(1)The title of these regulations is the Address Register and related Location (Geospatial) Registers Regulations. Citation, scope and commencement.
(2)The scope of these regulations is to establish a set of registers relating to the keeping and updating of an address of an existing or planned officially identified structure in Malta, as may be required in order to ensure consistent and coherent use of such data. These regulations further provide that such registers are to be used either in conjunction with each other or as individual registers to provide official records pertinent to that specific type of geospatial location.
(3)These regulations shall come into force on such date or dates as the Minister may, by notice in the Gazette establish, and different dates may be so established for different provisions and, or different purposes of these regulations.

- Act; "address" means the combination of details describing an addressable object being a bounded place used for habitation, work, entertainment or any other type of human related activity which is based on a hierarchical combination of geographic names of regions or localities, streets, buildings and doors or entry points together with a post code which uniquely identify a place where items or services may be delivered; "addressable object" means any built structure or geographic location which is generally known by one
(1)or more names, having specific geocodes for the latitude, longitude and elevation, where applicable, for such structures or place names and which can be plotted on a map; *Vide Legal Notice 103 of

- ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS "base map" or "official base map" means the digital national geographical database managed by the Planning Authority as referred to in article 38
(1)(e) of the Development Planning Act, which is designed to serve as the underlying geospatial layer on which other spatial information may be referenced and linked to; "building" means a specific type of location which represents a built structure which is included in the Buildings Register. Every building listed in the Buildings Register shall be identified in accordance with the location uniform resource identifier and geospatial details; "building entry point" means any form of passageway or opening as part of a building accessible from a street and which is used to enter or exit such a building; "country" means the specific type of location which includes the name of a geographical area or territory recognised at international level and as published by the International Standards Organisation through the ISO 3166 list of countries, which also includes names and codes of countries that previously existed. Every country shall be identified in accordance with the location uniform resource identifier and geospatial details; S.L. 546.
- "Data Governance Council" means the Data Governance Council as established by Part XI of the Organisational Structures for Data Sharing and Re-Use Regulations and for the purposes of these regulations shall have the same functions therein established; S.L. 546.
- "data owner" shall have the same meaning assigned to it in the Organisational Structures for Data Sharing and Re-Use Regulations; "data source" means the data as identified and requested by the Registrar for the purposes of the creation and maintenance of the Register and subsidiary registers; "entity" means any entity or body corporate of any nature, whether public or private; "good quality data" means data which is complete, unique, consistent, timely, valid and accurate, in the method of transmission as required by the Registrar; ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 "locality" means a specific type of location which identifies a geographical area which has its geographical boundary clearly defined and, or is included in the base map and is recognised by the Local Government Act. Every locality shall be identified in accordance with the location uniform resource identifier and geospatial details; Cap.
- "location" means the record containing the human readable information which, together with the geographic coordinates and spatial data of an addressable object from the base map, represent a particular place or physical structure; "Minister" means the Minister responsible for public sector information; "official record" shall have the same meaning as assigned to it in regulation 2 of the Organisational Structures for Data Sharing and Re-Use Regulations; S.L. 546.
- "official register" shall have the same meaning as assigned to it in regulation 2 of the Organisational Structures for Data Sharing and Re-Use Regulations; S.L. 546.
- "post code" means the system of codes created and applied, from time to time, by the postal services provider as authorised by the authority responsible for the regulation of communications. Every post code shall be identified in accordance with the location uniform resource identifier and geospatial details; "public officer" shall have the same meaning as assigned to it in article 124 of the Constitution; "public sector body" shall have the same meaning as assigned to it in the Act; "public sector entity" shall have the same meaning as assigned to it in the Act; "public service" shall have the same meaning as assigned to it in the Public Administration Act; "region" means a specific type of location which represents a subdivision of Malta as may be identified and included by the Registrar. Every region shall be identified in accordance with its location uniform resource identifier and geospatial details; "Register" means the Address Register as established in regulation 4; Cap.
- 3 4 [ S.L. 546.04 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS "Registrar" means the Registrar of Addresses who shall be responsible for the Register and subsidiary registers; S.L. 546.
- "regulatory authority" means the regulatory authority established by regulation 4 of the Organisational Structures for Data Sharing and Re-use Regulations; "street" means a specific location which is public or private and which serves as a thoroughfare or any other type of passageway and has a name recognised by the Registrar. Every street thus identified shall be linked to, and form part of, only one
(1)locality or sub-locality. Every street shall be identified in accordance with the location uniform resource identifier and geospatial details; "sub-locality" means a specific area within a locality. Every sub-locality shall be identified in accordance with its location uniform resource identifier and geospatial details; "subsidiary register" means the subsidiary registers as established in regulation 4, as follows: (
- a)the Buildings Register; (
- b)the Streets Register; (
- c)the Localities Register; (
- d)the Post Codes Register; (
- e)the Regions Register; (
- f)the Countries Register; and (
- g)any other subsidiary register as the Registrar may establish from time to time; "uniform resource identifier" or "URI" is a webcompliant format for the allocation of a machine-readable persistent identifier for every record in an official register, including the different identifiers assigned to the different versions of each record; S.L. 546.01. "user" shall have the same meaning as assigned to it in regulation 2 of the Organizational Structures for Data Sharing and Re-Use Regulations. Office of the Registrar. 3.
(1)There shall be established the Office of the Address Registrar, which shall be under the management of the Registrar, whose functions shall be as defined in these regulations. ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04
(2)The Registrar shall be designated as the data owner in respect of the data as processed following its inclusion in the Register and subsidiary registers.
(3)The Registrar shall be the public officer holding the office of Chief Electoral Commissioner in his capacity as Head of Department in the Electoral Office for the purposes of the Public Administration Act.
(4)The Registrar shall carry out all the functions required for the purpose of any matter connected with the establishment and management of the Register and subsidiary registers: Provided that without prejudice to the generality of the provisions of sub-regulation
(1), the functions of the Registrar shall include: (a)* the creation and maintenance of address records, ensuring the quality and accuracy of the address records within the Register and subsidiary registers in so far as the details may be ascertained or verified on the basis of other official registers and other official data sources as the Registrar may deem fit and as may be required from time to time; (b)† the regulation related to the manner in which the Register and subsidiary registers are to be made and kept; (c)‡ the retention of an audit trail of the changes and amendments to the Register and subsidiary registers; (
- d)the issuance of standards related to: (
- i)street naming; (
- ii)building and door naming; (iii) door numbering; and (
- iv)necessary; any other matter that the Registrar deems (e)§ the establishment, together with such entities as the Registrar considers appropriate, as far as possible, of the geocoding of addressable objects; (
- f)the establishment of official processes for the implementation of functions of the Registrar, maintenance of *Not yet in force. †Not yet in force. ‡Not yet in force. §Not yet in force. Cap. 595. 5 6 [ S.L. 546.04 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS the Register and subsidiary registers, creation of new addresses or changes to an existing address; (g)* the creation of the relative URI; (
- h)prescribing the formalities that are to be observed, the precautions that are to be taken, the instruments that are to be used, the notices that are to be issued, and the evidence that is to be brought in all processes before the Registrar or in connection with the registration; (i)† regulating the custody of any data which from time to time comes into the Registrar’s possession, with power to direct the destruction of any such data where it would have become altogether superseded by entries in the Register, or have ceased to have any effect; (
- j)the conduct of official searches and address certification; (
- k)prescribing the way any notices required by these regulations are to be issued; (
- l)any other functions ancillary thereto, including the issuing of orders in the Gazette.
(5)The Registrar may, in accordance with the provisions of these Regulations, delegate any one or more of its functions under such conditions as it may deem appropriate. Cap. 595.
(6)The Registrar may appoint officers, as may be required from time to time, as provided by the Public Administration Act, in order to ensure that the functions of the Office of the Address Registrar are duly carried out. The Register. 4.
(1)There shall be established a Register, which shall contain therein the details of all addresses in Malta, and which shall be based on data derived from the Location Base Register in accordance with the First Schedule, which shall hold records containing the necessary information required to identify any type of land, sea or air parcel including geocoding and which shall be linked to the relevant geospatial record from the official base map of Malta, and the following subsidiary registers: (
- a)the Buildings Register which shall hold records of all buildings together with their entry points; (
- b)*Not yet in force. †Not yet in force. the Streets Register which shall hold records of all ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 streets which are publicly or privately-owned and which serve as thoroughfares or any other type of passageway and which are assigned a name by the Registrar; (
- c)the Localities Register which shall hold records of all the localities, communities and sub-localities which are identified on the official base map; (
- d)the Post Codes Register which shall hold records that represent defined physical areas as established from time to time by the postal services provider as mandated by the authority responsible for the regulation of communications to provide postal services in Malta; (
- e)the Regions Register which shall hold the list of officially recognized geographical regions which represent a sub-division of Malta, as may be identified and included by the Registrar; and (
- f)the Countries Register which shall hold records of countries and territories: Provided that the Registrar, may from time to time, after the publication of a notice in the Gazette, establish the data elements and data types which are mandatory for each register, add new data elements and data types to the Register and subsidiary registers, and establish other subsidiary registers made up of the relevant data elements: Provided further that data elements may not be populated with the required content as from initial implementation of the Register and subsidiary registers.
(2)* The subsidiary registers shall be an extension of the Location Base Register establishing the Address Register, and shall contain the data elements as provided under the First to the Eighth Schedules.
(3)The Registrar shall request, at his discretion, and receive from the entities concerned, without incurring any costs, the relevant and good quality data together with its metadata, in machine-readable format from the competent data sources. The entity concerned shall comply with this request within a reasonable time-frame as established by the Registrar.
(4)New address records or changes to existing address details may be created only by the processes as established by the Registrar. *Not yet in force. 7 8 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 Obligation to make available and give data to Registrar. 5.
(1)The entities requested by the Registrar to provide data relevant to the Register and subsidiary registers shall make available and give the data requested by the Registrar and shall also have the responsibility to: (
- a)maintain their records and, or data elements listed in the First to the Eighth Schedules and ensure that the information shared with the Registrar is good quality data, which reflects true and updated information; (
- b)facilitate the machine to machine communication of information that shall be shared or re-used on the basis of these regulations; and (c)* indicate, when sharing data with the Registrar, the unique identifier of every entry included in the Register and in respect of which a record is required to be kept.
(2)The sharing of data is required to: (
- a)establish and maintain the Register and Subsidiary Registers, for the implementation of these regulations; (
- b)facilitate the re-use and exchange of address related data to: (
- i)reduce efficiency; and the duplication and increase (
- ii)facilitate and improve the correctness and quality of services being delivered; (
- c)assist in the identification or correction of any erroneous data held by one or more of the data sources concerned to establish an address record. Sharing of data pertaining to planning permits and building development. 6.
(1)Data pertaining to planning permits and building development shall be made available by the responsible authorities, in the format as shall be established by the Registrar, from time to time.
(2)The data shall be good quality data and made available upon the issuance of the permits by the authorities responsible for planning and building development.
(3)The purpose of the sharing of this data is to establish the address record at the earliest instance to serve for all the other related processes and permits relating to the said building development.
(4)The data requested by the Registrar shall be shared by the *Not yet in force. ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 9 entities concerned with the Registrar without any costs incurred by the Registrar, within reasonable time-frames as established by the Registrar. 7.
(1)The postal services provider, as mandated by the authority responsible for the regulation of communications established by the Malta Communications Authority Act to maintain the national list of post codes for Malta, shall be required to participate and assist the Registrar in the maintenance of the address records, and to provide good quality data in the format as shall be established by the Registrar, from time to time.
(2)Sharing of data pertaining to post codes. Cap. 418. The data shall be made available immediately upon: (
- a)(
- b)Registrar. any amendment to the list of post codes; or upon the creation of a new address by the
(3)The purpose of the sharing of this data is to establish the link between a post code and a door number or a building entry point.
(4)The data requested by the Registrar shall be shared by the entities concerned with the Registrar without any costs incurred by the Registrar, within reasonable time-frames as established by the Registrar. 8.
(1)The Registrar may request the sharing of good quality data by any entity in possession of data relating to the address. The requested data shall be shared in the format as established by the Registrar from time to time.
(2)Register. Sharing of other data relating to address. The purpose of sharing of this data is to maintain the 9.* The Registrar shall ensure transparency in its processes by establishing a record version control mechanism of the Register, through which each change to the record details shall be retained and kept distinct but linked to an identifiable record, with timestamps indicating the start and end of each version of the record that is kept, and the session details, including information of the user changing details. 10.† The Registrar shall endeavour to make specific data elements from the Register and subsidiary registers available as open data: Provided that the Registrar shall specify the licence *Not yet in force. †Not yet in force. Record version control mechanisms. Address Register and subsidiary registers published as open data. 10 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 under which the data shall be made available: Provided further that such data shall not include any data that is of a personal nature. National data portal. S.L. 546.

- The Registrar shall ensure the publication of the Register on the national data portal as provided by the Organisational Structures for Data Sharing and Re-Use Regulations: Provided that the Registrar, as data owner of the data held in the Register and subsidiary registers, may set-up a data portal for the Register. Obligation to establish a data link to Register. Regulatory procedure. S.L. 546.
- Redress procedure. 12.† The public service, all public sector bodies and all entities obliged to provide a service to the public, and any other body or entity which the Registrar may designate from time to time, by virtue of an notice published in the Gazette, shall link to the register through the uniform resource identifiers in order to establish an information technology data link between the locally stored records and the centrally maintained register.
- The Data Governance Council shall receive complaints or claims from the Registrar, any public sector body, public sector entity or public service, on breaches of these regulations, to take such remedial action as may be deemed necessary or as may be prescribed by the Act and the Organisational Structures for Data Sharing and ReUse Regulations, and inform the said public sector body, public sector entity or public service of the outcome of its decision, which decision shall be final. 14.‡
(1)The Minister shall appoint an arbiter for a period of five
(5)years. The said arbiter shall be a warranted lawyer able to practice in Malta and who has been exercising the profession for at least seven
(7)years.
(2)The arbiter shall be assisted by a secretary appointed by the Minister, who shall have the duty of receiving appeals, keeping minutes and assume such other duties as the arbiter may require.
(3)The arbiter shall not be precluded from the exercise of his respective profession provided that during the term of his appointment he shall not exercise his profession with respect to applications filed in accordance with these regulations.
(4)A person shall not be qualified to hold office as an arbiter if such person: *Not yet in force. †Not yet in force. ‡Not yet in force. ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 (
- a)is a member of the House or of the European Parliament or of a Local Council; or (
- b)has an interest that is likely to prejudice the discharge of the functions as an arbiter.
(5)The arbiter shall be disqualified from hearing an appeal filed before it in such circumstances as would disqualify a judge in a civil suit, and in any such case the arbiter shall be substituted.
(6)The arbiter shall hear and determine applications filed by a person, including a legal person who feels aggrieved by a decision of the Registrar to include, amend, archive or change a record on the register or any subsidiary register.
(7)The application to appeal a decision of the Registrar shall be filed within sixty
(60)days from the date when the applicant could have become aware of the inclusion or exclusion of a record from the Register or subsidiary register.
(8)The arbiter shall have the power to determine the procedure for the hearing of all appeals filed before it and shall ensure that during the hearing all interested parties are given the opportunity to make their case.
(9)The arbiter may appoint experts to relate on any matter before it whilst exercising its functions.
(10)The arbiter shall have the right to request from the Registrar information in respect of any application submitted before the arbiter and may request the Registrar to provide him with documentation relating to the case being heard. It shall be the duty of the Registrar to provide the requested information and, or documents without delay.
(11)The arbiter shall have the power to confirm, cancel or revoke with or without conditions, and to substitute any decision of the Registrar upon any appeal in accordance with these regulations.
(12)The Registrar, the applicant or any person who feels aggrieved by the decision of the arbiter may appeal to the Administrative Review Tribunal in accordance with the provisions of the Administrative Justice Act. Cap.
- No action shall be taken against the Registrar or any of the officers or employees of the Registrar, or the public service, any public sector body, public sector entity, or any authorised entity duly delegated, providing information in accordance with these regulations, in respect of any act done or omitted to be done in good faith by the Registrar, any of the officers or employees, the public service, public Acting in good faith. 11 12 [ S.L. 546.04 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS sector body, public sector entity or authorised entity duly delegated in the execution of their functions in accordance with these regulations. Infringements committed by a public sector body and, or the public service.
- If the Registrar is satisfied that a public sector body or the public service has failed to comply with these regulations, the Registrar shall refer the matter to the regulatory authority to take the required action as provided in articles 24A to 24C, both articles included, of the Act: Provided that the regulatory authority may also issue enforcement notices as provided in article 24A of the Act also against a public sector body or the public service. Fraudulent alteration. Cap.
- 17.
(1)Any person who fraudulently procures, or attempts to fraudulently procure, or is aware of the fraudulent procurement of, any record on, erasure from, or alteration of the register, or any other document held at or issued by the Registrar shall be guilty of an offence under Book II - Title V - Of Crimes affecting Public Trust in the Criminal Code.
(2)Any record, erasure or alteration made by fraud shall be void between all persons who are parties or aware of the fraud. Consquential amendment. Cap. 490. 18.* Immediately after the last item of the subsidiary legislation in the Second Schedule of the Administrative Justice Act, there shall be added the following new item: "Address Register and related Location (Geospatial) Registers Regulations, 2025, S.L. 546.04, Inferior Competence". First Schedule Location Base Register The Location Base Register shall include the following data elements: Location URI – An automatically generated numeric value that is used as the persistent and unique identifier on which the remaining information contained in the Location record can be kept and retrieved. Location Name – A short name with a meaning or description that enables the identification of the location. Location Type – The selection of one of the values from a *Not yet in force. ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 controlled list as may be established from time to time by the Registrar of permitted values which link the location record to one of the subsidiary registers as explained in the Address related subsidiary registers. Location Geocoding – The necessary codes and values together with the referencing system used to store the longitude, latitude and altitude as may be applicable to represent point, line or area (polygon) information. Country – The ISO 3166 code (Countries and Territories) to identify the Country within which the location is found. Location Version Control Number – An automated system of version control audit trail distinct identifiers linked to the original identifier used to enable the identification of changes applied to the original record and its subsequent substitutions over a period of time with a start and an end date for each version record. Second Schedule Address Register The Address Register shall include the following data elements: Address URI – The number automatically generated by the Location Base Register and which is also used to identify the address point record when the location type is an address point. The relevant spatial information shall be available to this register accordingly. Address Type – The classification applied to the address point from a controlled list, as established by the Registrar. Building Entry Point – The link between the address point and the building entry point when the address is part of a multi-address structure or a building with separate units. Building – The building that is linked to the building entry point when such a link is applicable. Door Number – The door number identification when such a door number exists or has been allocated. Door/Property Name – The name or other identification as prescribed by the owner or the responsible entity through which the door can be uniquely identified within the building or the street or when in combination with the door number. Floor Level – An indication of the altitude or the floor level where the entry point of the unit is located. 13 14 [ S.L. 546.04 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS Street – The link between the address point and the street which is inherited from the building entry point when such details are part of the address point record or as maintained when the Address Point is not part of a building from the Building Register. Post Code – The post code which is linked to the address point and which is either directly maintained or inherited from the building entry point record when such a link exists. Locality – The link between an address point and a locality which is inherited from the building details when such a link exists or is directly maintained when the address point is not within the definition of a condominium. Region – The link between an address point and the region which is derived from the Locality details as applicable to the Address Record. Country – The name of the country from the Countries Register. Address Version Control Number – An automated system of version control audit trail distinct identifiers linked to the original identifier used to enable the identification of changes applied to the original record and its subsequent replacements over a time period with a start-date and end-date for each version record. Third Schedule Buildings Register The Buildings Register shall include the following data elements: Building URI – The number automatically generated by the Location Base Register and which is also used to identify the building when the Location Type is a Building. The relevant spatial information shall be available to this register accordingly. Building Name – The name of the building as provided by the owner or entity responsible for the building which is within the definition of a condominium according to the Condominium Act. (Cap. 398). Building Type – The classification applied to the building from a controlled list to determine the specific features to be expected, as established by the Registrar. Locality – The link between the building and a specific locality from the Locality Register enabling the building to inherit all the relevant details pertinent to the locality to be added to the building ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS [ S.L. 546.04 details. Building Version Control Number – An automated system of version control audit trail distinct identifiers linked to the original identifier used to enable the identification of changes applied to the original record and its subsequent replacements over a time period with a start-date and end-date for each version record. Building Entry Point URI – The number automatically generated by the Location Base Register and which is also used to identify the building entry point when the location type is a building entry point. The relevant spatial information shall be available to this register accordingly. Building Entry Point Name – The name of the building entry point as provided by the owner or entity responsible for the building which is within the definition of the Condominium Act. (Cap. 398.) Building Entry Point Type – The type of entry point derived from a controlled list, as established by the Registrar. Building – The link between the entry point and the building where there is more than one entry point for the same building which may also be from different streets. Street – The link between the entry point and the street where such access exists. Post Code – The link between the entry point and the applicable post code. Building Entry Point Version Control Number – An automated system of version control audit trail distinct identifiers linked to the original identifier used to enable the identification of changes applied to the original record and its subsequent replacements over a time period with a start-date and end-date for each version record. Fourth Schedule Streets Register The Streets Register shall include the following data elements: Street URI – The number automatically generated by the Location Base Register and which is also used to identify the street when the location type is a street. The relevant spatial information shall be available to this register accordingly. Street Name – The name of the street as officially published in the Gazette, or any other temporary name as assigned by the Registrar from time to time. 15 16 [ S.L. 546.04 ADDRESS REGISTER AND RELATED LOCATION (GEOSPATIAL) REGISTERS Street Type – The classification applied to the street by selecting from a controlled list to enable the differentiation between public, private, arterial, local and any other criteria into which a street may be classified. Locality – The link between the street and a parent locality and all the locality and region details together to become an integral part of the Streets Register. Street Version Control Number – An automated system of version control audit trail distinct identifiers linked to the original identifier used to enable the identification of changes applied to the original record and its subsequent replacements over a time period with a start-date and end-date for each version record. Fifth Schedule Localities Register The Localities Register shall include the following data elements: Locality URI – The number automatically generated by the Location Base Register and which is also used to identify the Locality when the Location Type is a Locality. The relevant spatial information shall be available to this register accordingly. Locality Name – The name of the Locality and which in the case of localities in the Gozo region may also for ease of identification include the Region Name to which the locality is linked. Locality Type – The applicable classification of the selected locality from a controlled list, and which enables the distinction between parent localities and sub-localities and other types of localities as may be decided from time to time. Parent Locality – The link between a sub-locality and its parent locality where in the case of the major localities the parent locality shall be the same identifier of the locality. Local Council – The link established between a locality and the local council, and which is derived from the official list of Local Councils as provided by the Local Government Act. (Cap. 363.) Region – The link established between a Locality and the Region within which it is located and which shall be derived from the Regions Register with all the pertinent information that may be derived from the Regions Register as annexed to the Localities Register.
