MEASUREMENTS SUBJECT TO METROLOGICAL CONTROL [ S.L.454.17 1 SUBSIDIARY LEGISLATION 454.17 MEASUREMENTS SUBJECT TO METROLOGICAL CONTROL REGULATIONS 10th June, 2011 LEGAL NOTICE 223 of 2011, as amended by Legal Notice 65 of 2023. 1. The title of these regulations is the Measurements subject to Metrological Control Regulations. Citation. 2. For the purposes of these regulations, ‘metrological control’ means all the administrative and technical actions intended to check measuring instruments and their metrological requirements for reasons of public interest, public health, public safety, public order, protection of the environment, protection of consumers, levying of taxes and duties, calculation of tariffs, fees, administrative penalties, conduct of expert assessments and establishment of basic guarantees for fair trade and all other actions which may be laid down in due form. Interpretation. 3. The following measuring instruments shall undergo initial verification as from 1st June 2011: Initial verification. (
- a)instruments for measuring the speed of road vehicles; (
- b)time interval measuring. Initial verification shall seek to ensure that the measuring instrument to be placed on the market conform to an approved pattern and to the applicable regulations, have specified metrological characteristics that lie within the permissible limits, and function properly. Prior to placing the measuring instrument on the market, an application for initial verification shall be lodged with the Metrology Directorate of the Malta Standards Authority by the person placing the instrument on the market. The application shall include, as a minimum, the following information: (
- a)identification data of the applicant; (
- b)name and address; (
- c)identification instrument; data of the submitted measuring (
- d)name or trademark, if applicable; (
- e)label or name of the manufacturer; (
- f)measurement range, if applicable; (
- g)serial number and if a batch of measuring instruments is reported - the number of measuring instruments in the batch and the range of serial numbers of these instruments; (
- h)the assigned type approval mark or the number of the type approval decision or the decision on recognition as equivalent to the type approval - in the case of a 2 [ S.L.454.17 MEASUREMENTS SUBJECT TO METROLOGICAL CONTROL measuring instrument subject to type approval and submitted for initial verification; (
- i)date and signature of the applicant. Periodical metrological control. 4. The categories and types of measuring instruments listed in the schedule to these regulations shall be subjected to periodical legal metrological control according to the conditions laid down therein. Penalties. 5. Any person who contravenes any of these regulations shall, on conviction, be liable to the penalties established by virtue of article 27 of the Metrology Act. Cap. 454. Mutual recognition. 6. The provisions of these regulations do not hinder the marketing of products legally manufactured or marketed in another Member State, contracting parties to the EEA Agreement and Turkey.
