  1. The title of these regulations is Malta Standards Authority (Licensing) Regulations. Title.
  2. Words and phrases in these regulations shall have the same meaning as is assigned to them in the Malta Standards Authority Act, hereinafter in these regulations referred to as "the Act". Interpretation. Cap.
  3. Any person wishing to make use of the standard mark shall apply to the Authority for the grant of a licence authorising him to make use. Application for licence.
  4. An application to the Authority under regulation 3 shall be made on a form obtainable at the Department of Industry and shall contain - Form and contents of application. (a) information as to the nature and type of the local goods in respect of which the application is being made; and (b) the address or addresses in Malta at which such goods, or their component parts or ingredients, are assembled, produced, manufactured or processed.
  5. Any application made in accordance with regulation 4 shall be accompanied by a fee of one euro and sixteen cents (€1.16). Application to be accompanied by fee. Amended by: L.N. 426 of

(1)The Authority, after considering an application made under regulations 3 shall, if satisfied that - Grant of licence. Amended by: L.N. 3 of 1967. (
  1. a)the local goods, in respect of which the application has been made, satisfy the standards of quality and fulfil the conditions prescribed in the standard order or orders applicable to such goods; and (
  2. b)(
  3. i)the premises in which such goods are assembled, produced, manufactured or processed, as the case may be, and (
  4. ii)the nature of wrappers, cartons, containers or cans in which such goods are purveyed and other conditions relating to the transportation, handling and storage, comply with the requirements set out in any regulations made by the Minister under article 18(
  5. e)of the Act, grant a licence to the applicant authorising him to use the standard mark in relation to such goods. 2 [ S.L.419.02 MALTA STANDARDS AUTHORITY (LICENSING)
(2)Any licence granted by the Authority in accordance with subregulation
(1)shall be signed by the Chairman of the Authority for and on behalf of the Authority. Validity of licence and payment of fee. Amended by: L.N. 98 of 1968; L.N. 426 of 2007. 7.
(1)Any licence granted by the Authority shall be valid for one year from the date of the grant, renewable from year to year. Licensee may cease using the standard mark. 8.
(1)Any licensee under these regulations may, at any time, cease to make use of the standard mark in relation to any local goods covered by the relative licence.
(2)Prior to the grant or renewal of any such licence, the applicant shall pay to the Director of Industry a licence fee of eleven euro and sixty-five cents (€11.65).
(2)A licensee who shall have ceased from making any use of the standard mark in accordance with subregulation
(1)shall not be entitled to any refund of the fee paid for the grant or renewal of the relative licence or of any part of such fee. Register of licences. 9. There shall be kept by the Authority a register in which shall be noted any licence granted by them, the date of its issue, the name of the licensee, the local goods in respect of which it has been granted, the date of its expiry and any renewal or renewals thereof.
