  1. The title of these regulations is the Fishing Vessels Regulations.
  2. In these regulations, unless the content otherwise requires - "Act" means the Fisheries Conservation and Management Act; Title. Interpretation. Amended by: L.N. 191 of
  3. Cap.
  4. "AWLS" means an automated weighing and labelling system, and refers to electronic systems provided and, or approved by the Director for the weighing and labelling of fish, and installed at fish landing places as required by the Director; "Department" means the Department responsible for fisheries and aquaculture; "Director" means the officer responsible for fisheries and aquaculture; "Fishing Vessels Register" means the register of local fishing vessels kept by the Director in terms of regulation 8; "Minister" means the Minister responsible for fisheries and aquaculture; "satellite-tracking device" shall have the same meaning as assigned to it in Article 2

(9)of the Commission Implementing Regulation (EU) No 404/2011 of 8 April 2011 laying down detailed rules for the im pl e m e nt a t io n o f C ou nc il R e g ul a ti on ( E C ) No 12 24 /2 00 9 establishing a Community control system for ensuring compliance with the rules of the Common Fisheries Policy, as in force from time to time. 3. (
  1. a)Vessels which from their very nature or from other factors lead the Director to believe that their primary and predominant use is for fishing may be registered by the Director in the Fishing Vessel Register and, once so registered so that they can be so used, shall have a licence according to the relevant provisions of the law: Provided that, without prejudice to regulation 9, the Director shall not register or renew any registration with respect to any vessel falling under category C described under regulation 8(
  2. b)if the same vessel is of a length of 12 metres or more, and with effect from the 1st January 2014 he shall also cancel all registrations under category C which are in force on the same date.   3. b)Fishing vessels of all categories of six metres or over in length shall also be registered under the Merchant Shipping Act. (
  4. c)The issued licence shall be kept on board of the fishing vessel at all times. Fishing vessels of any category may only be used for the purposes indicated in the licence: Provided that without prejudice to regulation 9, the Director shall not register or renew any registration with respect to any vessel falling under category C as described in regulation 8, if the same vessel is of a length of twelve metres
(12m)or more: Provided further that in exceptional cases and if not causing any prejudice to the fishing sector, generally or in the particular case, the Director may register or renew registrations in category C for vessels of a length of twelve metres
(12m)or more. Other laws or conventions.
  1. Any fishing vessel which requires any other registration in accordance with any provision of prevailing maritime laws or other conventions, may obtain such other registration following the registration of such fishing vessel in the Fishing Vessels Register. (1)The owner or charterer or captain of a fishing vessel shall apply for the registration and licensing of such vessel using and completing those forms as may be required by the Director. This form shall be accompanied by the following documents: Cap. 234. (
  1. a)a certificate indicating the tonnage and length of the vessel and it shall be issued in accordance with the related requirements of the Merchant Shipping Act and all regulations relative to tonnage made thereunder, or a sworn declaration stating that the vessel was not previously registered according to any law in Malta, and if no boat builder’s certificate can be provided the same declaration shall also state the origin of the vessel; (
  2. b)a survey report of the fishing vessel; (
  3. c)the deed or instrument of incorporation of the company or body corporate owning the fishing vessel in the event that ownership belongs to such company or body corporate; (
  4. d)as many photographs as may be required to show the entirety of the fishing vessel, in order that the said photographs include the complete length, width and height from stern to bow, and port and starboard of the fishing vessel; (
  5. e)a copy of a legally valid identification document of the physical person submitting the application; and (
  6. f)the applicant shall provide reasonable evidence that he and the master of the vessel indicated upon the application for registration satisfy the requirements of sub-regulation

(2)The Director shall only register a fishing vessel in the Fishing Vessels Register upon submission of a formal application accompanied with all the documents mentioned in subregulation
(1): Provided that at any stage between the submission of an application and the registration of the fishing vessel, the Director may issue to the applicant a non-operational temporary registration certificate which shall be effective only until such time as any other registration procedure which is required according to the Merchant Shipping Act is concluded. (3)Without prejudice to sub-regulation
(4), the owner, charterer and master of the local fishing vessel shall be, at all times, resident in Malta and in conformity with all applicable immigration, residential, fiscal and employment laws, and the Director may require any evidence proving compliance with those laws and in case of a failure to provide such evidence or of a doubt on the said compliance, the Director shall refuse the application or suspend or revoke a registration.
(4)The Director shall provide separate and specific application forms requiring that information and, or documentation which he may deem appropriate, for the registration of a local fishing vessel whose master is not a citizen of a Member State of the European Union and, or does not fulfil the residency requirements of subregulation
(3): Provided that such application forms shall clearly indicate that these are being submitted for the purposes of this subregulation and that such application forms, if duly completed, shall be submitted by the Director to the Minister for the consideration of the latter in accordance with this regulation: Provided further that, no master shall be validly registered and licensed to operate a local fishing vessel by the Director under this sub-regulation unless the Minister orders so in writing after considering that there are exceptional circumstances which call for such an order and that the prospective master is duly qualified to act as such according to law: Provided further that the Minister may, at any time, delegate his powers under this sub-regulation to the Director.
(5)The registration and licensing of a master of a local fishing vessel as ordered by the Minister under sub-regulation
(4)shall be valid for renewable periods of not more than one year. 6. (
  1. a)Vessels requesting inclusion in the Fishing Vessels Register for the first time shall be present in the registration port so that the necessary inspections could be carried out. (
  2. b)Before every renewal of its registration and fishing licence, the fishing vessel and its gear shall be inspected, and the expenses incurred for this purpose shall be met by the owner, charterer and, or captain of the vessel when these are carried out in a port outside Malta. FISHING VESSELS 7.
(1)Vessel registration and license fees shall be paid in accordance with Schedule II.
(2)Unless a licence indicates otherwise, the duration of a fishing licence shall be for a period of one
(1)year from its date of issue, and for a period of twenty-four
(24)hours in the case of each fishing trip.
  1. There shall be identified in the Fishing Vessels Register various categories of fishing vessels equipped for the commercial exploitation of marine biological resources and the Director may register these under appropriate segments as follows: Category A: Commercial Fishing Vessels – Full-time Category B: Commercial Fishing Vessels – Part-time Category C: Non-commercial Fishing Vessels: Cap.

  4. Provided that work boats registered as such under the Merchant Shipping Act may be permitted by the Director to carry out any operation at sea in support of or in preparation of any activity related to fishing by issuing a fishing licence under article 12 of the Act limited to the period necessary for those activities and limited to specific activities. 9.*
(1)If a fishing vessel of Category A or B does not register a catch and sale of fish of value as shown in Schedule III, such vessel shall be recorded in a temporary register where it may remain visible for three
(3)years, in which period it shall restart its commercial fishing activity totally or shall otherwise continue to work on a low scale and shall therefore be included in Category C of regulation 8.
(2)A vessel losing its registration in Category A or B of Schedule III and included in Category C of regulation 8 according to sub-regulation
(1)shall pay two-thousand, six hundred and eighty-three euro and thirty cents of a euro (€2,683.30) in order to regain its right of registration in the categories for commercial fishing: Provided that, the right provided according to this subregulation shall not apply for fishing vessels who have been included in Category C of regulation 8 for a period of five
(5)years or more following the application of sub-regulation

With reference to regulation 2 of Legal Notice 305 of 2021 which substitutes regulation 9 of these regulations, anything done or to be done according to the provisions of regulation 9, before the entry into force of Legal Notice 305 of 2021, shall remain unaffected by this regulation and shall continue to apply accordingly: Provided that, according to regulation 9 any period accrued by the time of the coming into force of Legal Notice 305 of 2021, as regards fishing vessels included under Category C of regulation 8, shall be considered included in the calculation of the time period referred in the proviso of sub-regulation
(2)of regulation 9 as substituted by Legal Notice 305 of

  2. The fishing vessels of all categories in the Fishing Vessel Register which are less than six metres in length shall not be allowed to carry out fishing activities or related activities beyond 12 nautical miles. Fishing vessels less than six metres long.
  3. The fishing vessels of six metres or over in length are allowed to fish in all fishing waters as well as in international waters or convention waters as indicated in the licence. Fishing vessels over six metres long. 12.
(1)The masters of all fishing vessels shall be responsible for the fulfilment of any logbook obligation as applicable to them in accordance with European Union law and, or as the Director may require in issuing any licence or permit in accordance with the Act: Logbook obligations. Provided that the Director may provide logbooks to be used by masters of fishing vessels and, when those logbooks are correctly used, all logbook obligations shall be deemed iuris et de iure to have been fulfilled for all intents and purposes at law: Provided further that the logbooks provided by the Director may be on paper and, or electronic format as the Director may decide.
(2)When requiring logbooks according to sub-regulation
(1), the Director may provide for different logbook obligations and, or different logbook formats for different vessels and, or categories of vessels.
(3)Failure to adequately use or complete any logbook as provided by the Director according to sub-regulation
(1), shall constitute an offence against these regulations. 13.
(1)Without prejudice to other obligations according to law, the Director shall update the fishing licence details of a registered fishing vessel upon receiving a joint written request from the fishing licence holder and an ascendant or descendant up to the first degree, whether by consanguinity or affinity, who shall be registered as the new fishing licence holder in accordance with said request: Inter vivos fishing licence transfer. Substituted by: L.N. 158 of 2020. Provided that, without prejudice to any impediment according to law, upon giving effect to said update the fishing vessel may be used by the new fishing licence holder according to its fishing licence and the law.
(2)Any update done according to sub-regulation
(1)shall be made at no expense for the applicants. 14. (
  1. a)All fishing vessels shall, during operations, have safety equipment according to Schedule V which shall also be in conformity with all other regulations issued by the competent authorities from time to time.   2. b)The owner of a fishing vessel shall satisfy the Director that the vessel is seaworthy and that the machinery and gear, if existing, are suitable for the intended use of the vessel and are certified as such by a marine surveyor appointed in terms of the provisions of article 367 of the Merchant Shipping Act. (
  3. c)Owners of fishing vessels should abide by the regulations on collisions under the Merchant Shipping Act. 15.
(1)Local fishing vessels as licensed according to the Act shall be so licensed and shall operate in accordance with their gross tonnage, and the provisions of this regulation shall apply in case of discrepancies between the registered gross tonnage and the gross tonnage as verified by the Director.
(2)Without prejudice to any other right, obligation and power of the Director or of anyone else, and without prejudice to subregulations
(4)and
(5), the Director may change the amount of gross tonnage as registered for a local fishing vessel when this is reasonable according to the circumstances of the case and upon an application by the owner or operator of the vessel, in any one
(1)of the following circumstances: (a) when, following verification by the Director, the resulting discrepancy between the registered gross tonnage and the verified gross tonnage is less than one
(1)gross tonne, and when the Director deems that said discrepancy is due to an error made in good faith by whosoever it may be, the Director may correct the registered gross tonnage so that it coincides with the verified gross tonnage; or (b) when, following verification by the Director, and whatever the discrepancy between the registered gross tonnage and the verified gross tonnage may be, and if the Director deems that said discrepancy is not due to any fault of the applicant and that the required adjustment is not to the detriment of the local fishing vessel fleet and to the administration of fisheries according to the Act, the Director may change the registered gross tonnage so that it coincides with the verified gross tonnage.
(3)In case an owner or operator of a registered local fishing vessel applies with the Director to cancel the registration of a local fishing vessel and concurrently with the same cancellation also applies according to paragraphs (a) or (b), the Director may do the following: (a) instead of two
(2)or more registered local fishing vessels, he may permit the registration of one
(1)local fishing vessel if its gross tonnage does not exceed by more than one
(1)gross tonne of the sum of the gross tonnage of the local fishing vessels that were registered instead of that vessel; FISHING VESSELS [ S.L.425.07 (b) in cases in which the applicant requests the deregistration of a local fishing vessel and in lieu thereof does not request the registration of any vessel or requests the registration of one
(1)or more vessels the total gross tonnage of which is less than that of the deregistered vessel, the Director may, upon a request made concurrently with the request for de-registration, allow the applicant to use that gross tonnage or the resulting discrepancy in a manner that is compliant with these regulations and the applicant shall be obliged to do so within two
(2)years from the date of said de-registration: Provided that, in the circumstances provided under paragraph (b) and when the applicant does not make the use therein referred within the said two
(2)years, the applicant shall lose all rights as granted by the same paragraph.
(4)All changes requested according to paragraph (b) of subregulation
(2)are subject to the payment of eight hundred euro (€800) for each gross tonne or part thereof, and no change may take effect before the payment of the relevant amounts.
(5)The Director may not give effect to any change as provided by sub-regulations
(2)or
(3)if the registered gross tonnage of the entire local fishing vessel fleet exceeds seventy-five per cent (75%) of the amount equivalent to the maximum limit of the fishing capacity set for Malta according to Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2 0 1 3 o n t h e C o m m o n F i s h e r i e s P o l i c y, a m e n d i n g C o u n c i l Regulations (EC) No 1954/2003 and (EC) No 1224/2009 and repealing Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and Council Decision 2004/585/EC as in force from time to time or according to any other European Union legislation which substitutes its provisions as relating to the maximum limit of the fishing capacity.
(6)Without prejudice to sub-regulations
(2)to
(5), the changes referred in this regulation may be made both by decreasing or increasing the registered gross tonnage of a local fishing vessel.
(7)Whenever this regulation refers to gross tonnage, the Director may, if he so deems it fair according to the circumstances of a case, apply the same provisions mutatis mutandis for engine power.
(8)Without prejudice to the provisions of this regulation, gross tonnage and engine power taken out of the fishing capacity of Malta shall not be subject to being or becoming the property of any person, and no provision of this regulation may be interpreted as giving any right upon any registration of gross tonnage and, or engine power, or on an amount of gross tonnage and, or engine power.
(9)For the purposes of this regulation, gross tonnage and engine power shall be measured according to the law of the European Union as applicable to fishing vessels. 7 8 [ S.L.425.07 FISHING VESSELS
(10)Nothing in this regulation or done according to this regulation shall be construed as affecting any obligation or responsibility according to law, be it civil, administrative and, or criminal according to the circumstances, and anything done according to this regulation is without prejudice to the same. Satellite monitoring system. Amended by: L.N. 191 of 2023. 16. (
  1. a)all commercial fishing vessels shall be equipped with a satellite-tracking device as may be required by the Director and in accordance with this regulation: Provided that this obligation shall not apply if a commercial fishing vessel is otherwise obliged to be equipped with a functioning Vessel Monitoring System (VMS) or if a commercial fishing vessel is in fact equipped with such a functioning system. (
  2. b)Repealed by Legal Notice 191 of 2023. (
  3. c)If for some reason this system stops working during the fishing trip the captain or owner are bound to communicate the exact position of the fishing vessel by other means every two hours to the Department. The captain or owner of the fishing vessel shall come into port within twenty-four hours from when the automatic system stops functioning. (
  4. d)In the failure to deliver this communication the captain shall stop his activities and return to port. (
  5. e)The relevant details for the identification of the vessel within this system will be confidential and will be the responsibility of such person as is delegated by the Director. (
  6. f)No person shall input or output any false positions, manually over-ride, destroy, damage, render inoperative, tamper or otherwise interfere with the satellite-tracking device and system: Provided that the Director may authorise improvement, repair or replacement of the said device and system. Official markings. Cap. 234. Cap. 234. Marking of fishing vessels. Substituted by: L.N. 191 of 2023. 17. (
  7. a)The official number of fishing vessels which are six metres or over in length and are registered under the Merchant Shipping Act, and the number indicating their registered tonnage shall be incised on the inside of their keel. (
  8. b)The name and base port of the vessels of six metres or over in length registered under the Merchant Shipping Act shall be marked on the stem with coloured letters which show up on the base colour of the vessel according to the provisions of the Merchant Shipping Act. 18.
(1)Without prejudice to any other vessel marking as required by law, all fishing vessels over ten
(10)metres in length overall shall have their Fishing Vessel Register number marked in accordance with FISHING VESSELS [ S.L.425.07 9 Article 6 of Commission Implementing Regulation (EU) No 404/ 2 0 11 o f 8 A p r i l 2 0 11 l a y i n g d o w n d e t a i l e d r u l e s f o r t h e im p l e m e n t a t i on of Co u nc i l R e g ul a t i on ( E C ) N o 1 22 4 /2 0 09 establishing a Community control system for ensuring compliance with the rules of the Common Fisheries Policy, as in force from time to time.
(2)Without prejudice sub-regulation
(3)and any other vessel marking required by law, fishing vessels of ten
(10)metres and less in length overall shall be marked on both sides of the bow with their Fishing Vessel Register number, and such markings shall be in a colour contrasting with the background on which they are painted.
(3)Vessel markings according to sub-regulation
(2)shall be as follows: (a) for vessels up to six metres
(6m)in length, all the characters of the Fishing Vessel Register number shall be at least ten centimetres (10cm) high and two centimetres (2cm) wide; and (b) for vessels over six metres
(6m)but less than ten metres
(10m)in length, all the characters of the Fishing Vessel Register number shall be at least twenty centimetres (20cm) high and three centimetres (3cm) wide: Provided that the height and width of every character shall at all times be legible from a reasonable distance: Provided further that the height and width of the characters shall be adapted to dimensions which are never less than the dimensions referred above. 19. (a) Every fishing vessel may only use the gear indicated in any licence issued to it. (b) All equipment on board and deployed at sea during fishing shall be marked with the number of the vessel indicated in regulation 18. 19A.
(1)All commercial fishing vessels shall land their fish at landing places provided with AWLS systems approved by the Director.
(2)All fish as landed in accordance with sub-regulation
(1)shall be weighed immediately upon landing by using the same AWLS system: Provided that any landing and weighing according to this regulation shall be made prior to the first sale of the fish.
(3)All data entries required by the AWLS system shall be entered for all catches landed and weighed in accordance with this regulation. Landing, weighing and labelling of fish. Added by: L.N. 191 of 2023. 10 [ S.L.425.07 FISHING VESSELS
(4)The labelling issued by the AWLS system shall at all times be kept by the possessor of the fish in accordance with all labelling obligations as applicable in accordance with European Union law.
(5)This regulation is without prejudice to any landing, weighing and labelling obligations in accordance with applicable European Union law, and shall be read in conjunction and in compliance therewith. Fishing vessels over seventeen metres long. Observer on board vessel. 20. Vessels that are seventeen metres or over in length shall carry a certificate in accordance with the Sixth Schedule as approved by the Director of the Food and Veterinary Division, and plans of the fish holds which indicate the volume in cubic metres and the temperature which they are capable of maintaining. This certificate and the plans shall indicate the presence of cold water tanks on board. 21. (
  1. a)The Director may order the presence of an observer during fishing by means of a letter sent to the owner or captain or master of the vessel. (
  2. b)The observer shall be appointed to remain on board for different periods but for not more than three months. Such observer may not leave the vessel during the period in which he is in charge unless he is replaced by another observer. (
  3. c)The captain or master of the vessel shall give all facilities to the observer and co-operate with him in his duties on the vessel. (
  4. d)The captain or master of the vessel who shall be informed in accordance with paragraph (
  5. a)shall endeavour to facilitate the arrival and departure of the observer on the vessel. During the visit of the observer the captain or master shall provide him with accommodation and appropriate working facilities as indicated in Schedule VII. Offences and penalties. Any person who infringes any provision of these regulations shall be guilty of an offence and shall, on conviction, be liable to a fine (multa) of not less than one thousand and one hundred and sixty-four euro and sixty-nine cents (€1,164.69) but not exceeding five thousand and eight hundred and twenty-three euro and forty-three cents (€5,823.43) for each contravention. 23. (
  6. a)The existing vessels included in the current Fishing Vessels Register kept under the Registration of Fishing Boats Regulations, 1988*, will be transferred automatically to the new register as appropriate. In this respect wherever there are rights of registration with the Department, such rights shall apply to vessels r e g i s t e r e d a f t e r t h e d a t e o f p u b l i c a t i o n o f t he s e regulations. (
  7. b)All fishing vessels which are presently included in the *Revoked by these regulations. FISHING VESSELS [ S.L.425.07 11 Fishing Vessels Register and which still require a registration with the Authority for Transport in Malta and, or a radio licence or which still need to meet any other obligation in accordance with these regulations shall regularise their position by the 1st January, 2004. (
  8. c)In the case of a fishing vessel failing to observe the provisions of paragraph (b), such vessel shall automatically lose its fishing licence and registration in the Fishing Vessels Register, and the application for a new licence by such fishing vessel shall be considered as a new registration in the said Register. 24.
(1)Without prejudice to sub-regulation
(2), all effects at law of the provisions of regulation 9, inclusive of any terms therein provided, shall be suspended throughout the year 2020: Provided that the Director may, by order in the Gazette, extend the period of suspension due to extraordinary circumstances affecting the fishing industry.
(2)Notwithstanding the provisions of sub-regulation
(1), the following rights shall retain effect throughout the year 2020 and throughout any period of extension as provided according to the proviso of sub-regulation
(1): (
  1. a)the right to be removed from the temporary register referred in regulation 9 upon a vessel totally restarting its commercial fishing activity according to Schedule III; and (
  2. b)the right to regain a right of registration in categories A or B, as applicable for a particular vessel and as lost in accordance with regulation 9, upon payment of the amount provided in regulation 9 and upon that vessel totally restarting its commercial fishing activity according to Schedule III.
(3)Upon termination of the periods provided according to subregulation
(1), all terms provided under regulation 9 shall continue to run and all the effects of regulation 9 shall be applicable at law. Transitory provision. Added by: L.N. 236 of

Schedule VII Observers on Board I ALLOCATION OF OBSERVERS ON BOARD FISHING BOATS (
  11. a)In order to carry out their tasks, observers must have the following qualifications: - Sufficient experience to identify fish species and fishing gear. - The capacity to accomplish elementary scientific tasks, for example, taking of samples where necessary and making accurate observations and keeping records in that connection. - Maritime navigation skills. - A satisfactory knowledge of conservation measures according to laws and conventions to which Malta is a member. - A satisfactory knowledge of the language of the flag of the vessel being observed.   12. b)The Department of Fisheries and Aquaculture must take appropriate measures to ensure that observers are received on board fishing vessels at the agreed time and place and to facilitates their departure on completion of the observation period. II TASKS OF OBSERVERS The main task of observers is to monitor compliance with regulations. In particular observers will: (

  14. b)Send a report to the Director of Fisheries and Aquaculture that indicates all their observations, especially the biological data collected. (

  1. a)The captain or master must be given sufficient notice of the date and place at which the observer is to be received and of the likely duration of the observation period. (
  2. b)The captain or master has to make contact with the observer to be able to organise the arrival and departure of the same observer on his ship. (
