OUTDOOR ACTIVITIES WITHIN THE LOCALITY OF MARSAXLOKK (MARSAXLOKK LOCAL COUNCIL) [ S.L.363.176 1 SUBSIDIARY LEGISLATION 363.176 OUTDOOR ACTIVITIES WITHIN THE LOCALITY OF MARSAXLOKK (MARSAXLOKK LOCAL COUNCIL) BYE-LAWS 2nd July, 2013 * LOCAL COUNCIL BYE-LAW 36/3/

  1. The title of these bye-laws is the Outdoor Activities within the Locality of Marsaxlokk (Marsaxlokk Local Council) Bye-Laws.
  2. In these Bye-Laws unless the context otherwise requires - "Act" means the Local Government Act; Citation. Interpretation. Cap.
  3. "activity" means barbecues, camping and caravans; "applicant" means a person applying for a permit in terms of these bye-laws, and includes a company, club or association; "application” means a request made by an applicant to the Council in accordance with these bye-laws, in the form shown in the First Schedule to these bye-laws; "camp" includes any type of camp or encampment be it of textile or canvas or other temporary structure, but excludes shelter built by fishermen on boats or by vendors of the open market of the locality; "caravan" means any vehicle without mechanical power of its own and which is equipped with facilities for sleeping or for the preparation of food; "the Council" means the Marsaxlokk Local Council; "locality" means the locality of Marsaxlokk as defined in the Act; "motor caravan" means any vehicle with mechanical power of its own, registered and licensed with the competent authority, which vehicle is designed for the transport of persons and is equipped with beds or facilities for the preparation of food; "motor vehicle" means any vehicle propelled by mechanical power; "private land" means any immovable property in respect of which a person has title and includes land which is given on encroachment by Government, and not including land which is to be kept and maintained by the Local Council. 3.1 Without prejudice to the provisions of any other law which requires the necessity of a permit from any other authority, no person may erect a camp or place a caravan or motor caravan or organise any activity in any place within the locality including in any beach, without the prior written authorisation of the Council *see bye-law 1.2 of these Bye-laws, as originally promulgated. Prohibition of certain activiities. 2 [ S.L.363.176 OUTDOOR ACTIVITIES WITHIN THE LOCALITY OF MARSAXLOKK (MARSAXLOKK LOCAL COUNCIL) given in terms of these bye-laws. Signs. 3.2 The Council may erect signs to indicate the application of these bye-laws. Exceptions. 3.3 No authorisation in terms of the provisions of these byelaws shall be required: (a) for an activity which takes place on private land; (b) to place an umbrella in any part of the locality. Motor vehicles.
  4. No person may drive or cause a motor vehicle to be parked on any beach without the prior written authorisation of the Council given in terms of these bye-laws. Authorisation. 5.1 The Council may, on an application made by any person, on the form shown in the First Schedule to these bye-laws, grant an authorisation for an activity to be held in the locality: Provided that any authorisation shall be subject to such conditions which the Council may deem fit to impose. Information. 5.2 When submitting an application, an applicant shall provide sufficient information to allow the Council to consider the application and shall in particular indicate the type of activity, the date and time of the activity, the area where the activity shall take place and the number of participants for whom the activity is intended. The applicant should indicate the site where the activity is taking place on a site plan. Cleaning. 5.3 Every applicant shall be responsible for the cleaning of the site following the activity. Fees. 5.4 No application shall be considered unless the applicant pays a fee to the Council of three euro (€3) for a group of up to twenty-five

(25)persons and twenty euro (€20) for a group of not less than twenty-six
(26)and not more than fifty
(50)persons. Revocation. 5.5 Notwithstanding the provisions of these bye-laws, the Council may revoke a permit granted in accordance with these byelaws, at any time, if this would be necessary for public order: Provided that if the Council revokes a permit, the applicant shall be entitled to a refund of the fee paid in respect of the application for such permit; Authorisations for Tal-Magħluq. 5.6 Notwithstanding the foregoing provisions of this bye-law, the Council may, on the application of any person who holds a berth in the area within the locality known as Tal-Magħluq, which application shall be made to the Council on the form shown in the Second Schedule to these bye-laws, give an authorisation to such person to enter with a motor vehicle in the said area. Such authorisation shall be given for a maximum period of one year and shall be in the form shown in the Third Schedule to these bye-laws. No fee may be levied for any such authorisation: Provided that a permit given in accordance with this byelaw, may be renewed upon expiry. Contraventions.

Any person who acts in contravention of any provision of these bye-laws or who provides wrong information in the application or who contravenes any condition imposed in a permit OUTDOOR ACTIVITIES WITHIN THE LOCALITY OF MARSAXLOKK (MARSAXLOKK LOCAL COUNCIL) [ S.L.363.176 granted in terms of these bye-laws shall, on conviction, be liable to a fine (ammenda) of not more than seventy euro (€70) for any such contravention. 3 OUTDOOR ACTIVITIES WITHIN THE LOCALITY OF MARSAXLOKK (MARSAXLOKK LOCAL COUNCIL) [ S.L.363.176 4 FIRST SCHEDULE Application and Permit Form LOCAL GOVERNMENT ACT (CAP. 363) Outdoor Activities within the locality of Marsaxlokk (Marsaxlokk Local Council) Bye-Laws APPLICATION FORM The Executive Secretary Marsaxlokk Local Council Permission is hereby being requested in terms of the above-cited bye-laws for the following activity: Date/s: Type of Activity: Time:  Bar-be-cue;  Camping;  Caravan; Number of attendees: .........................
