[ S.L.441.03 SHOPS BUSINESS HOURS (TOURIST LOCALITY) 1 SUBSIDIARY LEGISLATION 441.03 SHOPS BUSINESS HOURS (TOURIST LOCALITY) REGULATIONS * 25th May, 1993 LEGAL NOTICE 71 of 1993, as amended by Legal Notices 51 and 140 of 1995, 34 of 1996 and 166 of 1999. 1. The title of these regulations is Shops Business Hours (Tourist Locality) Regulations. Title. 2. In requires - Interpretation. Amended by: L.N. 51 of 1995. these regulations, unless the context otherwise "Act" means the Shops and Hawkers (Business Hours) Act †; Cap. 155. "shop" means any premises where goods are sold or services offered to the public in any of the following activities (
- a)the sale of bona fide souvenirs; (
- b)the sale of books, articles of stationery, postal stamps, photographic goods, and video, radio and television electronic recording equipment; (
- c)the sale of tobacco, matches, drinks, sweets, items of confectionery, ice-creams and take-away foods; (
- d)lending libraries including video rentals; (
- e)shops connected with the hire of cars, boats or vessels and the offering of pleasure cruises or holiday excursions; (
- f)restaurants and bars; (
- g)shops connected with services given by barbers and hairdressers; (
- h)jewellers’ shops: Provided that where in such shops more than one class of items or services is offered to the public, the class of items or services constituting the main activity shall be deemed to be the activity of the shop for the purposes of these regulations. 3. The provisions of these regulations shall not apply to vehicles of hawkers, mobile structures and dispensaries. Businesses which are not included. 4. The localities indicated in the Schedule are to be considered as tourist localities in terms of article 10

(1)apply - The provisions of articles 6, 7 and 9 of the Act shall not (
- a)to any shop situated in Valletta during any day when a passenger liner is in Grand Harbour; and (
- b)to any shop in any tourist locality during the period between the 1st March and the 31st October (both dates inclusive): Provided that (
- i)any shop in any tourist locality, other than a shop in Valletta, shall close not later than 1.00 p.m on any Sunday or public holiday and not later than 10.00 p.m. on any other day; and (
- ii)all shops in Valletta shall close not later than 10.00 p.m. on any day when a passenger liner is in Grand Harbour and not later than 1.00 p.m. on any Sunday or public holiday other than a day when a passenger liner is in Grand Harbour; and (iii) subject to the provisions contained in article 11 of the Act, all shops connected with the hire of cars, boats or vessels and the offering of pleasure cruises or holiday excursions, shall close not later than 10.00 p.m. on any day.
(2)The exemptions of sub-regulation
(1)of this regulation shall apply subject to the conditions that no full-time employee shall be employed on Sundays or public holidays or after 7.00 p.m. on any other day, or during any half-day off, or after the ordinary hours of the shop as laid down in the recognised conditions of employment applicable to such employee, without the consent of the employee himself: Provided that when any full-time employee gives his consent, he may be employed outside the established times set out in sub-regulation
(1)of this regulation, and he shall be remunerated at the overtime rates applicable according to the recognised conditions of employment.
