- The title of these Bye-Laws is the Animal-drawn Carriages (L-Imdina (Città Nobile) Local Council) Bye-Laws.
- Citation. In these Bye-Laws unless the context otherwise requires: Interpretation. "the Act" means the Local Government Act; Cap.
- "animal-drawn carriage" means a karozzin and any animal-drawn vehicle; "Authority" shall have the same meaning as that assigned to it by regulation 2 of the Use of Animals and Animal-drawn Vehicles on the Road Regulations; S.L. 499.
- "Council" means the Imdina (Città Nobile) Local Council; "dawn" means the first appearance of light in the sky before sunrise; "dusk" means the time which occurs exactly after sunset when it is not yet dark; "locality" means the Imdina locality as shown in the Second Schedule to the Act; "parking stand" means a parking space designated for the parking of horse-drawn carriages; "seniority" means the amount of years which a driver of an animal-drawn carriage has been operating with a valid permit issued by the Authority; "year" means a period of three hundred and sixty-five
(365)days.
- Horse-drawn carriages used for hire or in compensation may circulate within Imdina at all times provided the animal’s hooves and the carriage wheels are fitted with rubber covers: Provided that the Council may issue a permit for an animal-drawn carriage not fitted with rubber covered wheels to access Imdina on a special occasion. Circulation of horse-drawn carriages and the use of rubber covers on hooves and carriage wheels. 2 [ S.L. 363.214 ANIMAL-DRAWN CARRIAGES (L-IMDINA (CITTÀ NOBILE) LOCAL COUNCIL) Penalties.
- Any person who is found guilty of contravening Bye-Law 3 shall, on conviction, be liable to a fine (ammenda) of sixty euro (€60). Permit required.
- Without prejudice to any other Bye-Laws, an animaldrawn carriage shall only enter the locality upon having obtained a valid permit from the Council: S.L. 499.
- Provided that such permit shall only be issued if the driver of the animal-drawn carriage is in possession of a valid licence X in accordance to the Use of Animals and Animal-drawn Vehicles on the Road Regulations: Provided further that all the other conditions of this ByeLaw are fulfilled. - In furtherance to Bye-Law 5, the Council may issue two
(2)types of permits to drivers of animal-drawn carriages: (
- a)a one-day permit, for the price of one hundred euro (€100) which may be issued at the discretion of the Council; (
- b)a yearly permit, for the price of three hundred euro (€300) which may be issued to a maximum of twelve
(12)drivers per year: Provided that this shall apply until and unless the Council decides otherwise: Provided further that the Council may, by resolution, amend the number of licences issued in terms of Bye-Law 6(b) from time to time, as may be necessary. Method of awarding yearly licence.
- In awarding the yearly permit referred to in Bye-Law 6(b), the Council shall issue a call for applications and shall grant a permit to drivers on a seniority basis until all permits are granted. Time of service.
- Animal-drawn carriages shall only operate in the locality from dawn until dusk. Maximum amount of carriages. 9.
(1)It shall not be lawful for there to be more than six
(6)animal-drawn carriages being driven within the locality at any one time.
(2)It shall be permissible however to have six
(6)driven carriages and six
(6)carriages alighting or mounting passengers at the parking stand. Failure to observe regulation 12 of S.L. 499.
- Drivers of animal-drawn carriages who fail to observe regulation 12 of the Use of Animals and Animal-drawn Vehicles on the Road Regulations may have their permit revoked at the discretion of the Council.
