[ S.L.427.94 FLUORINATED GREENHOUSE GASES SUBSIDIARY LEGISLATION 427.94 FLUORINATED GREENHOUSE GASES (IMPLEMENTING) REGULATIONS * 27th April, 2018 LEGAL NOTICE 143 of 2018. 1. The title of these regulations is the Fluorinated Greenhouse Gases (Implementing) Regulations. Citation. 2. These regulations implement the provisions of Regulation (EU) No 517/2014 of the European Parliament and of the Council of 16 April 2014 on fluorinated greenhouse gases and repealing Regulation (EC) No 842/2006 and all its implementing acts including: Implementation.   1. a)Commission Implementing Regulation (EU) No 1191/2014 of 30 October 2014 determining the format and means for submitting the report referred to in Article 19 of Regulation (EU) No 517/2014 of the European Parliament and of the Council on fluorinated greenhouse gases; (
  2. b)Commission Implementing Regulation (EU) 2015/2068 of 17 November 2015 establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, the format of labels for products and equipment containing fluorinated greenhouse gases; (
  3. c)Commission Implementing Regulation (EU) 2015/2066 of 17 November 2015 establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of natural persons carrying out installation, servicing, maintenance, repair or decommissioning of electrical switchgear containing fluorinated greenhouse gases or recovery of fluorinated greenhouse gases from stationary electrical switchgear; (
  4. d)Commission Implementing Regulation (EU) 2015/2067 of 17 November 2015 establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of natural persons as regards stationary refrigeration, air conditioning and heat pump equipment, and refrigeration units of refrigerated trucks and trailers, containing fluorinated greenhouse gases and for the certification of companies as regards stationary refrigeration, air conditioning and heat pump equipment, containing fluorinated greenhouse gases; *These regulations have been repealed by Legal Notice 69 of 2025. 1 2 [ S.L.427.94 FLUORINATED GREENHOUSE GASES (
  5. e)Commission Implementing Regulation (EU) 2015/ 2065 of 17 November 2015 establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, the format for notification of the training and certification programmes of the Member States; (
  6. f)Commission Implementing Regulation (EU) 2016/ 879 of 2 June 2016 establishing, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council, detailed arrangements relating to the declaration of conformity when placing refrigeration, air conditioning and heat pump equipment charged with hydrofluorocarbons on the market and its verification by an independent auditor; (
  7. g)Commission Implementing Regulation (EU) 2017/ 1375 of 25 July 2017 amending Implementing Regulation (EU) No 1191/2014 determining the format and means for submitting the report referred to in Article 19 of Regulation (EU) No 517/ 2014 of the European Parliament and of the Council on fluorinated greenhouse gases; and (
  8. h)Commission Implementing Decision (EU) 2017/ 1984 of 24 October 2017 determining, pursuant to Regulation (EU) No 517/2014 of the European Parliament and of the Council on fluorinated greenhouse gases, reference values for the period 1 January 2018 to 31 December 2020 for each producer or importer which has lawfully placed on the market hydrofluorocarbons from 1 January 2015 as reported under that Regulation. Interpretation. 3. Cap. 427. "the Act" means the Product Safety Act; Cap. 510. In these regulations, unless the context otherwise requires: "Director General" means the Director General (Technical Regulations) appointed by article 19 of the Malta Competition and Consumer Affairs Authority Act; "Regulation (EU) No. 517/2014" means Regulation (EU) No. 517/2014 of the European Parliament and of the Council of 16 April 2014 on fluorinated greenhouse gases and repealing Regulation (EC) No 842/2006 and all its implementing acts. Designation of the competent authority. Cap. 510. 4. The Technical Regulations Division established by article 19 of the Malta Competition and Consumer Affairs Authority Act shall be the competent authority for the purposes of Regulation (EU) No. 517/2014. (4)of Regulation (EU) No. 517/2014 the label shall be in either the Maltese or English language. Language requirements for labelling and product and equipment information.
  1. The competent authority may develop as appropriate and ensure the dissemination of guidance notes and documents for the purpose of ensuring the proper implementation of these regulations and of Regulation (EU) No. 517/2014 Guidance documents.
  2. For the enforcement of the provisions of these regulations the Director General shall have the same functions and powers prescribed under the Act. Functions and powers of the Director General.
  3. Part IV of the Act shall apply to proceedings in relation to any offence under these regulations. Proceedings.
