CARAVANS IN THE LOCALITY OF MARSASKALA (MARSASKALA LOCAL COUNCIL) [ S.L. 363.220 SUBSIDIARY LEGISLATION 363.220 CARAVANS IN THE LOCALITY OF MARSASKALA (MARSASKALA LOCAL COUNCIL) BYE-LAWS 10th July, 2020 LOCAL COUNCIL BYE-LAW 35/01/2020. 1. The title of these Bye-Laws is Caravans in the Locality of Marsaskala (Marsaskala Local Council) Bye-Laws. Citation. 2. requires: In these Bye-Laws, unless the context otherwise Interpretation. "the Act" means the Local Government Act; Cap. 363. "camp" means that it includes any type of tent made of fabric or canvas or any other textile material, and any type of camp or any other temporary structure, but excludes umbrellas; "camper" means any vehicle propelled by its own mechanical power and designed for the transport of persons, and which is equipped with beds and, or with facilities for the preparation of food; "caravan" means any vehicle, without mechanical power of its own, designed for the transport of persons, and which is equipped with beds and, or with facilities for the preparation of food; "the Council" means the Marsaskala Local Council; "gazebo" means that it includes all types of roofed structures made of fabric or canvas, usually but not necessarily with open sides, providing a shady place, but excludes umbrellas; "locality" means the locality of Marsaskala as defined in the Act. 3.1 Save as provided in the following Bye-Laws, no person may, in any place within the locality, including a beach, place, leave, erect, or park, temporarily or otherwise a camper, caravan, camp or gazebo. 3.2 A person may place a camper provided all the following conditions are observed: (
- a)that it is parked within a permitted parking space as permitted by traffic regulations, but not in the zone known as St. Thomas Bay as depicted in the Schedule in Site Plan A, as well as Żonqor as depicted in the Schedule in Site Plan B; Prohibition. 1 2 [ S.L. 363.220 CARAVANS IN THE LOCALITY OF MARSASKALA (MARSASKALA LOCAL COUNCIL) (
- b)that it does not cause a nuisance, inconvenience or obstacle, and that it does not lead to deterioration or defacement of a public place; and (
- c)that no other object is placed or left on the pavement or in the street or around the camper, even if said object is accessory to the camper. 3.3 A person may erect a camp or gazebo provided all the following conditions are observed: (
- a)that the camp or gazebo is erected on a beach or close to the foreshore, but not on salt pans, and not on a pavement, street or any other public place; (
- b)that it does not cause a nuisance, inconvenience or obstacle, and that it does not lead to deterioration or defacement of a public place; (
- c)that no object is placed or left on the pavement or in the street or around the camp or gazebo, even if said object is accessory to the camp or gazebo, except within a space of one and a half (1.5) metres around the camp or gazebo; and (
- d)that it is dismantled from dusk until dawn the following day. Penalties. 4. Any person who contravenes any provision of these ByeLaws, shall on, conviction, be liable to a fine (ammenda) of two hundred euro (€200) for such contravention together with a further ammenda of fifty euro (€50) for each day during which such contravention of these Bye-laws would have ensued. Removal. 5. The penalties referred to in Bye-Law 4 shall be without prejudice to any other right of action which the Council or any other authority may take to remove, store or dispose of any camp, camper, caravan or gazebo or any other object that is an accessory thereto in terms of the provisions of the Clamping and Removal of Motor Vehicles and Encumbering Objects Regulations, or any other law, and without prejudice to any other penalty or fine (ammenda) which may be imposed under any other law.
