(1)The Commissioner may direct that licences in any one or more classes be issued in booklet form and, in the case of each licence issued in that form, an appropriate entry shall be made thereon in the case of any renewal or transfer of the licence.

(2)If a licence is withdrawn or revoked or ceases otherwise to be operative or is suspended or if its holder is disqualified from holding it by any Court, it shall be returned to the Commissioner. If loss or destruction thereof is alleged, the Commissioner may require the declarant to confirm by means of an affidavit the statement of loss or destruction.

(3)The Commissioner may direct by notice published in the Gazette that licences in any one or more classes shall bear a photograph of the licensee; and in each case in respect of which such a direction obtains, any person who applies for the issue or renewal of a licence shall produce a recent and suitable photograph in duplicate of himself. 9. POLICE LICENCES 4.

(1)All licences issued or renewed by the Commissioner shall be valid from the date of issue or renewal, unless some other date is indicated thereon for such purpose, and all such licences, with the exception of those mentioned in subregulation

(3), shall lapse on the thirty-first day of December of the year in which they are issued or renewed, subject to renewal in accordance with any law or regulation applicable to such licences.

(2)Where any licence is issued or renewed after the first day of January of any year, the period between the date on which or with effect from which such licence is issued or renewed and the thirtyfirst day of December of that year, unless it is otherwise provided in respect thereof in these regulations, shall be deemed to be a full year for the purposes of the payment of any fees prescribed in relation to such licence in the First Schedule to these regulations.

(3)Licences issued or renewed in respect of one or more specified dates or periods shall lapse on the date indicated thereon.

(4)For the purposes of securing that the work of renewing licences will be evenly spread the Commissioner may fix the periods during which licences of any one or more classes are to be renewed, and notice of such periods shall be published in the Gazette.

(5)Any person who renews his licence within the period fixed by the Commissioner under the last preceding subregulation shall not be deemed to have acted without a licence during the interval between the date of expiry of the last licence held by him and the last day of the period fixed by the Commissioner, by reason only that the licence was not renewed before the date of its expiry. (1)The relevant fees specified in the First Schedule or Second Schedule shall be levied by the Commissioner on the issue, renewal or transfer of licences, or in connection therewith: Provided that: (

1. a)on the issue after the expiration of any quarter of a year of a licence, in respect of which a fee of more than one euro and sixteen cents (1.16) is leviable and which is not a sporting licence, the fee leviable in respect of that licence shall be reduced by as many fourths as there are quarters which have expired since the first day of January of the year then current; and (

4. d)the fees leviable in respect of item 17 of the First Schedule shall not leviable where the Director of Public Works or any officer of the department of public works duly authorised in writing by the Director of Pubic Works to act in his behalf, certifies that the deposit of building or other materials is being effected as part of works carried out under contract on behalf of the Government.

(2)On the transfer of a licence from premises in respect of which that licence is operative (hereinafter referred to as ''the new POLICE LICENCES [ S.L.128.01 3 premises'') the rental value of which is higher or lower than that of the former premises, an extra fee shall be levied or, as the case may be, a refund to the licensee shall be allowed in respect of the remaining quarter or quarters of the year for which the licence is valid. Such extra fee or such refund shall be computed in relation to the difference between the full annual fee leviable on the new premises immediately before the transfer is effected.

(5)The Minister responsible for Police may remit or reduce any fee specified in the First Schedule. 6.

(1)Where the fee in respect of the issue or renewal of a licence is based on the rental value of any premises, such rental value shall be ascertained by the Commissioner who, for that purpose, may require the applicant to produce a declaration signed by himself and by the landlord or administrator of the premises, showing the amount of rent payable in respect thereof. (2)It shall be lawful for the Commissioner to require such other evidence or to take such other measures at the expense of the applicant, as he may deem fit, for the purpose of ascertaining such rental value.

(3)If the applicant makes a false declaration, the licence shall not be granted or, as the case may be, renewed. If the falsity becomes known to the Commissioner after the grant or the renewal, the licence shall be avoided. Any refusal of the grant or renewal or the voidance of the licence under this regulation shall be without prejudice to any penalty to which the person making the false declaration may be liable.

(4)Where only a part of any premises is used for the trade or business covered by the licence, the rental value of the premises shall be deemed for the purposes of this regulation to be the rental value of the part so used only and the relative fee shall be computed accordingly. 7.

(1)Applications in connection with licences shall be made on such forms as may be prescribed by the Commissioner from time to time, and they shall be signed or marked by the applicant.

(2)Such application shall indicate (

1. a)the name, surname, father’s name, occupation and place of residence of the applicant, and any other particular at the discretion of the Commissioner relative to applicant’s identity; (
2. b)the object for which the licence is required including all relevant particulars thereof; (
3. c)where a licence is required in respect of acts which are to be performed on specified dates or at specified times or in specified places, the dates, times and places to be covered by the licence; (
4. d)any other detail which may be required under any Applications. 4 [ S.L.128.01 POLICE LICENCES particular law for the time being in force or which may be required by the Commissioner at his discretion. Each licence shall contain any condition under which it is granted. 9.

(1)Licences shall be personal.

(2)Badges which under these Regulations or under any law are issued to or are to be worn by licensees shall be personal and may not be handed over by the licensee to another person nor may they be used by any person other than the licensee. 10. (deleted by Legal Notice 206 of 2009). 11.

(1)Licences in respect of a shop shall be constantly kept on t he prem ises to which they refer and, if t hey are issued otherwise than in booklet form, they shall be enframed and conspicuously displayed in the premises.

(3)Licences other than those referred to in subregulation

(1)shall be constantly carried on his person by the licensee whenever he is performing the act to which the licence refers.

(4)All licences shall be produced on demand for examination by any member of the Police force. Badge. Amended by: G.N. 100 of 1950. 12.

(1)Drivers of motor cars for hire, bus drivers, bus conductors, bus ticket-inspectors, cab drivers, market and parcel post porters, waiters, waitresses, boatmen, artistes, barmaids, shoeblacks and any other persons who by any law or regulation are required to wear a distinctive badge shall, during the time in which they exercise their trade or calling wear such badge which shall be supplied by the Commissioner on payment of the appropriate fee according to these Regulations. Such fee shall be over and above that charged for the licence.

(2)Such badge shall be returned to the Commissioner if the licence is withdrawn or cancelled or if it ceases otherwise to be operative. If loss or destruction thereof is alleged, the Commissioner may require the declarant to confirm his statement of loss or destruction by means of an affidavit. Conditions.

1. The Commissioner may attach to any licence such conditions as he may deem fit, and in the case of each failure to observe such conditions, or any of them, the licensee shall be deemed to have acted without a licence. Age of licensees. Amended by: G.N. 100 of

(1)The Commissioner shall not issue any licence to persons who have not attained the age of eighteen years but he may grant the renewal of a licence to persons who, on the coming into operation of these Regulations, are already in possession of the licence though they have not attained that age. (2)The Commissioner may also grant to persons who, though they have not attained the age of eighteen years, are authorised under the provisions of the Commercial Code to exercise trade, such licences as are connected with the trade exercised by them. 15. Any person who fails to comply with or contravenes any of the provisions contained in regulations 3

(2), 9 or 11, or who knowingly or recklessly gives false information required under regulation 6, or who in applying to the Commissioner according to these Regulations gives information which is false or misleading in any material particular, shall be guilty of an offence under these Regulations and shall be liable to the penalties laid down in the Criminal Code in respect of contraventions.
