L.S. 437.06(R) Regolamenti dwar l-Aċċettazzjoni ta' Majjali ta' Razza Pura għat-Tgħammir Imħassrin bl-Avviż Legali 11 tal-2024

(1)The title of these regulations is the Acceptance of PureBred Breeding Pigs for Breeding Regulations. Title and scope.

(2)The scope of these regulations is to implement the provisions found under European Union Council Directive 90/118/ EEC on the acceptance of pure-bred breeding pigs for breeding which in turn finds its legal basis under article 3 of the European Union Council Directive 88/661/EEC. 2.

(1)In the territory of Malta, without prejudice to animal health rules, there is no prohibition or restriction of or obstacle to - Acceptance of pure-bred breeding pigs. (

1. a)the acceptance of pure-bred breeding female pigs for breeding; (
2. b)the acceptance of pure-bred breeding male pigs for natural service; (
3. c)the use of ova and embryos from pure-bred breeding female pigs.

(2)For the purpose of these regulations ''trading partner'' in the meaning of article 2 of the Veterinary Services Act shall mean (

1. a)Member States of the European Community; (
2. b)Third countries to the European Community. 3.

(1)No prohibition, restriction or impediment shall take place on (

1. a)the acceptance for artificial insemination within the territory of Malta of pure-bred breeding male pigs or the use of their semen when those animals have been accepted for artificial insemination in a Member State on the basis of tests for monitoring their performance and assessing their genetic value to be carried out in accordance with Member State legislation corresponding to European Union Commission Decision 89/507/EEC; (
2. b)the acceptance for official testing of pure-bred breeding male pigs or the use of their semen within the quantitative limits necessary for the tests for monitoring their performance and assessing their genetic value to be carried out in accordance with Member State legislation corresponding to European *These Regulations have been repealed by Legal Notice 11 of 2024. (2)Where implementation of the provisions of subregulation

(1)would give rise to disputes, particularly with regard to interpretation of the tests, operators shall have the right to seek the opinion of an expert. In the light of the expert’s opinion, measures may be adopted in accordance with requirements of the European Community and according to the procedure laid down in article 34(b) of the Veterinary Services Act. 4. In the territory of Malta, without prejudice to animal health rules, for marketing, the semen, ova and embryos are collected, treated and stored by an officially approved centre or officially approved staff.
