BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES (IMSIDA LOCAL COUNCIL) [ S.L. 363.222 1 SUBSIDIARY LEGISLATION 363.222 BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES (IMSIDA LOCAL COUNCIL) BYE-LAWS 6th November, 2020 LOCAL COUNCIL BYE-LAW 41/05/

  1. The title of these bye-laws is the Beverages in Glass Containers and Consumption of Alcohol in Public Places (Imsida Local Council) Bye-Laws.
  2. In these bye-laws, unless the context otherwise requires: "Act" means the Local Government Act; Citation. Interpretation. Cap.
  3. "bin" means any recipient that may be closed by means of a lid, supplied by or under the authority of the Council and placed in a public place within the Imsida locality boundary, for the deposit of refuse; "Council" means the Imsida Local Council; "designated areas" means those areas designated by the competent authorities for the placement of tables and chairs exclusively for the consumption of food and beverages; "glass container" includes glass bottles, glasses and or any other glass container intended for the serving of any beverages; "locality" means Imsida as shown in the Second Schedule to the Act; "public place" means the streets, squares, belvederes, open spaces and gardens within the Imsida locality.
  4. No one is permitted to loiter in any public place holding or having on his person any glass container. Prohibition of loitering with glass containers.
  5. No person is permitted to carry alcoholic drinks in public places other than in a sealed container. Prohibition of carrying of alcohol in public places.
  6. No person is permitted to consume alcohol in the streets or public places other than in the designated areas. Prohibition of consumption of alcohol in public places.
  7. Any commercial establishment situated within any street or pubic place selling beverages, shall: Notice and provision of containers. (a) affix a notice in Maltese as well as in English as 2 [ S.L. 363.222 BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES (IMSIDA LOCAL COUNCIL) shown in the First Schedule, which shall be placed in a conspicuous place and be easily legible by the patrons of such commercial establishment; (b) provide a container that is made from a material other than glass, if that drink is intended to be consumed in a public place; and (c) ascertain the regular cleaning of the area within five

(5)metres of the commercial establishment and collection of glass containers together with collection of refuse from bins in the same distance. Prohibition of use of plastic.
  1. Any use of plastic is prohibited and instead biodegradable containers are to be used. Exemption of the Activities Requiring Permit by Local Councils Regulations. S.L.
  2. 8.1 These bye-laws shall apply without prejudice to the provisions of the Activities requiring permit by Local Councils Regulations. Penalties.
  3. Any person who is in breach of any of the provisions of these bye-laws shall, on conviction, be liable to a fine (ammenda) of seventy euro (€70) for such contravention, and to a further fine (ammenda) of ten euro (€10) for every day during which any of the provisions of these bye-laws is breached. 8.2 Bye-laws 4, 5 and paragraph (a) of bye-law 6 shall not apply in the circumstances exhaustively listed in the Second Schedule.   4. In designated public areas, during the period beginning from and ending after the celebration of the titular feast of St. Joseph in Imsida.
  5. Activities permitted by the Imsida Local Council as per Activities Requiring Permit by Local Councils Regulations.
  6. Tables and chairs permit issued by the Imsida Local Council as per Activities Requiring Permit by Local Councils Regulations.
  7. Any activity permit issued by the Commissioner of Police in designated areas.
  8. Licensed establishments operating within the perimeter of outdoor extensions duly approved by the Planning Authority and the Malta Tourism Authority.
  9. Other occasions or circumstances which may be exempted by the Council from time to time, provided any such exemption is to be published in the Gazette at least
