(1)The title of this Order is the Civil Aviation Joint Aviation Requirements Order.
(2)The technical requirements and procedures set out in the JARs listed in the Schedule shall come into force from the 1st January, 1999 or from the applicability date stated in the particular JAR itself, whichever is the later: Title. Amended by: L.N. 81 of 2004; L.N. 169 of
- Provided that the Minister may grant exemptions from compliance with any particular provision of these JARs within the parameters for exemptions permitted by the JARs themselves
- In this Order, unless the context otherwiise requires - "the Act" means the Civil Aviation Act; "the Director" means the Director of Civil Aviation; "JAA" or "Joint Aviation Authorities" means the associated body of the European Civil Aviation Conference constituted by a number of European States to develop and implement common safety regulatory standards and procedures, and who have signed the document entitled "Arrangements concerning the Development, the Acceptance and the Implementation of Joint Aviation Requirements (JAR)" concluded in Cyprus on 11 September 1990; "JAR" means the technical requirements and procedures in the field of Civil Aviation Safety published by the JAA and listed in the Schedule to this Order.
(2)In the JAR documents referred to in the Schedule to this Order, reference to "the Authority" shall be construed to mean the Director of Civil Aviation except that in paragraph 1.010 of JAR OPS 1 and in paragraph 3.010 of JAR OPS 3 mentioned in the Schedule the expression "the Authority" refers to the Minister responsible for Aviation.
