- The title of these bye-laws is the Beverages in Glass Containers and Consumption of Alcohol in Public Places, and Catering Establishments in Outdoor Spaces (Żebbuġ Gozo Local Council) ByeLaws.
- Citation. In these bye-laws, unless the context otherwise requires: Interpretation. "Act" means the Local Government Act; Cap.
- "alcoholic beverage container" includes bottles, cans, glasses and, or any other container intended to serve beverages; "ashtrays" means receptables approved for the disposal of waste relating to cigarettes including but not limited to cigarette butts and placed in a public place; "bin" means any recipient that may be closed by means of a lid, supplied by the Local Council, and placed in a public space within the precincts of the locality of Marsalforn (Żebbuġ) Gozo, for the deposit of litter; "Council" means the Żebbuġ (Gozo) Local Council; "designated areas" means those areas designated by the competent authorities for the placement of tables and chairs exclusively for the consumption of food and beverages; "locality" means the locality of Marsalforn (Żebbuġ) Gozo as indicated in the Second Schedule to the Act; "loiter" or "loitering" means the persistent presence of any person for no particular reason, excluding persons who are carrying out a duty in a public place; "public place" means and includes the streets, alleys, pavements, squares, promenades, gardens, parks, belvederes, shores and all the public open spaces within the precincts of 1 2 [ S.L. 363.237 BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES, AND CATERING ESTABLISHMENTS IN OUTDOOR SPACES (ŻEBBUĠ GOZO LOCAL COUNCIL) Marsalforn (Żebbuġ) Gozo. Prohibition of loitering with glass containers and with alcoholic beverages. 3.
- No person shall loiter in any public place whilst holding in his hands, carrying or having in his possession or on his person any glass container. 3.
- No person shall loiter in any public place whilst holding in his hands, carrying or have in his possession or on his person alcoholic beverages. Prohibition of carrying of alcohol in public places.
- No person shall carry alcoholic beverages in a public place other than in a sealed or closed container. Prohibition of consumption of alcohol in public places.
- No person is permitted to consume alcohol in the streets or public places other than in the designated areas. Notice and provision of containers.
- Any commercial or catering establishment operating within the precincts of the locality which sells or serves beverages, shall: (a) affix a notice in Maltese as well as in English as indicated in the Schedule, which shall be provided by the Council, and such notice shall be placed in a conspicuous place that can be easily noticed and read by the customers and patrons of such commercial establishment; (b) provide containers which are made from a material other than glass, if that drink is intended to be consumed in a public place; and (c) ascertain the regular cleaning of the area within five
(5)metres of the commercial establishment and collection of glass containers together with collection of waste from bins in the same distance; (d) any person organising an activity in the precincts of Marsalforn (Żebbuġ) Gozo shall conform with these byelaws and obtain the necessary permits from the Council. Cleaning and clearing. 7.
- Every catering establishment shall be responsible for the cleaning and clearing of any waste deposited in the outside space of their establishment by their customers or by the establishments themselves. 7.
- Every catering establishment servicing clientele in an outdoor space shall put an adequate number of ashtrays in their outside area and shall be responsible for the cleaning and clearing of the ashtrays as well as the appropriate disposal of waste placed in BEVERAGES IN GLASS CONTAINERS AND CONSUMPTION OF ALCOHOL IN PUBLIC PLACES, AND CATERING ESTABLISHMENTS IN OUTDOOR SPACES (ŻEBBUĠ GOZO LOCAL COUNCIL) [ S.L. 363.237 3 ashtrays. 7.
- Every catering establishment shall ensure that at no time shall ashtrays overflow or be at risk of overflowing.
- Any use of plastic shall be prohibited and instead biodegradable containers are to be used. Prohibition of use of plastic.
- These bye-laws shall apply without prejudice to the provisions of the Activities requiring permit by Local Councils Regulations. Exemption of the Activities Requiring Permit by Local Councils Regulations. S.L. 441.
- Any person, owner or operator of a commercial or catering establishment, as the case may be, who is in breach of any of the provisions of these bye-laws shall, on conviction, be liable to a fine (ammenda) of seventy euro (€70) for such contravention, and to a further fine (ammenda) of fifteen euro (€15) for each day during which any of the provisions of these bye-laws is breached. THE CONSUMPTION OF ALCOHOLIC BEVERAGES IS PROHIBITED BY LAW IN PUBLIC PLACES AS DEFINED IN THE BYE-LAWS. THE CARRYING OF ALCOHOL AND BEVERAGES IN GLASS CONTAINERS IN PUBLIC PLACES OTHER THAN IN SEALED AND CLOSED CONTAINERS IS PROHIBITED BY LAW.
