- The title of these Regulations is the Malta Road Safety Council Regulations. Citation.
- requires: Interpretation. In these Regulations, unless the context otherwise "Authority" means the Authority for Transport in Malta, established by article 5 of the Authority for Transport in Malta Act; Cap.
- "Council" means the Malta Road Safety Council, established by virtue of these regulations; "Minister" means the minister responsible for transport. 3.
(1)There shall be a Council, to be known as the Malta Road Safety Council, which shall have such functions as established by these regulations.
(2)The Council shall be made up of the following members: (
- a)Minister; a Chairperson who shall be appointed by the (
- b)a deputy Chairperson who shall be appointed by the Minister; (
- c)the Commissioner of Police or a senior officer of the Executive Police, appointed by the said Commissioner, ex officio; (
- d)a senior officer of the Agency for Infrastructure Malta, ex officio; (
- e)a senior officer of the Authority, ex officio; (
- f)one
(1)member nominated by the Malta Insurance Association; (
- g)a senior Department, ex officio; (
- h)officer of the Civil Protection the Superintendent of Public Health, ex officio; (
- i)a senior officer of the Accident & Emergency Department within Mater Dei Hospital, ex officio; Establishment of the Council. 1 2 [ S.L. 499.73 MALTA ROAD SAFETY COUNCIL (
- j)a senior officer from the National Blood Transfusion Service, ex officio; (
- k)the Commissioner for Children or a person appointed by the said Commissioner, ex officio; (
- l)the Commissioner for the Rights of Persons with Disability or a person appointed by the said Commissioner, ex officio; (
- m)a senior officer appointed by the Minister for Education, ex officio; (
- n)the President of the Local Councils Association, ex officio; and (
- o)ex officio: a senior officer of the National Statistics Office, Provided that members appointed ex officio whose role does not fall within the Minister’s remit shall be appointed following consultation between the Minister and the respective entity being represented: Provided further that the Minister may appoint other persons as members of the Council whom he considers as having the relevant experience and who have shown the required capacity in matters relating to road safety.
(2)The Deputy Chairperson of the Council shall act instead of the Chairperson whenever the Chairperson is absent from a meeting of the Council or is unable, for any reason, so to act.
(3)The appointed members, other than those appointed ex officio, shall hold office for such term, not being of more than three
(3)years, as may be specified in their letter of appointment. All appointments, including renewed appointments, shall be published in the Gazette.
(4)If any vacancy in the Council occurs while the period of appointment is still valid, on account of death, resignation or for any other cause, the Minister shall, as soon as practicable, appoint another person to fill the vacancy: Provided that the Council and the members thereof may continue to act notwithstanding any such vacancy.
(5)Notwithstanding any other provision of this regulation, the Minister may at any time terminate the appointment of an appointed member, if, in his opinion, such member is unfit to continue in office or has become incapable of performing his functions as required by these regulations: MALTA ROAD SAFETY COUNCIL [ S.L. 499.73 3 Provided that in the case of members appointed ex officio, whose role does not fall within the Minister’s remit, such termination shall take place following consultation between the Minister and the respective entity being represented.
(6)The Minister shall appoint a secretary to the Council.
(7)The Council shall meet as often as necessary, but in no case less frequently than once
(1)every three
(3)calendar months.
(8)The Council shall decide on the composition and terms of reference of sub-committees or expert groups to which it can give special and specific tasks.
(9)The Council shall have the power to enter into contracts for the purpose of engaging the services of experts to support its work. 4.
(1)All decisions of the Council shall be taken by a majority of the members present, as long as a quorum for the meeting of the Council has been attained. Proceedings of the Council.
(2)There shall be a quorum when at least fifty per cent (50%) of the members plus one
(1)are present for a meeting of the Council.
(3)The Council shall otherwise regulate its own procedures, subject to the provisions of these regulations.
(4)At the end of each calendar year, the Council shall prepare an annual report on the work carried out which shall be submitted to the Minister and copied to all the members of the Council within the first quarter of the following year. The report shall include but not be limited to a full account of the Council’s activities throughout the year, its achievements as well as expenditure.
(5)The Council shall report to the Minister and shall keep him duly informed of its work on a regular basis. 5. The functions of the Council shall be the following: (
- a)to provide oversight on road safety together with the relevant competent authorities; (
- b)to support the competent authorities in the development, monitoring, implementation and evaluation of road safety policy and strategy; (
- c)to advise the Ministry on best practices, policies, action plans, legislative proposals and funding in the field of road safety; (
- d)to promote road safety for all road users in collaboration with the relevant stakeholders; Functions of the Council. 4 [ S.L. 499.73 MALTA ROAD SAFETY COUNCIL (
- e)to develop programs and initiatives targeting specific groups on road safety issues; (
- f)to collaborate with the authorities and entities from other countries on matters of road safety; (
- g)to prepare budget estimates for the following year’s initiatives as approved by the Council itself and present such estimates to the Minister; (
- h)to prepare an annual report outlining the work and actions of the Council, as specified in regulation 4
(4). Additional functions of the Council. 6. The Council shall, furthermore, have the following additional functions: (
- a)to advise the Minister on the development and the drafting of the national strategy concerning road safety in Malta; (
- b)to advise and report on the implementation of the national strategy concerning road safety in Malta based on reports submitted by the responsible and concerned entities; (
- c)to promote the ‘safe systems approach’ to road safety management which focuses on safe speeds, safe roads, safe vehicles, safe people and post-crash care; (
- d)to raise the road safety profile in Malta and influence road user behaviour through participation in public educational programs, community programs and other means as may be considered necessary; (
- e)to identify, request and analyse road safety-related data and information, and to commission research; (
- f)to use road safety data to monitor and evaluate the safety of roads in line with key performance indicators as may be established by the Minister; (
- g)to make recommendations for the implementation of road safety measures and the performance indicators that should be used to monitor progress towards agreed targets; (
- h)to make recommendations to increase road safety in Malta by ensuring the adoption and implementation of recognised best practices; and (
- i)to perform any other function as may be assigned to it by the Minister in the interest of road safety. Finance and resources. 7. The Minister shall allocate such funds and resources to MALTA ROAD SAFETY COUNCIL [ S.L. 499.73 the Council as shall be necessary for the proper exercise of its functions. 5
