The title of this Order is the Convention on the Elimination of Double Taxation in connection with the Adjustment of Profits of Associated Enterprises Order. 2. It is hereby declared that (
- a)the arrangements specified in the Convention set out in the Schedule to this Order have been made with a view to affording relief from double taxation in connection with the adjustment of profits of associated enterprises; (
- b)it is expedient that those arrangements should have effect; (
- c)it is expedient that those arrangements be implemented and interpreted, where applicable, in terms of the Code of Conduct Convention adopted by the EU Council on 7th December, 2004 for the effective implementation of the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises (90/436/EEC); (
- d)the Convention set out in the Schedule to this Order has entered into force on the 1st November, 2006. Citation. Article 2 The Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises is hereby amended as follows: 1. in Article 2

Article 3 The Secretary-General of the Council of the European Union shall transmit to the Governments of the Czech Republic, the Republic of Estonia, the Republic of 6 [ S.L.123.99 CONVENTION ON THE ELIMINATION OF DOUBLE TAXATION IN CONNECTION WITH THE ADJUSTMENT OF PROFITS OF ASSOCIATED ENTERPRISES Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic a certified copy of: - the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises, - the Convention on the accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden to the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises, and - the Protocol amending the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises, in the Danish, Dutch, English, French, Finnish, German, Greek, Irish, Italian, Portuguese, Spanish and Swedish languages. The text of the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises, of the Convention on the accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden to the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises, and of the Protocol amending the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises in the Czech, Estonian, Latvian, Lithuanian, Hungarian, Maltese, Polish, Slovenian and Slovakian languages is set out in Annexes I to IX to this Convention. The texts drawn up in the Czech, Estonian, Latvian, Lithuanian, Hungarian, Maltese, Polish, Slovenian and Slovakian languages shall be authentic under the same conditions as the other texts of the Convention on the elimination of double taxation in connection with the adjustment of profits of associated enterprises. Article 4 This Convention shall be subject to ratification, acceptance or approval by the signatory States. The instruments of ratification, acceptance or approval shall be deposited with the Secretary-General of the Council of the European Union. Article 5 This Convention shall enter into force, as between the Contracting States which have ratified, accepted or approved it, on the first day of the third month following the deposit of the last instrument of ratification, acceptance or approval by these States. Article 6 The Secretary-General of the Council of the European Union shall notify all signatory States of: (a) the deposit of each instrument of ratification, acceptance or approval; (b) the dates of entry into force of this Convention between the States that have ratified, accepted or approved it. Article 7 This Convention, drawn up in a single original in the Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Irish, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Slovenian, Slovakian, Spanish and Swedish languages, all twenty-one texts being equally authentic, shall be deposited CONVENTION ON THE ELIMINATION OF DOUBLE TAXATION IN CONNECTION WITH THE ADJUSTMENT OF PROFITS OF ASSOCIATED ENTERPRISES [ S.L.123.99 7 in the archives of the General Secretariat of the Council of the European Union. The Secretary-General shall transmit a certified copy to the Governments of each signatory State. Done at Brussels on the eighth day of December in the year two thousand and four.
