- The title of these Bye-Laws is the Beverages in Glass Containers and Consumption of Alcohol in Public Places (Għarb Local Council) Bye-Laws. Citation.
- requires: Interpretation. In these Bye-Laws, unless the context otherwise "Act" means the Local Government Act; Cap.
- "Council" means the Għarb Local Council; "designated areas" means those areas designated by the competent authorities for the placement of tables and chairs exclusively for the consumption of food and beverages; "glass container" includes glass bottles, glasses and or any other glass container intended for the serving of food and beverages; "locality" means the locality of Għarb as delineated in the Second Schedule to the Act; "public space" means the streets, squares, belvederes, open space and gardens within the Għarb locality excluding designated areas.
- No one is permitted to loiter in any public place holding or having on his person any glass container. Prohibition of loitering with glass containers.
- No person is permitted to carry alcohol in public places other than in a sealed unopened container. Prohibition of carrying of alcohol in public places.
- No person is permitted to consume alcohol in the streets or in public places other than in the designated areas. Prohibition of consumption of alcohol in public places.
- Any commercial establishment situated within any street or public place selling beverages shall,: Notice and provision of containers. (a) affix a notice in Maltese as well as in English as shown in the Schedule to these Bye-Laws, which notice shall be 2 [ S.L. 363.229 BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES (GĦARB LOCAL COUNCIL) placed in a conspicuous place and be easily legible by the patrons of such commercial establishment; (b) provide containers made of a material other than glass if such beverage is to be consumed in any public place; and (c) ascertain the regular cleaning of the area within five
(5)meters of the commercial establishment and collection of refuse from bins in the same distance. Penalties.
- Any person who is in breach of any of the provisions of these Bye-Laws shall, on conviction, be liable to a fine (ammenda) of seventy euro (€70) for such contravention, and to a further fine (ammenda) of fifteen euro (€15), for every day during which any of the provision of these Bye-Laws is breached. - THE CONSUMPTION OF BEVERAGES IN GLASS CONTAINERS OUTDOORS IS PROHIBITED BY LAW.
- THE CONSUMPTION OF ALCOHOL IN PUBLIC PLACES IS PROHIBITED BY LAW.
- THE CARRYING OF ALCOHOL IN PUBLIC PLACES OTHER THAN IN SEALED UNOPENED CONTAINERS IS PROHIBITED BY LAW.
