- The title of these regulations is Restriction of Movement (Public Health) Regulations. Citation.
- requires: In these regulations, unless the context otherwise Interpretation. "Act" means the Public Health Act; Cap.
- "conditions" means a set of rules established in the Order for the Restriction of Movement (Public Health) intended to prevent the potential spread of disease which shall be complied with at all times by the person subjected to the Order. "Order" means the Order for the Restriction of Movement (Public Health) issued by the Superintendent in terms of these regulations; "Revocation Notice" means a notice by means of which an Order issued under these regulations is revoked; "Superintendent" means the Superintendent of Public Health as defined in the Act. 3.
(1)Where the Superintendent has reason to suspect that a person may spread disease, she may issue an Order in writing in terms of these regulations, restricting the movement of such person for a period not exceeding four
(4)weeks, which period may be further extended by subsequent four
(4)week periods, up to a maximum of a continuous period of twelve
(12)weeks, for the purpose of finalising any diagnostic tests, as may be deemed necessary by the Superintendent.
(2)Such an Order shall be issued by the Superintendent in writing, in the official languages of Malta and shall stipulate clearly the reason upon which it is based.
(3)In cases wherein the person does not understand the Maltese or English language, the Order shall also be served upon the said person in writing or orally in a language which he is reasonably expected to understand.
(4)Any extension or variation in the period specified in the Order shall be indicated in a revised Order. Order for Restriction of Movement (Public Health). 2 RESTRICTION OF MOVEMENT (PUBLIC HEALTH) [ S.L. 465.75
(5)The said Order, extension, variation or revocation shall be delivered to the person subject to such Order either by registered mail, electronic mail or physically by a person designated for such purpose by the Superintendent. Conditions. 4.
(1)The Order shall stipulate the conditions deemed necessary for the purpose of preventing the potential spread of disease.
(2)A person subject to such an Order issued in terms of these regulations shall throughout the period specified in such Order comply with all the conditions.
(3)If circumstances so arise, the conditions may be changed by means of a revised Order issued in writing by the Superintendent.
(4)The Superintendent may order that such person is placed under the supervision of a suitable person to ensure compliance with the conditions stipulated in the Order or revised Order. If a person is found to suffer from a disease. 5. When it results that a person is suffering from a notifiable disease, article 29 of the Act shall apply mutatis mutandis. Revocation Notice. 6.
(1)The Superintendent shall with immediate effect, issue a Revocation Notice to a person subject to such an Order when, following conclusive diagnostic tests, such person is deemed by the Superintendent to be no longer capable of potentially spreading disease.
(2)The Revocation Notice shall be served or delivered physically without delay, according to the case, to the person subject to the said Order either by registered mail, electronic mail or physically, as may be delegated by the Superintendent.
(3)A Revocation Notice shall be deemed to be issued ipso iure in the case that the Order expires without any further extension. Contents of the Order for Restriction of Movement (Public Health). 7. An Order, variation or any subsequent extensions of the Order issued in terms of these regulations shall include the following information: (
- i)known; the name of the person to whom it is addressed, if (
- ii)the identification number or Police registration number given, as applicable; (iii) the date of issue; (
- iv)the reason upon which it is based; (
- v)period specified in the Order or extensions thereof, RESTRICTION OF MOVEMENT (PUBLIC HEALTH) [ S.L. 465.75 as applicable; (
- vi)the conditions which need to be complied fortwith; and (vii) the consequences in case of breach of the conditions established in the said Order. 8. A person who contravenes an Order or any of its conditions issued in accordance with these regulations shall be liable to legal proceedings in accordance with Part V of the Act. Enforcement. 9. Any power afforded to the Superintendent by means of these regulations may be delegated by the said Superintendent to a designated person. Delegation. 3
