OUTDOOR ACTIVITIES IN THE LOCALITY OF ILQRENDI (IL-QRENDI LOCAL COUNCIL) [ S.L. 363.212 SUBSIDIARY LEGISLATION 363.212 OUTDOOR ACTIVITIES IN THE LOCALITY OF ILQRENDI (IL-QRENDI LOCAL COUNCIL) BYE-LAWS 2nd April, 2019 LOCAL COUNCIL BYE-LAW 49/04/2019 1. The title of these Bye-Laws is the Outdoor Activities within the locality of Il-Qrendi (Il-Qrendi Local Council) Bye- Laws. 2. Citation. In these Bye-Laws unless the context otherwise requires: Interpretation. "the Act" means the Local Government Act; Cap. 363 "activity" means all outdoor activities in terms of these Bye-Laws and includes all activities of recreation, entertainment, tombola, fête and barbecue; "applicant" means any person who applies for a permit according to these Bye-Laws and includes companies, clubs and groups; "application" means a request made by an applicant to the Council in accordance with these Bye-Laws in the form shown in the Second Schedule to these Bye-Laws; "Council" means the Il-Qrendi Local Council; "locality" means the locality of Qrendi as identified under the Act; "mechanical vehicle" means any vehicle propelled by mechanical power; "private land" means any immoveable property in respect of which a person has title and includes land which is given on encroachment by Government. 3. The Council may erect signs to indicate the application of these Bye-Laws. Signs. 4. No authorisation in terms of the provisions of these ByeLaws shall be required for an activity which takes place on private land. Exceptions. 5. The Local Council may, on an application made by any person, on the form shown in the Second Schedule to these Bye-Laws, grant authorisation for any activity to be held in the locality: Permit. Provided that any authorisation shall be subject to such conditions which the Council may deem fit to impose. 1 2 OUTDOOR ACTIVITIES IN THE LOCALITY OF ILQRENDI (IL-QRENDI LOCAL COUNCIL) [ S.L. 363.212 Information. 6. When submitting an application, an applicant shall provide sufficient information to allow the Council to consider the application and shall in particular indicate the type of activity, the date and time of the activity, the area where the activity shall take place and the number of participants for whom the activity is intended. The applicant shall indicate the site where the activity is taking place on a site plan. Fees. 7.1 No application can be considered unless the applicant pays a fee to the Council in terms of the First Schedule to these ByeLaws whenever an activity is to be held in virtue of which an authorisation is requested. 7.2 The fees shall be as outlined in the First Schedule: Provided that the highest fee for an event shall be of five hundred fifty euro (€550). Cooking. 8.1. Cooking shall be prohibited (
- a)in Misrah il-Maqluba; (
- b)on St. Matthew’s Chapel parvis, or in the square opposite the Chapel with white floorings; (
- c)in the area where benches are situated opposite St. Matthew’s Chapel; and (
- d)square. on the adjacent pavement or in the Chapel’s 8.2. Provided that cooking activities are only permissible directed by the Qrendi Local Council: 8.3. In any other activity held outdoors other than in Misraħ il-Maqluba, the applicant shall provide all information as to how and where the cooking is to be done and the measures to be taken to keep the area clean. Cleaning. 9. The applicant shall ensure that as soon as the event is over, the area is cleaned up. The cleaning shall consist in the sweeping and collection of waste accumulated during the event. All waste shall be placed on a plastic or canvas sheet, so that it does not soil the pavement on where it is placed. Music. 10. In any outdoor activity, music shall stop by midnight (00:00), unless instructions are given by the Police authorities to stop earlier. Instructions issued by the Police authorities as regards to noise intensity are strictly to be abided with. No music shall be played after midnight (00:00). Revocation. 11. Notwithstanding the provisions of these Bye-Laws, the OUTDOOR ACTIVITIES IN THE LOCALITY OF ILQRENDI (IL-QRENDI LOCAL COUNCIL) [ S.L. 363.212 Council may at any time revoke an authorisation issued in terms of these Bye-Laws, if it is necessary for reasons of public order. Provided that if the Council revokes an authorisation, the applicant shall have the right to the refund of the fees paid when submitting the application. 12. Any person who acts in contravention of any provision of these Bye-Laws, or gives wrong information when submitting the application, or acts in contravention of any condition of the permit issued in terms of these Bye-Laws, shall on conviction be liable to a fine (ammenda) of not more than seventy euro (€70) for such contravention. FIRST SCHEDULE (Bye-Law 4.3) 1. Whenever a wedding is held and a small reception (champagne party) is held right after the wedding in Misraħ il-Maqluba, particularly the areas of the parvis of St. Matthew’s Chapel and the area of the Malta Tourism Authority’s new project, a fee of fifty euro (€50) shall be paid by the applicant. 2. Whenever Misraħ il-Maqluba is used in any other instance such as receptions, lunches or any other forms of entertainment, the applicant shall pay a fee which shall be dependent on the number of people to attend. The fees shall be: (
- i)up to 100 persons - €150 (
- ii)between 101 & 200 persons - €350 (iii) more than 200 persons - €550 3. Whenever Misraħ il-Maqluba is used by the Qrendi organisations for village fêtes, receptions and any other form of entertainment, no fees shall be paid, provided that they clean the area when the event is over. 4. The applicant shall make all necessary arrangements and ensure that all litter and garbage is collected and disposed of immediately as is required by law. 5. The applicant shall be held responsible for any damage caused to public property and property belonging to third parties as a consequence of the said activity.
