justice Act and any appeal l o d g e d b e f o r e t h e s a i d Tr i b u n a l s h a l l b e r e g u l a t e d b y t h e Administrative Justice Act and any subsidiary legislation made thereunder. (4)An appeal shall be lodged from a decision of the Market Administration Unit within twenty days from the notification of that decision to the appellant, provided that appeals lodged before the Administrative Review Tribunal from a decision of the Market Administration Unit before the entry into force of these regulations shall continue to be valid even if they have not been lodged within the said twenty days period. 3.
(1)The Administrative Review Tribunal shall continue to be competent to hear appeals from the Director of Trade in terms of regulation 5
(3)of the Control of Kerosene Regulations.
(2)Such appeals shall be heard by the Products and Services Panel of the Administrative Review Tribunal established by regulation 2 of the Administrative Review Tribunal (Establishment of Panels) Regulations.
(3)The Administrative Review Tribunal, in hearing appeals under the Control of Kerosene Regulations shall enjoy all the powers conferred on it by the Administrative Justice Act and any appeal lodged before the said Tribunal shall be regulated by the Administrative Justice Act and any subsidiary legislation made thereunder.
(4)An appeal shall be lodged from a decision of the Director of Trade within twenty days from the notification of that decision to the appellant, provided that appeals lodged before the Administrative Review Tribunal from a decision of the said Empowerment of the Administrative Review Tribunal with regard to the Control of Kerosene Regulations.
