(1)On the resignation, death or the expiry of the term of office of the appointed members, the President shall cause a notice thereof to be sent to the respective authority concerned. Resignation, death or the expiry of term of office.

(2)In the case of elected members or elected additional members, the President shall cause an election to be held in accordance with the provisions of regulation 5

(1)of the Pharmacy Council (Elections) Regulations. S.L. 464.03 PART III PROCEEDINGS OF COUNCIL 5.

(1)The Council shall meet at least once monthly as established in paragraph 14 of the First Schedule to the Act: Provided that additional meetings of the Council (

1. a)may be summoned by the President at any other time; (
2. b)may also be summoned on a written request signed by not less than three of the members and, or additional members and addressed to the President, who shall cause such meetings to be convened within seven days, Meetings of the Council. 2 [ S.L.464.12 PHARMACY COUNCIL (STANDING ORDERS) of the receipt of such request unless otherwise agreed by the three members summoning the meeting.

(2)The next meeting shall be scheduled as agreed by majority consensus at the end of the meeting convened in accordance with subregulation

(1). Meetings to be convened by Registrar.

1. All meetings of the Council shall be convened by the Registrar, by notice addressed to each member entitled to attend the meeting in accordance with article 15 of the Act, and such notice shall be sent by hand, by post or by electronic means. Notice.
2. The notice as required by regulation 6 shall state the hour and place of the meeting and the agenda, and whether for general business or for any special matter and together with such notice there shall be sent: (a) a copy of the minutes of the previous meeting; provided that the minutes may not be attached to a notice convening a meeting to discuss special matters in accordance with regulation 5

(1); (

1. b)in the case of special business, the purpose in detail; and (
2. c)any other additional information that may be needed for that meeting. Copy of notice to be sent to each member. 8.

(1)The Registrar shall send a copy of the notice drawn up in accordance with regulations 6 and 7 to each member entitled to attend the meeting in accordance with article 15 of the Act.

(2)Such notice shall be sent not less than five days before the day of the meeting, provided that in case of special urgency, a notice to c onvene a me eting to discus s special business in accordance with regulation 5

(1)(

1. a)and (
2. b)of two working days shall suffice. Notice of motion. 9. Any notice of motion to be inserted in the agenda for a meeting must be received by the Registrar at least eight working days before: Provided that the President may at any time decide to include in the agenda a matter arising urgently. Absence of the President. 10. In accordance with paragraph 2 of the First Schedule to the Act, in the absence of the President of the Council the other members shall elect a person from among themselves to chair the meeting and such person shall continue to have his original vote as well as a casting vote. Decisions of the Council. 11. A decision of the Council shall be made by a simple majority of votes: Provided that in the case of equality of votes the President will be entitled to a casting vote in accordance with paragraph 3 in the First Schedule to the Act. Quorum. 12.

(1)In accordance with paragraph 13 of the First Schedule to the Act no business shall be transacted by the Council unless a [ S.L.464.12 PHARMACY COUNCIL (STANDING ORDERS) 3 quorum of half the members thereof plus one is present.

(2)In such instances when there is no quorum the meeting shall be scheduled for no later than ten working days from the date of the meeting in question. 13. The order of business at each regular meeting shall be as follows: (

1. a)(
2. i)reading, amendment, confirmation, minutes of the previous meeting; (
3. ii)matters arising out of the minutes; of Order of business. the (
4. b)correspondence; (
5. c)matters of urgency; (
6. d)adjourned matters; (
7. e)motions on the notice; (
8. f)reports of committees; (
9. g)other matters: Provided that when the Pharmacy Council is discussing matters relating to Pharmacy Technicians, this subject shall be placed after paragraph (a)(ii). 14. The regular order of business may be varied or suspended at any meeting at the discretion of the President together with simple majority consent. Variation or suspension of order of business. 15. Except by permission of two-thirds of the members present, no member shall introduce for discussion at a meeting a subject which had not been duly inserted on the notice for that meeting. Discussion of subject not duly inserted on the notice. 16.

(1)Before any motion or amendment is discussed, it shall be proposed and seconded by two-thirds of the members present for the meeting. Proposal and secondment of motion.

(2)Any such motion shall be produced in writing.

(3)All amendments shall be framed so that they may be read as independent motions.

1. No amendment motion shall be withdrawn after having been read unless by permission of the majority of the Council members present. Withdrawal of amendment motion.
2. The seconder of a motion or of an amendment may reserve his speech to any period of the debate; but only the proposer has the right of final reply. Final reply.
3. If an amendment to a motion is proposed, it shall be discussed and a decision shall be taken before any other amendment is moved. Decision on amendment to a motion. 20.

(1)The amendment shall be put to a vote and if it is refused, a second amendment may be moved, and shall be disposed of in the same way as the first amendment; and so on for other amendments, until no further amendment is proposed. (2)For an amendment to be approved it requires the support of a simple majority provided that abstained votes shall not be considered.

(3)In any case except that described in subregulation

(2), the amendment shall be refused.

(4)In the case of an amendment being refused the second successive amendment shall be moved and disposed of in the same manner. Original motion. 21. Should every amendment be refused, the original motion shall then be put to the vote. Amendment which has been carried to be regarded as a substantive motion. 22. If any amendment is carried, it shall then be regarded as a substantive motion and so treated, as to a further amendment with the right of speaking on it in reply, and in all other respects, as an original motion. Motion under debate. 23. Without prejudice to regulation 25, when a motion is under debate, no further proposal shall be received, except one of the following: (

1. i)an amendment, namely, "That the motion be amended as follows ...................................." (
2. ii)the postponement of the question, namely, "That the consideration of the motion be postponed"; (iii) the adjournment of the debate, namely, "That the debate on the motion be now adjourned"; (
3. iv)the adjournment of the Council, namely, "That the Council do now adjourn"; (
4. v)the closure of the debate, namely, "That the Council do now proceed to vote on the motion"; (
5. vi)the prejudicial question as to the motion, namely, "That the Council, instead of proceeding to deal with the motion, do pass to the next item on the agenda". Amendment under debate. 24. Without prejudice to regulation 25, when an amendment is under debate, no further proposal shall be received except one of the following: (
6. i)the adjournment of the debate on the amendment, namely, "That the debate on the amendment be now adjourned"; (
7. ii)the adjournment of the Council, namely, "That the Council do now adjourn"; (iii) the closure of the debate on the amendment, namely, "That the Council does now proceed to vote on the amendment"; (
8. iv)the prejudicial question as to the amendment, namely, "That the Council, instead of proceeding to deal with the amendment, do resume the debate on the motion originally proposed". PHARMACY COUNCIL (STANDING ORDERS) [ S.L.464.12 5 25. The proposal for the postponement of the motion or amendment may specify a date for the further consideration of the question, or be made sine die. Proposal for postponement of motion. 26.

(1)If the proposal for the adjournment of the debate is carried, the Council shall pass to the next item on the agenda, and the debate shall be resumed at the next ordinary meeting of the Council. Where proposal for the adjournment of the debate is carried.

(2)The proposer of the adjournment shall, on the resumption of the debate, be entitled to speak first. 27. On the proposal for the adjournment of the Council being made and seconded it shall be competent for the President before putting the question, to take the opinion of the Council as to whether they will, before rising, proceed to the transaction of unopposed business. Proposal for the adjournment. 28.

(1)The proposal for the closure of the discussion on an amendment or motion shall be made and seconded without debate, and shall, unless the President shall rule otherwise, be put forthwith. Proposal for closure of discussion on an amendment or motion.

(2)Should the proposal of closure be in line with subregulation

(1), the motion or amendment under debate shall be at once voted on by the Council. 29.

(1)The proposal for a previous question shall be made and seconded without debate, and shall be put forthwith. Proposal for a previous question.

(2)Should the proposal be carried, the motion or amendment to which it applies shall be dropped from the agenda.

1. A question shall be decided by a show of hands unless a secret ballot be asked for by a member or by an additional member. The numerical outcome of the vote shall be recorded in the minutes. Question to be decided by show of hands.
2. A motion to rescind any decision of the Council cannot be proposed before the lapse of three months from the date of the decision in question unless the Council unanimously decides otherwise and such motion has to be seconded by the majority of the members present. Motion to rescind a decision of the Council.
3. All the proceedings of the Council shall be entered in minute form and periodically bound and the names of the members present at each meeting shall be entered in the minutes. Minutes. 33.

(1)The minutes of each meeting shall contain such motions and amendments as have been proposed and adopted or refused, with the names of the proposer and seconder, but without any comment or observation of members or additional members. Minutes to contain motions and amendments.

(2)The reason for the decision should, however, be recorded. 34. The President shall confirm by his signature the minutes arising out of the business of a meeting. Signing of minutes. 35.

(1)No motion or discussion shall take place upon the minutes except upon their accuracy. Accuracy of minutes. 6 [ S.L.464.12 PHARMACY COUNCIL (STANDING ORDERS)

(2)If no such question is raised, or if it is raised, as soon as it has been disposed of, the President shall declare that the minutes are confirmed.

(3)If such question is raised it shall be discussed and approved or rejected. If the majority of members present approve the amendment, the President shall, if so decided, amend the minutes before confirming that the minutes are confirmed. Special committees and standing committees. 36.

(1)The Council may appoint as it deems necessary special committees and standing committees to assist the Council in the execution of its functions, both from within the Council and outside.

(2)The Council shall provide any such committee with a written declaration approved by Council majority outlining: (

1. a)the term of appointment; (
2. b)the terms of reference; (
3. c)their reporting relationship to the Council; and (
4. d)any other item deemed necessary by the Council. Proceedings to be regarded as confidential. 37.

(1)All proceedings of the Council and of its committees shall be regarded as confidential.

(2)The Council may issue statements and directives, as it considers appropriate from time to time.

(3)The Council shall publish any report, statement and similar document as required by or under the Act. PART IV REGISTERS AND REGISTRATION Registers. 38.

(1)Separate registers shall be kept for the registration of (

1. a)pharmacists (
2. b)pharmacy technicians (
3. c)specialists (
4. d)special areas of practice, in accordance with articles 16, 17, 18 and 29 of the Act.

(2)Separate registers shall be kept for the temporary registration of (

1. a)pharmacists (
2. b)pharmacy technicians, in accordance with articles 17 and 18 of the Act. Form of register. Two parts of register. 39. Each register shall be in accordance with the form shown in the First Schedule and shall state in respect of each person the particulars referred to in that Schedule. 40. Each register shall consist of the following two parts: (
3. a)EU citizens part (
4. b)Non-EU citizens part. PHARMACY COUNCIL (STANDING ORDERS) [ S.L.464.12 7 41. An application for the issue of a licence or temporary licence to practise as a pharmacist and registration or temporary registration in any of the registers shall be made to the Registrar in accordance with the form shown in the Second Schedule. Application for the issue of a licence. 42.

(1)The Registrar shall in any meeting after the receipt of a valid application, lay before the Council all applications for the issue of any licence to practice as a pharmacist and for any registration in any of the registers. Applications for issue of licence to be laid before Council.

(2)The Council shall verify the information and documentation and if found to be in compliance to the provisions of the Act or these regulations issued thereunder shall instruct the Registrar to: (

1. a)recommend to the President of Malta for a licence or temporary licence to practice as a pharmacist to be issued; (
2. b)enter, once the President of Malta has issued a licence or a temporary licence, the particulars of the person accepted for registration in the relevant part of the appropriate register; (
3. c)enter the particulars of any person accepted for registration to practice as a pharmacy technician in the relevant part of the appropriate register; (
4. d)enter the name, after an application to that effect by the person concerned, of a pharmacist who is in possession of a specialist qualification according to article 29

(4)of the Act; (e) enter the name of the pharmacist in the corresponding Register for the Special Areas of practice as determined by regulation 38

(3).

(3)In dealing with any application submitted to it in accordance with sub-regulations

(1)and

(2), the time-frames and procedures stipulated by article 42

(1)of the Act shall be respected.

1. When any person entitled to be registered in any of the registers has his name and particulars entered in the registers, he shall be given a certificate of registration in accordance with the form shown in the Third Schedule. Certificate of registration.
2. The entries made in any register other than those in regulation 38

(2)shall, subject to the provisions of regulations 46, 47, 51 and 52, be permanent. Entries made in any register to be permanent. 45.

(1)Every registered practitioner shall be bound to notify the Registrar, without undue delay, of any change affecting the entry in his respect in any of the registers. Change affecting entry in any register.

(2)Every registered practitioner shall notify the Registrar of any changes thereof within a maximum of thirty calendar days of such change.

(3)Every registered practitioner shall comply with any request for information as the Council may from time to time require from him in accordance with the provisions of these regulations or any other law. 8 [ S.L.464.12 Alterations. PHARMACY COUNCIL (STANDING ORDERS) 46.

(1)Subject to the provisions of regulation 47, a registered practitioner shall apply in writing to the Registrar to have an alteration made in any field of his respective entry in any register.

(2)A registered practitioner, who applies to have an alteration made in his registered name, shall produce in support of his application such certificates or other documentary evidence as the Council considers necessary.

(3)The Council shall, on being satisfied that all the requirements of these rules of procedure have been complied with, cause to be entered in the appropriate register the alteration or addition so notified as approved. Retention of name on insertion of alteration.

1. On the insertion in the appropriate register of an alteration in the name of a registered practitioner, the Registrar shall retain in the register his name as already registered: Provided that if the practitioner requests that his former name be omitted from the register, his request may be complied with after that name and the new name have appeared together at least in one issue of the register. Certificate showing alterations.
2. A certificate showing any alterations in the respective entry in the register, shall be issued in accordance with the form shown in the Fourth Schedule. Temporary registration. 49.

(1)A temporary registration shall be made in respect of a valid application as shown in the Fifth Schedule submitted to the Council in accordance with the Act and these regulations and in the case of a pharmacist a temporary licence shall also be issued.

(2)The certificate of temporary registration shall be in the form shown in the Sixth Schedule.

(3)A temporary registration shall be valid for a period of not more than one year in accordance with articles 17

(4)and 18

(4)of the Act. Publication of registers. 50.

(1)Each of the registers kept by the Council shall be published every year.

(2)Each of such registers shall show the names and surnames, in alphabetical order of surnames, with the locality, qualifications as existing on the first day of January of the year of publication. Conditions for validity of entry in register. 51.

(1)An entry in any register shall be subject to the conditions stipulated hereunder, in order for it to be considered as valid and retained in the register.

(2)Before the expiry of one year from the registration or the last retention, the registered person shall: (

1. a)provide evidence that the practitioner satisfies the requirements for continued professional development as may from time to time be established by the Council where necessary in consultation with relevant authorities or bodies which the Council deems appropriate; (
2. b)verify and certify the accuracy of the entry in the PHARMACY COUNCIL (STANDING ORDERS) [ S.L.464.12 register or otherwise update in accordance with these regulations; (
3. c)pay the retention fee as stipulated by or under articles 16

(1)(i) and 37

(1)of the Act; (d) provide any other information as may be requested by the Council.

(3)The Registrar shall as a minimum and at least but not more than three calendar months prior to the date stipulated in subregulation

(2), inform the practitioner that the practitioner should: (

1. a)provide evidence that he satisfied the requirements for continued professional development; (
2. b)verify and certify the accuracy of the respective entry in the register; (
3. c)pay the retention fee; (
4. d)provide direction as to the place where this information should be submitted and by which time the conditions of this regulation have to be satisfied to ensure the retention of the entry; (
5. e)inform the practitioner of the consequences for failure to adhere to the requirements of this regulation; (
6. f)inform the practitioner of any other information or proof the Council so requires for retention of the entry in the register. 52.

(1)If a registered practitioner applies to the Council for the removal of his name from any of the registers, the application shall be in the form of a declaration signed by him specifying the ground or grounds on which the application is made and stating that the applicant is not aware of any proceedings or of any reason for the institution of any proceedings which might result in rendering him liable (a) to have his name erased from that register by or under the Act; or (b) to have withdrawn from qualification which he holds. him any registrable

(2)The application shall be considered by the Council, who may, if they deem fit, adjourn consideration to a future date, and may require the applicant to furnish further information or explanation either in writing, or orally and in person before the Council.

(3)After considering the application, the Council may, if they think fit, by resolution put from the President, direct the Registrar to remove the name of the applicant from the register.

(4)If removal is ordered, the decision of the Council shall forthwith be notified by the Registrar to the applicant by letter addressed to his registered or last known address. Application for removal of name from register. 9 10 [ S.L.464.12 PHARMACY COUNCIL (STANDING ORDERS) Restoration to the register of name which has been removed. 53. Unless the Council shall otherwise direct, the Registrar shall not restore to the register any name which has been removed under regulation 52, unless the person whose name has been so removed applies in writing for the restoration of his name to the register, saving the provisions of article 34 of the Act. Seal. 54.

(1)The Council shall have a seal of a circular form bearing the figure of a mortar and pestle and intertwined serpent enclosed in the inscription "PHARMACOPOLARUM CONSILIUM MELITENSE" followed by the words "ANNO DOMINI" and the year in which the Pharmacy Council, formerly the Pharmacy Board, was established.

(2)Affixing of seal to all certificates of registration. The seal shall be kept in the custody of the Registrar. 55.

(1)The Registrar, or another officer of the Council authorized in writing by the President of the Council, shall be authorized to affix the seal to all certificates of registration and to all formal commissions issued by the Council.

(2)Save as aforesaid, the seal shall be affixed only by order or under the authority of the Council.

(3)Any order for affixing the seal shall state the object of its use and shall be entered in the minutes of the Council.
