(2)Advertisement of dinitrogen oxide shall only be permitted where it is clear from the manner of presentation that it is not intended to be, nor is it likely to be, used for a recreational use. (1)For the purposes of compliance and enforcement of these regulations, the Superintendent of Public Health hereby delegates his powers under the Act to the Executive Police pursuant to article 5 of the Act, and in the exercise of such functions, the Executive Police shall be deemed to be authorised officers for the purposes of the Act.
(2)Without prejudice to the generality of sub-regulation
(1), such power shall include the power for the Executive Police to institute, ex officio, criminal proceedings against any person in accordance with Part V of the Act.
(3)Where a person is found guilty of an offence under these regulations, such person shall be liable to the orders and punishments in accordance with Part V of the Act.
