LOCAL COUNCILS (DELEGATION OF FUNCTION) (BUS SHELTERS) [ S.L.363.79 1 SUBSIDIARY LEGISLATION 363.79 LOCAL COUNCILS (DELEGATION OF FUNCTION) (BUS SHELTERS) ORDER 1st December, 2001 LEGAL NOTICE 292 of 2001, as amended by Act XV of

  1. The title of this Order is the Local Councils (Delegation of Function) (Bus Shelters) Order.
  2. In this Order unless the context otherwise requires - "Act" means the Local Government Act; "bus shelter" means any roofed structure, sited near a location designated by the competent authorities for the collection of passengers by motor buses that are employed as public transport vehicles, an d whi ch struct ure is i ntended prim aril y fo r t he convenience and protection of such passengers; Citation.   3. Cap.
  4. "bus stop" means any location designated by the Authority for Transport in Malta for the purpose of serving as a bus stop for the purposes of the public transport; "Council" means a Local Council established under the Act; "locality" has the same meaning assigned to it by the Act; "Authority for Transport in Malta" means the MAuthority for Transport in Malta as established in the Authority for Transport in Malta Act; Cap.
  5. "Minister" means the Minister responsible for Local Government.
  6. In terms of article 33

(1)(
  1. n)of the Act, the Minister has directed that: Delegated functions. (
  2. a)the erection and replacement of all new bus shelters, and (
  3. b)the maintenance of all bus shelters, shall be a function which is hereby delegated to each Local Council in relation to its locality. 4. In terms of article 33
(2)of the Act, the responsibility for arterial and distributor roads and the items shown in the Schedule is being delegated to Local Councils solely for the purposes provided for in article 3 of this Order: Responsibility for arterial and distributor roads, etc. Provided that the delegation for the arterial and distributor roads mentioned above should not exclude concurrent central government authority to replace bus shelters as necessary when required.
  1. Bus shelters shall be installed or maintained, as the case may be, strictly in conformity with the specifications established by the Authority for Transport in Malta. Specifications. Amended by: XV. 2009.

  3. Local Councils shall obtain all necessary permits from the Planning Authority. Replacement of structure of bus shelter. Amended by: XV. 2009.

In the case of replacement of a bus shelter in existence prior to the publication of this Order, a Council shall give notice in writing of its intention to the Authority for Transport in Malta of at least ten days, and the Authority for Transport in Malta shall advise the Council in writing whether the structure to be replaced is to be disposed of by the Council itself or by the Authority for Transport in Malta: Provided that if the Authority for Transport in Malta fails to advise the Council as provided in this article, such structure shall become the property of the Council and the Council shall, at its expense, have the right to dispose of such structure as it deems fit.
