CO-ORDINATION BETWEEN ORGANISATIONS AND ASSOCIATIONS WHICH MAINTAIN OR ESTABLISH STUD-BOOKS FOR REGISTERED EQUIDAE [ S.L.437.26 1 SUBSIDIARY LEGISLATION 437.26 CO-ORDINATION BETWEEN ORGANISATIONS AND ASSOCIATIONS WHICH MAINTAIN OR ESTABLISH STUD-BOOKS FOR REGISTERED EQUIDAE REGULATIONS * 24th October, 2003 LEGAL NOTICE 318 of 2003. 1.
(1)The title of these regulations is the Co-Ordination between Organisations and Associations which maintain or establish Stud-Books for Registered Equidae Regulations. Citation and scope.
(2)The scope of these regulations is to implement the rules found under European Union Commission Decision 92/354/EEC lay in g d ow n certa in r ul es to e nsu re co -o r di na ti on b etw een organisations and associations which maintain or establish studbooks for registered equidae. This Decision finds its legal basis under European Union Council Directive 90/427/EEC, article 4
(2)(e). 2. The organisation or association which maintains the studbook of the origin of the breed must ensure close collaboration with the organisation and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute. Close collaboration with the organisation and associations. 3.
(1)Where the competent authority considers that an approved or recognised organisation or association in a Member State is not complying with the rules laid down in the relevant zootechnical legislation, and particularly with the principles laid down by the organisation or association which maintains the studbook of the origin of the breed, it shall contact the competent authority of the Member State concerned forthwith. Non-compliance with rules laid down in zootechnical legislation.
(2)If the competent authorities considers these measures likely to be insufficient, it shall explore with the authority of the Member State ways of remedying the situation, if necessary by visiting that Member State.
(3)The competent authorities shall inform the European Commission of the solutions decided upon. 4.
(1)Where the competent authority of a Member State c o n s i d e r s t h a t a n a p p r o v e d o r r e c o g n i s e d o rg a n i s a t i o n o r association in the territory of Malta is not complying with the rules laid down in the corresponding Member States legislation, and particularly with the principles laid down by the organisation or association which maintains the stud-book of the origin of the breed, it may contact the competent authority of the territory of *These Regulations have been repealed by Legal Notice 11 of 2024. (2)The competent authority shall take all the necessary measures and inform the competent authority of the Member State of the type of checks carried out, the decisions taken and the reasons for those decisions.
(3)If the competent authorities of the Member State considers these measures likely to be insufficient, it may explore with the authority of the territory of Malta ways of remedying the situation, if necessary by visiting the territory of Malta.
(4)The competent authorities of the territory of Malta shall inform the European Commission of the solutions decided upon.
