(1)requires: Interpretation. In these regulations, unless the context otherwise "Act" means the Water Services Corporation Act; Cap. 355. "drilling rig" or "rig" means any equipment intended for use to drill holes of a diameter greater than one hundred millimetres and of a depth in excess of fifteen meters. It includes also any equipment, whether registered or not with the Police as a normal heavy vehicle or heavy plant, which is temporarily or permanently altered mechanically so as to drill holes as mentioned above; " C o r p o r a t i o n " m e a n s t h e Wa t e r S e r v i c e s C o r p o r a t i o n a s established by the Act; "officer" includes any person engaged by, detailed for duty with, or in any manner whatsoever performing duties for or on behalf of the Corporation; "user" means the person who has the effective control of use of the drilling rig.

(2)The meanings set out in the Act shall be applicable in these regulations, unless the context requires otherwise. 3.

(1)Every user shall inform the Corporation of the existence of all drilling rigs, whether or not so registered with the Police, over which he has effective control of use. Registration of drilling rigs.

(2)The information required in subregulation

(1)shall be given in the form established by the Corporation in the Schedule, and shall include all the particulars and shall meet all the requirements stipulated therein.

(3)The form indicated in subregulation

(2)may be collected from the offices of the Corporation or from any other place which the Corporation may designate. 4.

(1)There shall be paid to the Corporation, upon the registration of the drilling rig, a fee of sixty-nine euro and eightyeight cents (€69.88).

(2)A drilling rig shall not be deemed to be registered for the purposes of these regulations unless and until the relative fee has been paid.

(3)If a drilling rig is registered by more than one person, only Fee on registration. Amended by: L.N. 426 of

2. Subject to the provisions of these regulations, every drilling rig registered in accordance with the provisions of regulations 3 and 4 shall be deemed to be operated under a temporary licence from the Corporation. Penalty. Amended by: L.N. 426 of
3. 6.

(1)Every user who fails to inform the Corporation as prescribed in regulations 3 and 4, or who submits incorrect, incomplete or false information, shall be guilty of an offence and shall be liable to a fine (multa) of not less than nine thousand and three hundred and seventeen euro and forty-nine cents (€9,317.49) but not exceeding eighteen thousand and six hundred and thirtyfour euro and ninety-nine cents (€18.634.99) and to the confiscation of the drilling rig.

(2)Such fine shall be payable within a period of time as the Court in passing sentence shall direct.

(3)Such fine and confiscation shall be over and above, and in addition to, any other punishment for which he would be liable under any other law or regulation. Executing officers.

1. The Corporation may designate any officer or officers to carry out duties in connection with, or arising from, these regulations. Groundwater source.
2. The registration of a drilling rig does not in any way give any right to the user to drill any hole which may be defined as a groundwater source according to the Notification of Ground Water Sources Regulations. S.L. 423.12 Third party rights.
3. The registration of a drilling rig by a user shall in no way prejudice any rights or claims which third parties may have over such drilling rig. Other requirements non-exempt.
4. The permit given by regulation 5 does not exempt the user from the obligation of obtaining any other permit or licence which may be required by any other law or regulation.
