BEVERAGES IN GLASS CONTAINERS IN PUBLIC PLACES (BIRŻEBBUĠA LOCAL COUNCIL) [ S.L.363.193 1 SUBSIDIARY LEGISLATION 363.193 BEVERAGES IN GLASS CONTAINERS IN PUBLIC PLACES (BIRŻEBBUĠA LOCAL COUNCIL), BYE-LAWS 3rd January, 2018 LOCAL COUNCIL BYE-LAW 15/01/2018. 1. The title of these Bye-Laws is the Beverages in Glass Containers and Consumption of Alcohol in Public Places (Birżebbuġa Local Council) Bye-Laws. 2. In these Bye-Laws unless the context otherwise requires: "the Act" means the Local Government Act; Citation. Interpretation. Cap. 363. "Council" means the Birżebbuġa Local Council; "glass container" includes glass bottles, glasses and, or any other glass containers intended for the serving of any beverages; "locality" means the locality of Birżebbuġa as delineated in the Act; "public place" means all the streets including pavements, squares public gardens, and playing fields, but excluding coast and beaches within the Birżebbuġa locality. 3. No person is permitted to loiter in any public place holding or having on his person any glass container. Prohibition of loitering with glass containers in public places. 4. No person is permitted to carry in any public place alcohol or any other drinks in glass containers other than in a sealed unopened container. Prohibition of carrying of alcohol in public places. 5. No person is permitted to consume beverages or alcohol in glass containers in public areas, unless during an organised activity authorised by the Birżebbuġa Local Council. Prohibition of consumption of alcohol or beverages in public spaces. 6. Any commercial establishment situated in the locality selling beverages shall: Commercial establishments. (

  1. a)affix a notice in Maltese as well as in English as shown in Schedule, which notice shall be placed in a conspicuous place and be easily legible by the patrons of such commercial establishment; and (
  2. b)provide containers made of a material other than glass if such beverage is to be consumed in any public place. 7. Any person who is in breach of any of the provisions of Penalties. 2 [ S.L.363.193 BEVERAGES IN GLASS CONTAINERS IN PUBLIC PLACES (BIRŻEBBUĠA LOCAL COUNCIL) these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of sixty five euro (€65) for such contravention, and to a further fine (ammenda) of ten euro (€10) for every day during which any of the provisions of these Bye-Laws is breached.
