The title of this Order is the Work Places (Extension of Definition) Order. Title. Amended by: XXVII. 2000.39. 2. The premises and places referred to in the Schedule shall be considered work places to which the Health and Safety at Work Act applies. Extension of definition. Amended by: XXVII. 2000.39. XXXIII.2024. First Schedule. Cap. 646. SCHEDULE (Article 2) 1. All docks, wharves and quays in any harbour in Malta and its Dependencies and all ships either therein or thereat or anywhere else within the territorial waters of Malta and its Dependencies, in each case while the processes of loading and unloading, or of moving and handling goods or of coaling are in progress or are being commenced or terminated. Any premises or open-air spaces where the work of quarrying stone, crushing stone or drilling for water, oil or natural gas is carried on; any yard or dry dock (including the precincts thereof) in which ships or vessels are repaired, refitted, finished or b r o k e n u p a n d a n y u n d e rg r o u n d w o r k s c o n n e c t e d w i t h t h e construction of tunnels and other underground structures: L.N. 44 of 1960. Provided that the work therein performed is carried on by way of trade or for the purposes of gain and that the employer of the persons employed therein has the right of access to or control over such premises or open air spaces, yard or dry deck, or under ground works, as the case may be. 3. Any premises, open air spaces or underground works being a poultry, dairy or other farm or horticultural establishment: Provided that (

1. a)such premises, spaces or works are used by way of a connection with trade or for, or in connection with, the purposes of gain, and (

All those places where the following operations are undertaken by way of trade or business or for the purpose of any industrial or commercial undertaking or by or on behalf of the Government, namely, the construction, structural alteration, painting, decoration, repair or maintenance of a building or any other structure (including repainting, redecoration and external cleaning of the building or structure), the demolition of a building or structure and the preparation for and laying the foundation of an intended building or structure. Any premises or open air space, wherein a steam boiler is installed, as well as any premises or open air space being a part of an educational establishment, hospital, Government Department, hotel or catering establishment, wherein a steam or hot water boiler is installed. Any premises or open air space, wherein a hoist or lift is installed, and is used by way of a connection with trade or for, or in connection with, the purpose of gain, as well as any premises or open air space being part of an educational establishment, hospital, Government Department, hotel or catering establishment wherein a hoist or lift is installed.
