(1)The title of these rules is the Zootechnical and Genealogical Conditions for the Breeding, Trade in and Entry into Malta of Purebred Breeding Animals, Hybrid Breeding Pigs and the Germinal Products thereof (Implementing) Rules. Citation and scope.
(2)The scope of these rules is to implement the requirements of Regulation (EU) 2016/1012 of the European Parliament and of the Council of 8 June 2016 on zootechnical and genealogical conditions for the breeding, trade in and entry into the Union of purebred breeding animals, hybrid breeding pigs and the germinal products thereof and amending Regulation (EU) No 652/2014, Council Directives 89/608/EEC and 90/425/EEC and repealing certain acts in the area of animal breeding ("Animal Breeding Regulation"). 2. requires:
(1)In these rules, unless the context otherwise "Act" means the Veterinary Service Act; "competent authority" means the Veterinary Services; "Director" means the Director of Veterinary Services as defined in the Act; "Regulation (EU) 2016/1012" means Regulation (EU) 2016/1012 of the European Parliament and of the Council of 8th June 2016 on zootechnical and genealogical conditions for the breeding, trade in and entry into the Union of purebred breeding animals, hybrid breeding pigs and the germinal products thereof and amending Regulation (EU) No 652/2014, Council Directives 89/608/EEC and 90/425/EEC and repealing certain acts in the area of animal breeding ("Animal Breeding Regulation").

- 1 2 [ S.L. 437.112 ZOOTECHNICAL AND GENEALOGICAL CONDITIONS FOR THE BREEDING, TRADE IN AND ENTRY INTO MALTA OF PUREBRED BREEDING ANIMALS, HYBRID BREEDING PIGS AND THE GERMINAL PRODUCTS THEREOF (IMPLEMENTING) otherwise requires, terms used in these rules which are not defined herein shall have the same meaning as assigned to them in the Act and Regulation (EU) 2016/
- Competent authority.
- The Veterinary Services as defined in the Act shall be the competent authority for the purposes of Regulation (EU) No 2016/
- Certificates and forms.
- The model forms of zootechnical certificates for breeding animals and their germinal products in accordance with Annex V to Regulation (EU) 2016/1012 for the issuing of zootechnical certificates by breed societies or breeding operations in accordance with the requirement of Article 30
(1)of the said Regulation, shall be those found in Commission Implementing Regulation (EU) 2020/602 of 15 April 2020 amending Implementing Regulation (EU) 2017/717 as regards the model forms of zootechnical certificates for breeding animals and their germinal products. (1)Whenever any person infringes any of the provisions of these rules or Regulation (EU) 2016/1012, the provisions of articles 54, 55, 56, 57, 58, 59, 60 and 61 of the Act shall apply.
(2)Without prejudice to the provisions of sub-rule
(1), the Court may also order any person who is found guilty of an offence in accordance with these rules, to pay for the expenses incurred by the competent authority and the Director as a result of the said offence, the revocation of any permits or certification issued under these rules and the confiscation, retention and disposal of the animals involved.
