[ S.L.409.05 FEES (TOURISM) 1 SUBSIDIARY LEGISLATION 409.05 FEES (TOURISM) REGULATIONS 31st May, 2002 LEGAL NOTICE 125 of 2002, as amended by Legal Notices 184 of 2002, 100 and 157 of 2003, 87and 284 of 2005, 426 of 2007, and 4 and 148 of 2013. 1. The title of these regulations is the Fees (Tourism) Regulations. Citation. 2.

  2. In these regulations, unless the context otherwise "the Act" means the Malta Travel and Tourism Services Act; "applicable rate" means the fee charged by the Authority to tourism operations as appearing in the First and Second Schedules; "tourist areas" and "non-tourist areas" mean the areas specified as such in the Second Schedule; "tour operator representative" means an incoming tourism agent acting as a representative of a tour operator for leisure travel.
(2)Words and expressions used in these regulations and which are also used in the Act shall, unless the context otherwise requires, have the same meaning as in the Act.
  1. There shall be payable to the Authority for the issue, transfer or renewal of any licence or certificate issued under the Act, the relative fee as specified in the First Schedule: Licence fees. Amended by: L.N. 148 of
  2. Provided that on the issue or renewal of a licence to run or operate an accommodation or catering establishment in Gozo, the licensee shall pay seventy-five percent of the licences fees as specified in Parts I, II, III, IV and VI of the First Schedule. 4.
(1)The fee payable for a licence issued by the Authority under the Act shall be deemed to be due on the first day of January of each year. Due dates of licence fees.
(2)The provisions of subregulation
(1)shall not apply in relation to a house on lease to tourists, in which case the duration of the licence shall be for a period of twelve months commencing on the date when the lease agreement is made. New licences issued after midyear. 5.
(1)In addition to the above-mentioned fees, there shall be payable to the Authority, by the persons referred to in the First Column of the Second Schedule, the annual contribution set out in the Second Column of that Schedule in relation to those persons and to matters connected with tourism and as specified therein: Contributions. Amended by: L.N. 87 of 2005. Provided that if the amount of the contribution due to the Authority is paid within three months from the date when the payment of such amount is due, the applicable rate shall be reduced by twenty per cent (20%): 2 [ S.L.409.05 FEES (TOURISM) Provided further that this reduction in the applicable rates shall not apply to contributions in respect of the Gozo Sea Passenger Service (Item N), Transport Facilities (Item P) and Fees due for the Processing of Applications for Tourism Operations (Item U) of the Second Schedule.
(2)The said contributions shall, unless otherwise established by the Authority, be deemed to be due on the same date as the above-mentioned licence fees in accordance with regulation
  1. Fees and contributions due after the 1st July of any year.
  2. Whenever a new licence in respect of any tourism operation is due to the Authority after the first day of July of any y e a r, t h e f e e f o r s u c h a l i c e n c e a n d t h e a m o u n t f o r s u c h contribution shall be at the rate of one half the annual amount applicable for such licence and contribution. Fees due on reclassification. 7.
(1)Whenever, during the validity of a licence, a tourism operation is reclassified in a class superior or inferior to the one shown on the licence, the Authority shall, on payment of the r e la t iv e f e e an d n e w c o nt r i b ut i o n b y th e t o u r is m op e ra t or, substitute such licence with a new licence denoting the new classification.
(2)In any case falling under the provisions of subregulation
(1), there shall be deducted from the relative amounts payable in respect of the new licence and new contribution the fee paid for the former licence and amount paid for the former contribution: Provided that, where a reclassification as referred to in subregulation
(1)is made after the first day of July, the deduction to be allowed shall be equal to one half of the fee paid in respect of the former licence. Difference in fees as a result of increased capacity. 8. Whenever the accommodation of a hotel, tourist village, aparthotel, hostel, guesthouse or holiday premises is increased, with the approval of the Authority and according to the fee specified in these regulations, such increase carries a higher rate of the licence fee and contribution, there shall be paid by the licensee of the above-mentioned tourism operation, the difference between the higher fee and the fee paid for the licence and contribution: Provided that when the provisions of this regulation become applicable in respect of any such licence and contribution at any time after the first day of July of any year, the amount payable shall be equal to one half of such difference. Deduction of temporary licence fee. 9. There shall be deducted from the licence fee payable following a first application, the fee, if any, paid for a temporary licence issued during the same year. Fees on appeal. 10. When an appeal is entered under the provision of article 13 of the Act, the appellant shall pay to the Tourism Appeals Board the relative fee as set out in the First Schedule. Savings. 11. Any fees relating to licences, certificates and contributions due to the Hotels and Catering Establishments Board, the Ministry of Tourism and the Authority under the Hotels and Catering Establishments Regulations, 1972, the Guest Houses and Holiday FEES (TOURISM) [ S.L.409.05 Furnished Premises Regulations 1989, the Travel Agencies and Hotel Services Regulations, 1980 and the Tourism Services (Private Sector Contributions) Regulations, 2001, repealed by these regulations, and which may be due immediately before such repeal, shall be due to the Authority as if they were fees due under these regulations. 3 [ S.L.409.05 4 FEES (TOURISM) FIRST SCHEDULE LICENCE FEES Amended by: L.N. 184 of 2002; L.N. 100 of 2003.
