CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES (SAN PAWL IL-BAĦAR LOCAL COUNCIL) [ S.L. 363.228 SUBSIDIARY LEGISLATION 363.228 CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES (SAN PAWL IL-BAĦAR LOCAL COUNCIL) BYE-LAWS 7th May, 2021 LOCAL COUNCIL BYE-LAW 55/05/

2. The title of these Bye-Laws is the Consumption of Alcoholic Beverages in Public Places (San Pawl il-Baħar Local Council) Bye-Laws. Citation.
3. requires: Interpretation. In these Bye-Laws, unless the context otherwise "Act" means the Local Government Act; Cap.
4. "containers of alcoholic beverages" includes bottles, glasses, cans, and any other container intended intended for the serving of any beverages; "Council" means the San Pawl il-Baħar Local Council; "locality" means the locality of San Pawl il-Baħar as shown in the Second Schedule to the Act; "mentioned spaces" covers those spaces mentioned by the competent authorities to occupy with tables and chairs to serve and consume food and beverages; "public space" means the streets, pavements, open spaces, squares, gardens, shores and promenade within the locality but excluding non-urban open spaces which are not in the vicinity of residential areas.
5. No one is permitted to loiter in any public place holding or having on his person any alcoholic beverages. Prohibition of loitering with alcoholic beverages.
6. No one is permitted to consume alcohol in public places other than in the designated areas. Prohibition of consumption of alcohol in public places.
7. Any commercial establishment that operates in the locality of San Pawl il-Baħar, selling beverages shall affix a notice in Maltese as well as in English as shown in the Schedule, which shall be provided from the local council, which notice shall be placed in a conspicuous place and be easily legible by the patrons of such Notice and provision of containers. 1 2 [ S.L. 363.228 CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES (SAN PAWL IL-BAĦAR LOCAL COUNCIL) commercial establishment. Anyone organising an activity in San Pawl il-Baħar has to conform with these Bye-Laws and obtain the necessary permits from the San Pawl il-Baħar Local Council. Penalties. 6.1 Any owner of an establishment who is in breach of any of the provisions of these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of seventy euro (€70) for each contravention, and to a further fine (ammenda) of fifteen euro (€15) for every day during which any of the provisions of these Bye-Laws is breached. 6.2 Any person who is in breach of any of the provisions of these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of seventy euro (€70). Exemption.
8. The San Pawl il-Baħar Local Council on special occasions shall have the right to give exemptions to these Bye-Laws, which are to be given in writing after an application is filed citing the conditions of these Bye-laws to be exempted in such special occasions. THE CONSUMPTION OF ALCOHOLIC BEVERAGES IS PROHIBITED BY LAW IN PUBLIC PLACES AS DEFINED IN THE BYE-LAWS THE CARRYING OF ALCOHOL IN THE STREETS OTHER THAN IN SEALED UNOPENED CONTAINERS IS PROHIBITED BY LAW.
