- The title of these Bye-Laws is Trailers and other Encumbering Objects in the Locality of Birżebbuga (Birżebbuġa Local Council) Bye-Laws.
- Citation. In these Bye-Laws unless the context otherwise requires: Interpretation. "the Act" means the Local Government Act; Cap.
- "Council" means the Birżebbuġa Local Council; "encumbering object" means any object which although may not necessary be considered as waste, causes obstruction or inconvenience on any part of the locality or any other object of a size or quantity or accumulation, as taken by itself, causes a nuisance, or which may lead to deterioration or defacement of a public place; "locality" means the locality of Birżebbuġa as defined in the Act; "trailer" means any vehicle without mechanical power of its own designed to be drawn by a motor vehicle and intended for the purpose of the carriage of boats and other sea craft or for the conveyance of goods. 3.
- No person shall in any part of the locality, place or leave a trailer or any other encumbering object, including any skip which is not destined for domestic use, and no person shall, whether for a temporary period or otherwise, leave unattended any trailer or park it, loaded or not in any part of the locality save in an area that is designated by the Council as a site for the parking of trailers or on private land, without the prior authorisation of the Council. 3.
- No part of these Bye-Laws shall be construed as restricting the transit of trailers within the locality. 3.
- Notwithstanding the provisions of these Bye-Laws, any person may place any trailer in any part of the locality to unload therefrom any boat or other sea-craft: Provided that such trailer shall be removed immediately once the objects that would be conveyed thereon would be removed. - Any trailer or encumbering object which passes through or is parked within the locality of Birżebbuġa has to have a means of clear identification which leads to the person responsible for the same trailer or encumbering object. Applicability. 5.
- These Bye-Laws may not be applicable to a site or sites identified and approved by the Council for this purpose and as long as conditions imposed by the Council are observed. 5.
- Sites identified by the Council can only be used after an application has been filed to the Council and the same Council approves such application. Fishermen’s and boats zones.
- Sites identified as fishermen’s and boat’s zone should only be used as granted in relative permits and according to the provisions of Maltese laws and any other use shall be subject to these Bye-Laws. Penalties.
- Any person who in one way or another acts in contravention of any provision of these Bye-Laws, shall on conviction be liable to a fine (ammenda) of seventy euro (€70) for such contravention together with a further fine (ammenda) of ten euro (€10) for each day during which such contravention of these Bye-Laws would have ensued. Removal.
- The penalty referred to in bye-law 4 shall be without prejudice to any right of action which the Council or any other authority may take to remove, deposit, or dispose of any trailer or any encumbering object or any accessory thereto in terms of the provisions of the Clamping and Removal of Motor Vehicles and Encumbering Objects Regulations, or any other law, and without prejudice to any other penalty or fine (ammenda) which may be imposed under any other law.
